 1. BASED ON VISUAL INSPECTION OF THE EXISTING ROADWAY
 CONDITION , DRIVEWAYS, AND SIDEWALK, THE CONDITION OF
 EXISTING INFRASTRUCTURE APPEARS TO BE IN GOOD
 CONDITION. EVIDENCE OF TREE ROOT DAMAGE OR CONFLICT IS
 MINIMAL AND LESS THAN WOULD NORMALLY BE EXPECTED, IN
 CONSIDERATION OF THE TREE MATURITY AND PLANTING
 LOCATION. THERE IS LITTLE EVIDENCE OF ROADWAY,
 SIDEWALK, OR CURB REPAIR ATTRIBUTED TO POSSIBLE TREE
 ROOT DAMAGE. WHAT EVIDENCE OF CONFLICT THAT IS PRESENT
 IS MINOR AND HAS BEEN MITIGATED. BASED ON SERVICES
 RECORDS AS PROVIDED BY THE PUBLIC UTILITIES DEPARTMENT
 CENTRAL OPERATIONS, BETWEEN 2005-2010 THERE ARE NO
 RECORDS OF WATER MAIN BREAKS OR DAMAGE TO THE UTILITY
 SYSTEM. THERE ARE RECORDS OF THREE (3) INDIVIDUAL
 RESIDENTIAL SERVICE LINE CALLS FOR SERVICE. ALL CALLS
 WERE CUSTOMER SIDE SERVICE PROBLEMS RELATED TO
 IRRIGATION PROBLEMS. THERE ARE RECORDS OF SEVEN (7)
 INDIVIDUAL RESIDENTIAL SERVICE COMPLAINTS FOR LOW
 PRESSURE, ALL WERE CORRECTED AND UNATTRIBUTED TO TREE
 ROOT RELATED CONFLICTS.
  
 2. THE PROPOSED MITIGATION TREES (HOLLY, CLUSIA, ORANGE
 GEIGER) ARE TYPE THREE MATRIX (COLUMNAR) AND TYPE FOUR
 MATRIX (VASE) SHAPED TREES, AS CLASSIFIED BY THE
 FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES
 GRADES AND STANDARDS. THESE TREES ARE NOT COMPARABLE TO
 THE EXISTING LIVE OAK IN MATURE SIZE AND CANOPY SPREAD
 AND SHOULD BE CONSIDERED FOR MITIGATION BY A MULTIPLING
 FACTOR OF 3:1.
  
 3. THE RLA CONCEPT PLANS REPRESENT THAT 90% OF THE
 PROPOSED TREES TO BE REMOVED WILL BE REPLACED BY
 FOXTAIL PALMS. BASED ON VISUAL INSPECTION AND
 PROFESSIONAL EXPERIENCE, THE FOXTAIL PALMS INSTALLATION
 WILL REQUIRE THE REMOVAL OF THE EXISTING LIVE OAK ROOT
 BALL IN ORDER TO PROVIDE A VIABLE PLANTING LOCATION.
 THIS ACTIVITY WAS NOT REPRESENTED IN THE PROPOSED WORK.
 IF ANY OF THE ROOT BALLS ARE REMOVED, ENGINEERING WILL
 REQUIRE A SEPARATE SUBMISSION FOR PERMIT AND ASSIGNMENT
 FOR PROTECTION OF THE PUBLIC UTILITY SYSTEM ASSETS.

 THIS REVIEW IS IN RESPONSE TO THE DAMAGE REPORTS
 RECEIVED ON 5/9/11. PLEASE BE AWARE THAT ALL OF THE
 COMMENTS MADE ON 12/29/10 STILL APPLY.
  
