 WORSHIP OCCUPANCY TO DAY CARE AND MIXED USE BUILDING,
 NON-SPRINKLERED BUILDING.
  
 WITHIN THE 2014 FBC-B SECTION 303.1.4. ASSEMBLY
 OCCUPANCIES WITH ACCESSORY RELIGIOUS EDUCATIONAL ROOMS
 AND RELIGIOUS AUDITORIUMS WITH OCCUPANT LOADS OF LESS
 THAN 100 ARE NOT CONSIDERED SEPARATE OCCUPANCIES.
 PLEASE REVIEW THE INFORMAL CODE INTERPRETATION FROM
 BOAF & FL DEPART OF COMMUNITY AFFAIRS.

 QUESTION:
 IS IT THE INTENT OF THE CODE TO ALLOW AN EXISTING
 CHURCH WITH CLASSROOMS THAT ARE PRESENTLY USED TO SERVE
 RELIGIOUS
 PURPOSES ONLY (I.E. SUNDAY SCHOOL, BIBLE STUDY, ETC.)
 TO NOW HAVE THE CLASSROOMS ACT AS A SCHOOL SERVING AN
 OCCUPANT
 LOAD OF 50 CHILDREN IN GRADES RANGING FROM K- 6TH? CAN
 THE PROPOSED USE REMAIN UNDER A GROUP (A3)ASSEMBLY
 CLASSIFICATION OR IS THIS NOW CLASSIFIED AS A CHANGE OF
 USE UNDER GROUP (E) EDUCATIONAL CLASSIFICATION?
 ANSWER:
 YES, WHEN THE CHANGE OF USE IS DONE FOR THE
 RECLASSIFICATION TO EDUCATIONAL.
 COMMENTARY:
 CONSIDER IT A DUAL USE, AND MEET THE MOST RESTRICTIVE
 REQUIREMENTS. IN THIS CASE IT WILL BE THE EDUCATIONAL.
 IF THE
 CLASSROOMS ARE BEING USED FOR EDUCATIONAL PURPOSES
 THROUGH THE 12TH GRADE BY SIX OR MORE PEOPLE FOR FOUR
 OR MORE
 HOURS PER DAY OR 12 OR MORE HOURS PER WEEK THAN IT
 BECOMES AN EDUCATIONAL OCCUPANCY AND THIS IS A CHANGE
 OF USE.
  
 THE CHANGE OF OCCUPANCY OCCURS BECAUSE OF THE EVERYDAY
 USE OF THESE ROOMS, TO A DAYCARE OCCUPANCY AND WILL
 NEED TO MEET ALL THE REQUIREMENTS THERE OF FOUND IN
 FBC-B 436 FOR DAYCARE OCCUPANCIES AS WELL AS
 EDUCATIONAL OCCUPANCIES FOUND IN FBC-B 1031 & EMERGENCY
 ESCAPE & RESCUE 1029.
 THIS SPACE WOULD ALSO BE CLASSIFIED AS A SEPARATE
 OCCUPANCY NEEDING TO MEET THE REQUIREMENTS OF FBC-B
 TABLE 508.4 AND HORIZONTAL SEPARATION TABLE

 5.LIFE SAFETY SYSTEMS SHALL BE DETERMINED AND SHALL

 8. INTERIOR REQUIREMENTS SHALL INCLUDE THE FOLLOWING:
 INTERIOR FINISHES (FLAME SPREAD/SMOKE DEVELOPMENT)
 LIGHT AND VENTILATION
 SANITATION
  
 2) THIS IS A CHANGE OF USE, OCCUPANCY AND THE 2014
 FBC-EXISTING BUILDING CODE WOULD BE USED TO DESIGN THE
 NEW OCCUPANCY. THE DESIGNER OF RECORD WILL NEED PROVIDE
 WHICH COMPLIANCE METHOD THE PLANS WERE DEVELOPED:
 101.5 COMPLIANCE METHODS.
 THE REPAIR, ALTERATION, CHANGE OF OCCUPANCY, ADDITION
 OR RELOCATION OF ALL EXISTING BUILDINGS SHALL COMPLY
 WITH ONE OF THE METHODS LISTED IN SECTIONS 101.5.1
 THROUGH 101.5.3 AS SELECTED BY THE APPLICANT.
 APPLICATION OF A METHOD SHALL BE THE SOLE BASIS FOR
 ASSESSING THE COMPLIANCE OF WORK PERFORMED UNDER A
 SINGLE PERMIT UNLESS OTHERWISE APPROVED BY THE CODE
 OFFICIAL. SECTIONS 101.5.1 THROUGH 101.5.3 SHALL NOT BE
 APPLIED IN COMBINATION WITH EACH OTHER. FOR THE
 REMAINDER OF THIS REVIEW THE REVIEW WILL BE COMPLETED
 UNDER THE WORK AREA METHOD.
  
 3) 901.3 CHANGE OF OCCUPANCY CLASSIFICATION.
 WHERE THE OCCUPANCY CLASSIFICATION OF A BUILDING
 CHANGES, THE PROVISIONS OF SECTIONS 902 THROUGH 912
 SHALL APPLY. THIS INCLUDES A CHANGE OF OCCUPANCY
 CLASSIFICATION WITHIN A GROUP AS WELL AS A CHANGE OF
 OCCUPANCY CLASSIFICATION FROM ONE GROUP TO A DIFFERENT
 GROUP
 PLEASE REVIEW ALL CODE SECTIONS. IF THE CODE REFERENCES
 SECTION 902THROUGH 912, THIS IS ALL THE SECTIONS UNDER
 THE EXISTING BUILDING CODE.
 THE CODE WILL ALSO REFERENCE THE FLORIDA BUILDING CODE-
 BUILDING AS WELL AS THE FLORIDA FIRE PREVENTION CODE.
  
 4) BEFORE A PERMIT TO CONSTRUCT, MAY BE ISSUED, IMPACT
 FEES MUST BE PAID TO PALM BEACH COUNTY. THE ACTUAL
 PERMIT SET OF PLANS MUST BE STAMPED BY THAT OFFICE, AND
 A COPY OF THE PAID RECEIPT ATTACHED TO THE PERMIT

 RESULT OF THE ADDITIONAL INFORMATION REQUESTED
