 COMMENTS:
  
 1. PROVIDE RESPONSES TO REVIEW COMMENTS IN A WRITTEN
 FORMAT.
  
 2. PURSUANT TO THE DEVELOPMENT APPLICATION (PAGE 2) A
 PLANNED DEVELOPMENT MINOR AMENDMENT REQUIRES SIX (6)
 SETS OF LANDSCAPE/SITE PLANS ARE REQUIRED.
 WHEN RESUBMITTING, PROVIDE SIX (6) SETS AND
 LANDSCAPE/SITE PLANS AND SURVEYS.
  
 JUSTIFICATION STATEMENT:
  
 3. PROVIDE AN ACTUAL NUMBER OF TREES THAT AREA EXISTING
 AND PROPOSED TO BE REMOVED, TAKE OUT ANY NOTATION
 SAYING "UP TO". FOR EXAMPLE, THERE ARE A TOTAL OF 62
 EXISTING OAK TREES, 53 WILL BE CUT DOWN AND 8 TO
 REMAIN, ETC.
 KEEP IN MIND, THAT THE NUMBERS ARE FOR GRAPHIC PURPOSES
 ONLY. THE ACTUAL NUMBER IS DIFFERENT.
  
 4. THERE ARE DISCREPANCIES THROUGHOUT THE PLANS AND
 JUSTIFICATION STATEMENTS OF HOW MANY TREES ARE BEING
 CUT DOWN, EXISTING, AND RELOCATED. ONE EXAMPLE IS ON
 SOME DOCUMENTS IS 8 OAK TREES TO REMAIN VS. IN THE
 LETTER TO MRS. LEBEN, QUAIL MEADOW FROM THE POA, PAT
 ERDMAN, 12 OAK TREES ARE TO REMAIN. CLARIFY ALL
 DISCREPANCIES ACCORDINGLY.
  
  
 SURVEY/SITE PLAN:
  
 5. PROVIDE SIX (6) COPIES OF A CURRENT SURVEY, WHICH
 INCLUDES THE PROPERTY'S ADDRESS AND LEGAL DESCRIPTION.
  
 6. I. SITE PLAN & LANDSCAPE PLAN
  
 SITE PLAN - SEE THE SITE PLAN CHECKLIST ON PAGE 14 OF
 THIS APPLICATION FOR THE REQUIRED INFORMATION; AND
  
 LANDSCAPE PLAN - SEE THE LANDSCAPE PLAN CHECKLIST ON
 PAGE 16 OF THIS APPLICATION FOR THE REQUIRED
 INFORMATION.
  
  IMPORTANT: ALL SITE PLANS AND LANDSCAPE PLANS SHALL
 ALSO BE SUBMITTED IN .PNG GRAPHIC FORMAT. ADDITIONALLY,
 TWO (2) SETS OF REDUCED PLANS (1 SET 8 " X 11" AND 1
 SET 11" X 17") SHALL BE PROVIDED.
  
 7. PROVIDE PLANS OF THE AERIALS ON 24"X36" SHEETS, SO
 THAT IT DEPICTS MORE OF THE AREA TO BE WORKED ON (I.E.
 ALL SHEETS 11X14 SHEETS THAT WERE SUBMITTED). LABEL THE
 STREETSCAPE TREE REMOVAL & RELOCATION PLAN WITH A SHEET
 NUMBER.
  
 8. SHOW ALL SITE DATA ON LANDSCAPE/SITE PLAN; THIS
 INCLUDES WHAT IS REQUIRED AND WHAT IS PROVIDED.
 PERCENTAGES NEED TO INCLUDE THE LANDSCAPE INFORMATION
 BELOW:
  
 PURSUANT TO SECTION 94-442 (C) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS ("ZLDR"), PALM TREES MAY BE
 SUBSTITUTED FOR NOT MORE THAN 35 PERCENT OF THE SHADE
 OR FLOWERING TREES REQUIRED BY THIS ARTICLE, EXCEPT AS
 SPECIFIED IN THE COMPREHENSIVE PLAN. HOWEVER, WHEN PALM
 TREES ARE SUBSTITUTED FOR SHADE TREES, TWO PALM TREES
 SHALL BE PROVIDED FOR EACH REQUIRED SHADE TREE. THIS
 2:1 SUBSTITUTION SHALL NOT BE REQUIRED FOR ROYAL PALM
 TREES AND SUCKERING PALM TREES SUCH AS THE ARECA PALM,
 PAUROTIS PALM AND THE SENEGAL DATE PALM.
  