 1. THE FIRST FIVE PHOTOGRAPHS DID NOT REFERENCE THE
 LOCATION OF THE DAMAGE. IT IS UNCLEAR TO ME AS TO WHAT
 THESE PHOTOS ARE DEPICTING. THERE APPEARS TO BE A PHONE
 OR CABLE TV WIRE THAT WAS PREVIOUSLY SPLICED. THESE
 CABLES ARE ALWAYS INSTALLED CLOSE TO THE SURFACE AND
 NEED TO BE REPAIRED FROM TIME TO TIME. LAWN MAINTENANCE
 CREWS HAVE BEEN KNOWN TO DAMAGE LINES BY INSTALLING
 PLANT MATERIAL OR EVEN RUNING AN EDGER AROUND A BED.
 PHOTO # 6 SHOWS A PATCH IN THE STREET, BUT NO TREE IS
 SHOWN IN THE PHOTO AND THE CURB APPEARS TO BE ORIGINAL
 AND UNDISTURBED. PHOTO # 7 SHOWS A DISCOLORATION AROUND
 A WATER METER. AGAIN, NO TREE IS IN CLOSE PROXIMITY AND
 WATER METERS HAVE BEEN KNOWN TO LEAK. PHOTOS # 8-10 DO
 SHOW TREE DAMAGE TO SIDEWALKS. HOWEVER, THE
 INSTALLATION OF ROOT BARRIERS COULD HAVE PREVENTED THIS
 SITUATION. PHOTOS # 11-12 SHOW DAMAGE IN THE REAR OR
 SIDE OF A HOME. IT WOULD BE EXTREMELY UNLIKELY THAT
 ROOTS FROM A STREET TREE COULD HAVE CAUSED THIS DAMAGE.
 PHOTOS #11 AND 12 ARE NOT SHOWING ANY DAMAGE.
  
 2. CONCERNING THE WRITTEN COMPLAINTS, EIGHT OF THE
 SIXTEEN COMPLAINTS REFER TO THE TREES AS BEING DIRTY
 AND/OR DROPPING ACORNS. THE LENGTH OF TIME THAT THESE
 TREES DROP ACORNS IS QUITE LIMITED. PERHAPS IF THE LAWN
 CREW WERE VACUUMING THE PAVED AREAS DURING THE TIME OF
 ACORN AND LEAF DROP INSTEAD OF USING A BLOWER, THE
 PROBLEM WOULD BE RESOLVED. MAINTENANCE IS REQUIRED FOR
 ALL LIVING THINGS. I AM CERTAIN THAT THE DOLLARS
 ALLOCATED FOR LAWN MAINTENANCE OF YOUR COMMUNITY FAR
 EXCEEDS THE DOLLARS ALLOCATED FOR TREE CARE. THE
 ELIMINATION OF ALL TREES WOULD RESOLVE THE PROBLEM. THE
 SAME ANALOGY CAN BE DRAWN THAT IF ALL OF THE LAWN AREAS
 WERE ELIMINATED, THERE WOULD BE NO NEED TO MOW THE
 GRASS. ONE OF THE LETTERS INDICATED THAT THE THATCH IN
 THE LAWN WAS CAUSED BY THE TREES. THATCH IS CAUSED BY
 NOT PICKING UP THE GRASS CUTTINGS AFTER MOWING AND
 MOWING AT TOO HIGH OF A SETTING. THE GENTLEMAN ALSO
 STATED: "THE LEAVES ARE HARDLY EVER CLEANED UP". AGAIN,
 I WOULD ATTRIBUTE THE PROBLEM TO THE LACK OF PROPER
 MAINTENANCE. I WOULD ALSO DISPUTE THE NEWS ARTICLE
 CONCERNING POLLEN LEVELS IN WEST PALM BEACH. I GOT ONTO
 THE POLLEN.COM WEBSITE REFERENCED IN THE NEWS ARTICLE
 AND FOUND THE EXACT OPPOSITE RESULTS STATED IN THE
 ARTICLE. I HAVE A PRINT OUT TAKEN DIRECTLY FROM THEIR
 WEBSITE THAT SHOWS SOUTH FLORIDA, INCLUDING WEST PALM
 BEACH, AS HAVING A LOW TO MODERATE POLLEN COUNT AND AS
 BEING ONE OF THE BEST PLACES IN THE COUNTRY TO LIVE IF
 YOU HAVE AN ALLERGY.
  
