| CONDITIONS ARE MET: SEPARATION DISTANCE. A MEDICAL |
| MARIJUANA DISPENSARY SHALL NOT BE LOCATED WITHIN 500 |
| FEET OF THE REAL PROPERTY THAT COMPRISES A PUBLIC OR |
| PRIVATE ELEMENTARY SCHOOL, MIDDLE SCHOOL, OR SECONDARY |
| SCHOOL, UNLESS WAIVED BY THE CITY COMMISSION PURSUANT |
| TO F.S. 381.986. |

| 1. THERE IS A SCHOOL (BILGRAV SCHOOL - 307 EVERNIA |
| STREET, 2ND FLOOR) LOCATED WITHIN THE 500-FOOT |
| PROXIMITY THAT PROHIBITS THE USE OF A MEDICAL MARIJUANA |
| DISPENSARY FROM OCCUPYING AND OPERATING WITHIN THIS |
| PROPERTY/LOCATION. |

| HAS COME TO THE CONCLUSION AND FINAL ZONING |
| INTERPRETATION: |
| SHOULD THE "BACK-WALL" OF THE DISPENSARY USE OR |
| TENANT'S OPERATION FALL WITHIN THE 500 FT. BUFFER FROM |
| THE SCHOOL, THE USE OR OCCUPATION OF THIS SPACE FOR A |
| MEDICAL MARIJUANA DISPENSARY IS NOT PERMITTED. ANY |
| DISPENSARY USE WOULD HAVE TO FALL OUTSIDE OF THIS 500 |
| FT. BUFFER AND TERMINATE AT THE BOUNDARY. |