 THE "STREET TREE MITIGATION PLAN" SHEETS SUBMITTED
 SHOWING THE STATUS/CONDITION OF THE TREES (GREEN COLOR)
 AND TREE RELOCATION TABLE (BLUE COLOR) INFORMATION
 NEEDS TO BE TRANSFERRED TO THE SITE PLAN. CLARIFY THE
 CALCULATIONS FOR THE "FINAL TAB." TABULATION IS? IT IS
 UNCLEAR WHERE THAT NUMBER WAS DERIVED FROM. FOR
 INSTANCE, IF THE EXISTING COUNT FOR THE OAK TREES IS
 84, THEN 35% OF THAT WOULD EQUAL THE TOTAL AMOUNT OF
 TREES THAT MAY BE SUBSTITUTED WITH PALM TREES, SEE
 SECTION 94-442 ABOVE. THIS DOES NOT COUNT FOR THE
 OVERALL TREE CANOPY THAT NEEDS TO BE MITIGATED FOR THE
 SUBSTITUTED TREES. WHAT IS THE PROPOSED SIZE FOR THE
 FOX TAIL PALMS AT INSTALLATION? THE "GREEN" MATRIX
 SHOWS A VARIATION OF 10' TO 30' QV MATURE?
  
 THE PROPOSAL EXCEEDS THE TOTAL 35% OF TREES THAT CAN BE
 MITIGATED (RELOCATED). FOR EXAMPLE, THE ORIGINAL
 APPROVED LANDSCAPE PLAN CALLED OUT FOR 84 CANOPY TREES
 TOTAL (OAK TREES WERE INSTALLED), ONE OF A VARIETY OF
 CANOPY TREES THAT WAS APPROVED. 35% OF THOSE TREES WILL
 BE 29 THAT CAN BE MITIGATED (RELOCATED) AND REPLACED
 WITH PALM TREES IN ACCORDANCE WITH THE COMMENTS FROM
 THE LANDSCAPE REVIEW BY ROBERT KUSSNER. THE REMAINDER
 OF OAK STREETS SHALL REMAIN AS PART OF THE LANDSCAPE
 STREETSCAPE APPROVED. IF ANY OF THOSE 29 OAK TREES CAN
 NOT BE RELOCATED DUE TO THE SIZE, ETC. BASED ON THE
 CITY'S STANDARDS, THEN THE TOTAL TREE CANOPY OF SAID
 TREE NEEDS TO BE MITIGATED WITH "X" OF TREES TO COVER
 FOR THE CANOPY LOST BY THE TREE THAT IS CUT DOWN,
 PURSUANT TO COMMENT NO. 9 BELOW. EVERY TREE WILL BE
 REVIEWED UNDER THIS MINOR PD AMENDMENT AND THE TREE
 ALTERATION PERMIT PROCESS IN ORDER TO ASCERTAIN IF A
 PARTICULAR TREE SHOULD BE LEFT IN ITS CURRENT PLACE DUE
 TO SURVIVABILITY AND THAT NO UTILITY CONFLICTS ARE
 PRESENT ONCE A COMPLETE RESUBMITTAL IS SUBMITTED THAT
 SHOWS ALL REQUIRED INFORMATION NOTED.
  
 PURSUANT TO SECTION 94-445 (4) (B) OF THE ZLDR, PALM
 SPECIES PLANTED SHALL BE REASONABLY RESISTANT TO LETHAL
 YELLOWING DISEASE. WHENEVER THE CLUSTERING OF PALM
 TREES IS UTILIZED, A MINIMUM OF THREE PALM TREES PER
 CLUSTER SHALL BE REQUIRED. PALM TREES THAT ARE EXEMPT
 FROM THE SUBSTITUTION REQUIREMENT PURSUANT TO SECTION
 SUBSECTION 94-442 (C) ARE ALSO EXEMPT FROM THE
 CLUSTERING REQUIREMENT.
  