 3. REGARDING THE INVOICES, INVOICE # 267 AND 622 ARE
 VALID EXPENSES INCURRED BY HAVING THE TREES. THE TWO
 INVOICES TOTAL $2,750 AND WERE PAID OUT ALMOST TWO
 YEARS AGO. I BELIEVE THAT THE DOLLAR AMOUNT SPENT IS
 LOW CONSIDERING THE COST OF THIS PROPOSED PROJECT. ONE
 OF THE INVOICES REFERENCED A BROKEN MAINLINE WITHIN A
 SLEEVE. I AM NOT CLEAR ON HOW THE MAINLINE WITHIN A
 SLEEVE WAS DAMAGED BY A TREE WHEN THE SLEEVE WAS NOT
 DAMAGED. ANOTHER INVOICE WAS FOR REPAIR OF BROKEN
 IRRIGATION LINES CAUSED BY CONCRETE REPAIR. IF THE
 CONCRETE COMPANY DAMAGED LINES IN THE COURSE OF DOING
 THEIR JOB, HOW IS THAT CAUSED BY THE TREES?

 4. PURSUANT TO SECTION 94-442 (C), PALM TREES MAY BE
 SUBSTITUTED FOR NOT MORE THAN 35 PERCENT OF THE SHADE
 OR FLOWERING TREES REQUIRED BY THIS ARTICLE, EXCEPT AS
 SPECIFIED IN THE COMPREHENSIVE PLAN. HOWEVER, WHEN PALM
 TREES ARE SUBSTITUTED FOR SHADE TREES, TWO PALM TREES
 SHALL BE PROVIDED FOR EACH REQUIRED SHADE TREE. THIS
 2:1 SUBSTITUTION SHALL NOT BE REQUIRED FOR ROYAL PALM
 TREES AND SUCKERING PALM TREES SUCH AS THE ARECA PALM,
 PAUROTIS PALM AND THE SENEGAL DATE PALM. THE PROPOSED
 FOXTAIL PALMS ARE NOT EXEMPT FROM THE 2:1 SUBSTITUTION
 AND ONLY 35% OF THE REQUIRED STREET TREES CAN BE PALMS.

 REQUIRED TO HAVE ONE SHADE OR FLOWERING TREES. A TOTAL
 OF 29 OF THE 84 TREES CAN BE PALMS.
  
 5. PURSUANT TO SECTION 94-445 (4) (B), PALM SPECIES
 PLANTED SHALL BE REASONABLY RESISTANT TO LETHAL
 YELLOWING DISEASE. WHENEVER THE CLUSTERING OF PALM
 TREES IS UTILIZED, A MINIMUM OF THREE PALM TREES PER
 CLUSTER SHALL BE REQUIRED. PALM TREES THAT ARE EXEMPT
 FROM THE SUBSTITUTION REQUIREMENT PURSUANT TO SECTION
 SUBSECTION 94-442 (C) ARE ALSO EXEMPT FROM THE
 CLUSTERING REQUIREMENT.
  
 6. PURSUANT TO SECTION 94-448 (D) (4), THE APPLICANT
 FOR A TREE REMOVAL PERMIT SHALL BE REQUIRED TO RELOCATE

 DEVELOPMENT, OR REDEVELOPMENT. RELOCATED TREES SHALL BE
 INSTALLED IN A SOUND AND SKILLED MANNER ACCORDING TO

 WITH THE FOLLOWING:
 A. IF THE TREE IS TRANSPLANTED, IT SHALL BE MOVED BY
 THE PROPERTY OWNER IN ACCORDANCE WITH THE NATIONAL
 ARBORIST ASSOCIATION STANDARDS TO ANOTHER LOCATION
 WITHIN THE CITY AND MAINTAINED BY THE NEW PROPERTY
 OWNER.
 B. IF A TREE ON PUBLIC PROPERTY IS WILLFULLY DESTROYED
 BY ANYONE EXCEPT THE CITY FORESTER/ARBORIST, THE TREE
 MUST BE SUBSTITUTED WITH AN EQUIVALENT REPLACEMENT THAT
 IS APPROVED BY THE FORESTER/ARBORIST OR DESIGNER ON THE
 SITE FROM WHICH THE DESTROYED TREE WAS REMOVED.
  
