| NEW HANDHOLE IN THE 44TH STREET RIGHT-OF-WAY CROSSING A |
| PORTION OF PRIVATE PROPERTY. IN ORDER FOR THE |
| UNDERGROUND ELECTRIC TO CROSS PRIVATE PROPERTY, IT MUST |
| BE LOCATED WITHIN A GENERAL UTILITY EASEMENT. THE |
| SURVEY DOES NOT SHOW AN EASEMENT AT THIS LOCATION. IF |
| THERE IS AN EASEMENT, IT MUST BE SHOWN ON THE SURVEY |
| AND THE UNDERGROUND ELECTRIC MUST CLEARLY BE SHOWN IN |
| THE EASEMENT. IF NO EASEMENT IS PRESENT, THE |
| UNDERGROUND ELECTRIC MUST COME FROM AN ALTERNATIVE |
| LOCATION. |

| 2) THE SURVEY SHOWS THE UNDERGROUND POWER LOCATED AT A |
| DIFFERENT LOCATION THAN THE ENGINEERING PLAN. BOTH |
| PLANS SHOW THE PORTION OF THE UNDERGROUND ELECTRIC |
| ROUTE FROM THE WESTERN HANDHOLE TO BROADWAY WITHIN THE |
| CITY'S RIGHT-OF-WAY, BUT SINCE THEY ARE NOT THE SAME, |
| THEY SHOW PROXIMITY TO DIFFERENT EXISTING CITY |
| INFRASTRUCTURE. THE IMPACT TO THE INFRASTRUCTURE, IF |
| ANY, CAN ONLY BE IDENTIFIED WITH ACCURATE PLANS. |

| 3) PROVIDE CROSS SECTIONS OF THE LOCATION OF THE |
| UNDERGROUND ELECTRIC (VERSION USED IN COMMENT #2 |
| ABOVE), INCLUDING THE EXISTING UNDERGROUND |
| INFRASTRUCTURE, FOR 44TH STREET WHICH VERIFIES THAT |
| THERE ARE NO CONFLICTS. |

| THE FACILITY/POLE SHOWN WITH THESE PLANS COMPLIES WITH |
| CITY REQUIREMENTS. |
