 PROVIDE WRITTEN RESPONSE TO COMMENTS.
  
 THE FOLLOWING ITEMS NEED TO BE ADDRESSED OR THE PERMIT
 WILL NOT BE APPROVED.
  
 1) THE ENGINEERING PLAN -
  
 A. SHEET 27 DOES NOT SHOW THE RIGHT-OF-WAY LINE IN THE
 SAME LOCATION AS THE SURVEY BOTH ALONG THE M CANAL AND
 2130 ECHO LAKE DRIVE. ONCE THE RIGHT-OF-WAY LINE IS
 CORRECTLY SHOWN, IT APPEARS THAT IT WILL CLEARLY VERIFY
 THAT THE FIBER INSTALLATION AND THE HANDHOLE ARE WITHIN
 THE CONGRESS AVENUE RIGHT-OF-WAY, WHICH WILL BE SUBJECT
 TO PALM BEACH COUNTY RIGHT-OF-WAY APPROVAL ONLY.
  
 B. 4441 BEACON CIRCLE IS PRIVATE PROPERTY. THE HANDHOLE
 AND FIBER INSTALLATION MAY ONLY OCCUR ON PRIVATE
 PROPERTY WITHIN A UTILITY EASEMENT (AND THEN IS NOT
 SUBJECT TO THE RIGHT-OF-WAY PERMIT APPLICATION). NO
 VERIFICATION OF THE UTILITY EASEMENT SHOWN ON THE
 ENGINEERING PLAN WAS PROVIDED ON THE SURVEY. IF THERE
 IS NO UTILITY EASEMENT HERE, THEN THE INSTALL MUST BE
 DONE WITHIN THE CONGRESS AVENUE RIGHT-OF-WAY AND IS
 SUBJECT TO PALM BEACH COUNTY PERMITTING.
  
 C. 4400 NORTH CONGRESS AVENUE IS PRIVATE PROPERTY. THE
 FIBER INSTALLATION MAY ONLY OCCUR ON PRIVATE PROPERTY
 WITHIN A UTILITY EASEMENT (AND THEN IS NOT SUBJECT TO
 THE RIGHT-OF-WAY PERMIT APPLICATION). NO VERIFICATION
 OF THE UTILITY EASEMENT SHOWN ON THE ENGINEERING PLAN
 WAS PROVIDED ON THE SURVEY. IF THERE IS NO UTILITY
 EASEMENT HERE, THEN THE INSTALL MUST BE DONE WITHIN THE
 CONGRESS AVENUE RIGHT-OF-WAY AND IS SUBJECT TO PALM
 BEACH COUNTY PERMITTING.
  
 D. LOMBARD STREET IS A PRIVATELY OWNED RIGHT-OF-WAY AND
 THUS NOT SUBJECT TO THE COMMUNICATION FACILITY WITHIN
 THE RIGHT-OF-WAY PERMIT; HOWEVER, YOU MAY NOT INSTALL
 THE FIBER AT THIS LOCATION WITH PROVIDING VERIFICATION
 ON THE SURVEY THAT UTILITY ARE PERMITTED TO BE
 INSTALLED WITHIN THE LOMBARD STREET PARCEL. IF THERE IS
 NO UTILITY EASEMENT HERE, THEN THE INSTALL MUST BE DONE
 WITHIN THE CONGRESS AVENUE RIGHT-OF-WAY AND IS SUBJECT
 TO PALM BEACH COUNTY PERMITTING.
  
 2) SURVEY -
  
 A. THE SURVEY DOES NOT SHOW THE RIGHT-OF-WAY LINE FOR
 CONGRESS AVENUE WHERE IT CROSSES THE WEST PALM BEACH
 CANAL. STAFF CANNOT VERIFY IF THE BORE SHOWN ON THE
 ENGINEERING PLAN IS WITHIN THE CONGRESS AVENUE
 RIGHT-OF-WAY (AND THUS SUBJECT TO PALM BEACH COUNTY
 PERMITTING) OR THE CITY'S CANAL RIGHT-OF-WAY AND
 SUBJECT TO THIS APPLICATION.
  
 B. 4441 BEACON CIRCLE IS PRIVATE PROPERTY. THE
 ENGINEERING PLAN SHOWS THAT THE HANDHOLE AND FIBER
 INSTALLATION IS ON THIS PRIVATE PROPERTY WITHIN A
 UTILITY EASEMENT. THE SURVEY FAILS TO SHOW A UTILITY
 EASEMENT. IF THERE IS A UTILITY EASEMENT AT THIS
 LOCATION, THEN IT MUST BE SHOWN ON THE SURVEY.
  
 C. 4400 NORTH CONGRESS AVENUE IS PRIVATE PROPERTY. THE
 ENGINEERING PLAN SHOWS THAT THE FIBER INSTALLATION IS
 ON THIS PRIVATE PROPERTY WITHIN A UTILITY EASEMENT. THE
 SURVEY FAILS TO SHOW A UTILITY EASEMENT. IF THERE IS A
 UTILITY EASEMENT AT THIS LOCATION, THEN IT MUST BE
 SHOWN ON THE SURVEY.
  
 D. LOMBARD STREET IS PRIVATE PROPERTY (A PRIVATE
 RIGHT-OF-WAY). THE ENGINEERING PLAN SHOWS THAT THE
 FIBER INSTALLATION IS ON THIS PRIVATE PROPERTY. THE
 SURVEY FAILS TO VERIFY THAT UTILITIES MAY BE INSTALLED
 WITHIN THE LOMBARD STREET PARCEL. IF THERE IS A UTILITY
 EASEMENT OR UTILITY INSTALLATION ALLOWANCE AT THIS
 LOCATION, THEN IT MUST BE SHOWN ON THE SURVEY.
  
 PLEASE NOTE:
  
 THE INSTALLATION CONTRACTOR MUST CONTACT SUNSHINE 811
 TO VERIFY THE LOCATION OF ALL UTILITIES AND VERIFY ALL
 DEPTHS PRIOR TO CONSTRUCTION. ALL CITY UTILITIES MUST
 BE LOCATED BY SOFT DIG METHODS BEFORE STARTING THE
 WORK.
  
 THE RIGHT-OF-WAY USE PERMIT REQUIRES YOU TO PROVIDE A
 CERTIFICATE OF LIABILITY INSURANCE, WHICH IN ACCORDANCE
 WITH SECTION 78-406 OF THE CITY CODE SPECIFICALLY NAMES
 THE CITY OF WEST PALM BEACH, ITS COMMISSIONERS,
 OFFICERS, EMPLOYEES AND AGENTS AS ADDITIONAL INSURED.
