 THANK YOU FOR THE COMMENTS SUBMITTED IN THIS LATEST
 REVIEW CYCLE. I WILL TRY TO EXPLAIN IN THIS RESPONSE
 WHY YOU MUST COMPLY WITH THE CODE SECTION 403.3.1.1 AND
 TABLE 403.3.1.1 OR PROVIDE APPROVED (BY THE CODE
 OFFICIAL) STATISTICAL DATA. A LETTER FROM THE ENGINEER
 AND THE ARCHITECT STATING THAT THESE AREAS ARE PRIVATE
 IS NOT ACCEPTABLE TO THIS REVIEWER AS NEITHER OF YOU
 HAVE CONTROL OF THE USE OF THESE AREAS.
 THIS BUILDING IS A 25 STORY BUILDING OF CONDO?S TO BE
 SOLD. THE OWNER?S OF THESE CONDO?S WILL HAVE FRIENDS
 AND FAMILY OVER. THIS WILL EFFECT THE OCCUPANT COUNT OF
 THESE AREAS. IN THE ENGINEER?S LETTER THE FURNITURE IS
 BEING CALLED PERMANENT. I SEE NO WAY OF CALLING THE
 FURNITURE PERMANENT AS IT IS NOT SECURED IN PLACE AND
 COULD BE MOVED OR ADDED TO. AGAIN THE ARCHITECT OR
 ENGINEER HAS NO CONTROL OF THIS BUILDING AND HOW THE
 FURNITURE WILL BE MAINTAINED.
 THE LOUNGE AREAS SHOW FURNITURE DESIGNS MUCH LIKE YOU
 COULD FIND IN A RESIDENCE. THIS TYPE OF FURNITURE DOES
 WEAR OUT AND WOULD NEED TO BE REPLACED AT SOME POINT.
 THERE IS ROOM IN EACH OF THESE AREAS TO INSTALL MORE
 FURNITURE, MORE FURNITURE EQUALS MORE PEOPLE. THERE ARE
 AREAS IN EACH SPACE WHERE OCCUPANTS COULD STAND.
 AS WE KNOW THE CODE COMMENTARY IS NOT ENFORCEABLE BUT
 ONLY AN EXPLANATION AS TO THE INTENT OF THE CODE. I
 HAVE QUOTED THE 2018 IMC COMMENTARY BELOW THAT STATES
 YOU MUST MEET MINIMUMS TO JUSTIFY NOT USING TABLE
 403.3.1.1, IN THIS LATEST REVIEW CYCLE YOU HAVE NOT
 DONE SO.
  
 IMC CODE COMMENTARY:
 ?THE EXCEPTION ALLOWS THE OCCUPANT LOAD FOR VENTILATION
 TO BE BASED ON THE ACTUAL OCCUPANT FOR WHICH THE SPACE
 IS DESIGNED WHERE IT CAN BE SHOWN TO THE CODE
 OFFICIAL?S SATISFACTION THAT THE OCCUPANT LOAD IS
 REALISTIC. THE OCCUPANT DENSITY ENTRIES IN TABLE
 403.3.1.1 ARE BASED ON EMPIRICAL DATA AND ARE
 REASONABLY ACCURATE FOR THE TYPICAL CASES IN EACH TYPE
 OF OCCUPANCY. SUFFICIENT DOCUMENTATION MUST BE
 SUBMITTED TO THE CODE OFFICIAL TO JUSTIFY ANY DEVIATION
 FROM THE PRESCRIBED OCCUPANT DENSITIES.
  
 2) SHEET M2.102D: THE ADDED EXHAUST FAN EF-8 IN THE
 WARMING KITCHEN, THE TERMINATION LOCATION MUST BE A
 MINIMUM OF 10 FEET FROM THE OUTDOOR AIR INTAKE. FMC
 501.3.1 NUMBER 3
  
 1) PLEASE SEE THE 2ND CYCLE REVIEW COMMENT BELOW:
  
 1) PLEASE USE FMC 403.3.1.1 3RD SENTENCE AND TABLE
 403.3.1.1 TO DETERMINE THE OCCUPANCY CLASSIFICATION
 USED TO PROVIDE THE OUTDOOR AIR FOR EACH USE OF SPACE.
 THE ARCHITECTS EGRESS OCCUPANT COUNT CANNOT BE USED TO
 DETERMINE THE OUTDOOR AIR NEEDED FOR THE OCCUPANCY
 CLASSIFICATION. PLEASE NAME EACH SPACE PER THE CLOSEST
 OCCUPANCY CLASSIFICATION OF TABLE 403.3.1.1 AND PROVIDE
 THE OUTDOOR AIR CALCULATIONS USING THE TABLE 403.3.1.1
 AND NOT THE ARCHITECTS EGRESS OCCUPANT COUNTS. EXAMPLE:
 BUSINESS/MEETING COULD BE A CONFERENCE ROOM WHICH IF
 USING THE CALCULATIONS IN TABLE 403.3.1.1 WOULD REQUIRE
 149 CFM OF OUTDOOR AIR.
  
  
 WHEN RESUBMITTING, IT IS HELPFUL TO PROVIDE A RESPONSE
 LETTER ADDRESSING EACH ITEM.
