 THE NEW RULING BY FDEP (SEE BELOW) RELEASES THE CITY
 FROM REQUIRING APPROVAL BY FDEP, THE APPLICANT IS
 REQUIRED TO ADDRESS THE COMMENTS OF THEIR EXEMPTION
 REQUEST SUBMITTED FOR REVIEW -
 DENIED BY FDEP.

 EFFECTIVE DATE: 7/01/2020
  
 AS OF JULY 1, 2020, SECTION 403.813, FLORIDA STATUTES,
 NOW PROHIBITS LOCAL GOVERNMENTS FROM REQUIRING FURTHER
 VERIFICATION FROM DEP THAT A PARTICULAR CONSTRUCTION
 ACTIVITY MEETS AN ERP EXCEPTION. IN ADDITION, THE
 CHANGES REVISED THE ERP EXCEPTION FOR THE REPLACEMENT
 OR REPAIR OF EXISTING DOCKS AND PIERS TO ALLOW FOR THE
 REPAIR OR REPLACEMENT IF IT IS WITHIN FIVE FEET OF THE
 SAME LOCATION AND NO LARGER THAN THE EXISTING DOCK OR
 PIER AND NO ADDITIONAL AQUATIC RESOURCES ARE ADVERSELY
 AND PERMANENTLY IMPACTED.
  
 PLEASE NOTE THAT EFFECTIVE 7/1/20, IN ADDITION TO THE
 DOCK REPAIR AND REPLACEMENT COVERED IN THE EMAIL ABOVE,
 SECTION 403.813(1)(B) OF FLORIDA STATUTES ALSO STATES
 THAT, IN AN AREA THAT IS NOT DESIGNATED AS OUTSTANDING
 FLORIDA WATERS, WE CANNOT REQUIRE DEP APPROVAL FOR THE
 INSTALLATION OF A PRIVATE DOCK THAT HAS 1,000 SQUARE
 FEET OR LESS OF OVER-WATER SURFACE AREA. THAT INCLUDES
 A NEW DOCK THAT IS NOT REPLACING AN EXISTING DOCK.
  
 BASED ON MY RESEARCH USING THE LINK BELOW TO THE
 ?OFFICIAL STATE OF FLORIDA GEOGRAPHIC DATA PORTAL?, THE
 CITY OF WEST PALM BEACH DOES NOT CURRENTLY HAVE ANY
 AREAS DESIGNATED AS OUTSTANDING FLORIDA WATERS.

 REQUIRE DEP APPROVAL FOR THE INSTALLATION OF A PRIVATE
 DOCK THAT HAS 500 SQUARE FEET OR LESS OF OVER-WATER