 9. PURSUANT TO SECTION 94-448 (D) (4) OF THE ZLDR, THE
 APPLICANT FOR A TREE REMOVAL PERMIT SHALL BE REQUIRED
 TO RELOCATE OR REPLACE TREES TO BE REMOVED TO ALLOW
 PROPERTY USE, DEVELOPMENT, OR REDEVELOPMENT. RELOCATED
 TREES SHALL BE INSTALLED IN A SOUND AND SKILLED MANNER
 ACCORDING TO ACCEPTED PLANTING PRACTICES AND SHALL BE
 IN ACCORDANCE WITH THE FOLLOWING:
 A. IF THE TREE IS TRANSPLANTED, IT SHALL BE MOVED BY
 THE PROPERTY OWNER IN ACCORDANCE WITH THE NATIONAL
 ARBORIST ASSOCIATION STANDARDS TO ANOTHER LOCATION
 WITHIN THE CITY AND MAINTAINED BY THE NEW PROPERTY
 OWNER.
 B. IF A TREE ON PUBLIC PROPERTY IS WILLFULLY DESTROYED
 BY ANYONE EXCEPT THE CITY FORESTER/ARBORIST, THE TREE
 MUST BE SUBSTITUTED WITH AN EQUIVALENT REPLACEMENT THAT
 IS APPROVED BY THE FORESTER/ARBORIST OR DESIGNER ON THE
 SITE FROM WHICH THE DESTROYED TREE WAS REMOVED.
  
 COORDINATE WITH COMMENT NUMBER 8.
  
 AFTER APPROVAL OF THE MINOR AMENDMENT THAT ALL DATA IS
 IN ADHERENCE WITH THE ZLDR, THEN A TREE ALTERATION
 PERMIT WILL BE REQUIRED TO BE SUBMITTED TO THE PLANNING
 AND ZONING DEPARTMENT (ROBERT KUSSNER, LANDSCAPE
 PLANNER) NOTE: THE PLANS SUBMITTED FOR THE ALTERATION
 PERMIT NEED TO REFLECT THE SAME INFORMATION THAT IS
 BEING ASKED FOR THE MINOR AMENDMENT.
  
 10. PURSUANT TO SECTION 94-448 (E) (1),
 CHARACTERISTICS. REPLACEMENT TREES SHALL HAVE SHADE AND
 SCREENING POTENTIAL EQUAL TO OR SUPERIOR TO THAT OF THE
 TREES THEY REPLACE AT THE TIME OF THE INITIAL
 INSTALLATION.
  
 11. PURSUANT TO SECTION 94-448 (E) (2) MINIMUM
 STANDARDS. ALL REPLACEMENT TREES SHALL BE EQUAL TO OR
 BETTER THAN FLORIDA DEPARTMENT OF AGRICULTURE NUMBER 1
 NURSERY GRADE STANDARD. ALL TREES REPLACED OR RELOCATED
 PURSUANT TO THIS SECTION MUST BE IN A HEALTHY, LIVING
 CONDITION ONE YEAR FRO THE DATE OF PLANTING.
 REPLACEMENTS THAT ARE NOT ESTABLISHED, HAVE FAILED TO A
 DEGREE THAT SURVIVAL IS NOT PROBABLE, OR HAVE DIED MUST
 BE REPLACED WITH HEALTHY SPECIMENS. SUCH REPLACEMENTS
 MUST CONTINUE UNTIL A TREE IS ESTABLISHED AT THE
 APPROVED LOCATION.
  
 12. PROVIDE THE TREE SIZE, HEIGHT INCLUDING THE TREE
 CALIPER, OVERALL HEIGHT AT INSTALLATION, ETC. ON THE
 SITE DATA INFORMATION OF WHAT THE PROPOSED TREES WILL
 BE ON THE LANDSCAPE PLANS.