 7. PURSUANT TO SECTION 94-448 (E) (1), CHARACTERISTICS.
 REPLACEMENT TREES SHALL HAVE SHADE AND SCREENING
 POTENTIAL EQUAL TO OR SUPERIOR TO THAT OF THE TREES
 THEY REPLACE AT THE TIME OF THE INITIAL INSTALLATION.
 ALL REPLACEMENTS SHALL BE SHADE TREES AND NOT A MIX OF
 PALMS AND SHADE TREES. THE PROPOSED HOLLY, CLUSIA AND
 GEIGER TREES WILL NEVER DEVELOP A CANOPY AS LARGE AS AN
 OAK. TREES SELECTED FOR MITIGATION SHALL HAVE THE
 CAPABILITY TO DEVELOP INTO LARGE SHADE OR FLOWERING
 TREES.
  
 8. ALL PROPOSED TREES SHALL BE IDENTIFIED BY SCIENTIFIC
 NAME, COMMON NAME, HEIGHT, SPREAD OF CANOPY AND THE
 NUMBER OF FEET OF CLEAR TRUNK. PLEASE PROVIDE THE
 OVERALL MINIMUM HEIGHT AND THE AMOUNT OF GRAY WOOD OF
 THE PROPOSED PALMS.
  
 9. PURSUANT TO SECTION 94-448 (E) (2) MINIMUM
 STANDARDS. ALL REPLACEMENT TREES SHALL BE EQUAL TO OR

 CANOPY TREES THAT WAS APPROVED. 35% OF THOSE TREES WILL
 BE 29 THAT CAN BE MITIGATED (RELOCATED) AND REPLACED
 WITH PALM TREES IN ACCORDANCE WITH THE COMMENTS FROM
 THE LANDSCAPE REVIEW BY ROBERT KUSSNER. THE REMAINDER
 OF OAK STREETS SHALL REMAIN AS PART OF THE LANDSCAPE
 STREETSCAPE APPROVED. IF ANY OF THOSE 29 OAK TREES CAN
 NOT BE RELOCATED DUE TO THE SIZE, ETC. BASED ON THE
 CITY'S STANDARDS, THEN THE TOTAL TREE CANOPY OF SAID
 TREE NEEDS TO BE MITIGATED WITH "X" OF TREES TO COVER
 FOR THE CANOPY LOST BY THE TREE THAT IS CUT DOWN,
 PURSUANT TO COMMENT NO. 9 BELOW. EVERY TREE WILL BE
 REVIEWED UNDER THIS MINOR PD AMENDMENT AND THE TREE
 ALTERATION PERMIT PROCESS IN ORDER TO ASCERTAIN IF A
 PARTICULAR TREE SHOULD BE LEFT IN ITS CURRENT PLACE DUE
 TO SURVIVABILITY AND THAT NO UTILITY CONFLICTS ARE
 PRESENT ONCE A COMPLETE RESUBMITTAL IS SUBMITTED THAT
 SHOWS ALL REQUIRED INFORMATION NOTED.
  
 PURSUANT TO SECTION 94-445 (4) (B) OF THE ZLDR, PALM
 SPECIES PLANTED SHALL BE REASONABLY RESISTANT TO LETHAL
 YELLOWING DISEASE. WHENEVER THE CLUSTERING OF PALM
 TREES IS UTILIZED, A MINIMUM OF THREE PALM TREES PER
 CLUSTER SHALL BE REQUIRED. PALM TREES THAT ARE EXEMPT
 FROM THE SUBSTITUTION REQUIREMENT PURSUANT TO SECTION
 SUBSECTION 94-442 (C) ARE ALSO EXEMPT FROM THE
 CLUSTERING REQUIREMENT.
  
 9. PURSUANT TO SECTION 94-448 (D) (4) OF THE ZLDR, THE
 APPLICANT FOR A TREE REMOVAL PERMIT SHALL BE REQUIRED
 TO RELOCATE OR REPLACE TREES TO BE REMOVED TO ALLOW
 PROPERTY USE, DEVELOPMENT, OR REDEVELOPMENT. RELOCATED
 TREES SHALL BE INSTALLED IN A SOUND AND SKILLED MANNER
 ACCORDING TO ACCEPTED PLANTING PRACTICES AND SHALL BE
 IN ACCORDANCE WITH THE FOLLOWING:
 A. IF THE TREE IS TRANSPLANTED, IT SHALL BE MOVED BY
 THE PROPERTY OWNER IN ACCORDANCE WITH THE NATIONAL
 ARBORIST ASSOCIATION STANDARDS TO ANOTHER LOCATION
 WITHIN THE CITY AND MAINTAINED BY THE NEW PROPERTY
 OWNER.
 B. IF A TREE ON PUBLIC PROPERTY IS WILLFULLY DESTROYED
 BY ANYONE EXCEPT THE CITY FORESTER/ARBORIST, THE TREE
 MUST BE SUBSTITUTED WITH AN EQUIVALENT REPLACEMENT THAT
 IS APPROVED BY THE FORESTER/ARBORIST OR DESIGNER ON THE
 SITE FROM WHICH THE DESTROYED TREE WAS REMOVED.
  
 COORDINATE WITH COMMENT NUMBER 8.
  
 AFTER APPROVAL OF THE MINOR AMENDMENT THAT ALL DATA IS
 IN ADHERENCE WITH THE ZLDR, THEN A TREE ALTERATION
 PERMIT WILL BE REQUIRED TO BE SUBMITTED TO THE PLANNING
 AND ZONING DEPARTMENT (ROBERT KUSSNER, LANDSCAPE
 PLANNER) NOTE: THE PLANS SUBMITTED FOR THE ALTERATION
 PERMIT NEED TO REFLECT THE SAME INFORMATION THAT IS
 BEING ASKED FOR THE MINOR AMENDMENT.
  
 10. PURSUANT TO SECTION 94-448 (E) (1),
 CHARACTERISTICS. REPLACEMENT TREES SHALL HAVE SHADE AND
 SCREENING POTENTIAL EQUAL TO OR SUPERIOR TO THAT OF THE
 TREES THEY REPLACE AT THE TIME OF THE INITIAL
 INSTALLATION.
  
 11. PURSUANT TO SECTION 94-448 (E) (2) MINIMUM
 STANDARDS. ALL REPLACEMENT TREES SHALL BE EQUAL TO OR
 BETTER THAN FLORIDA DEPARTMENT OF AGRICULTURE NUMBER 1
 NURSERY GRADE STANDARD. ALL TREES REPLACED OR RELOCATED
 PURSUANT TO THIS SECTION MUST BE IN A HEALTHY, LIVING
 CONDITION ONE YEAR FRO THE DATE OF PLANTING.
 REPLACEMENTS THAT ARE NOT ESTABLISHED, HAVE FAILED TO A
 DEGREE THAT SURVIVAL IS NOT PROBABLE, OR HAVE DIED MUST
 BE REPLACED WITH HEALTHY SPECIMENS. SUCH REPLACEMENTS
 MUST CONTINUE UNTIL A TREE IS ESTABLISHED AT THE
 APPROVED LOCATION.
  
 12. PROVIDE THE TREE SIZE, HEIGHT INCLUDING THE TREE
 CALIPER, OVERALL HEIGHT AT INSTALLATION, ETC. ON THE
 SITE DATA INFORMATION OF WHAT THE PROPOSED TREES WILL
 BE ON THE LANDSCAPE PLANS.
