 1) THE PALM BEACH DAY ACADEMY COMMUNITY SERVICE PLANNED
 DEVELOPMENT IS GOVERNED BY DEVELOPMENT REGULATIONS
 STATED IN RESOLUTION NO. 144-11. THE ABANDONMENT AND
 REDEDICATION OF THE INTERSECTION OF TUXEDO AND COCOANUT
 LANES AND THE ABANDONMENT OF A PORTION OF ORANGE COURT
 ARE GOVERNED BY RESOLUTION NOS. 341-10 AND 342-10,
 RESPECTIVELY.
  
 2) PROVIDE VERIFICATION THAT THE DEVELOPMENT CONDITIONS
 FROM RESOLUTION NO. 144-11 LISTED BELOW HAVE BEEN
 SATISFIED:
  
 A. GRANT TO THE CITY A TEMPORARY ACCESS EASEMENT FOR
 USE OF TUXEDO AND COCONUT LANES UNTIL THE ROADS ARE
 RELOCATED; EXISTING UTILITIES UNTIL RELOCATED; AND
 EXISTING DRAINAGE UNTIL RELOCATED, IN FORM ACCEPTABLE
 TO THE CITY.
  
 B. GRANT TO THE CITY A DRAINAGE AND FLOWAGE EASEMENT
 FOR ALL ON-SITE DRAINAGE AND FLOWAGE THROUGH THE
 BIOSWALE [OR CURRENT ITERATION]. PBDA SHALL BE
 RESPONSIBLE FOR MAINTENANCE OF ALL ON-SITE DRAINAGE.
  
 C. PROVIDE THE PLANNING DIVISION WITH A TRAFFIC CONTROL
 PLAN, APPROVED BY THE CITY'S TRAFFIC ENGINEER, WHICH
 INCLUDES THE LOCATIONS OF THE TRAFFIC DIRECTING
 PERSONNEL AND A WRITTEN NARRATIVE HOW THE TRAFFIC
 CONTROL OPERATIONS WILL FUNCTION FOR THE PICK-UP AND
 DROP-OFF TIMES. THE COST TO CONSTRUCT, INSTALL AND
 MAINTAIN ANY OFF-SITE SIGNAGE OR TRAFFIC CONTROL AIDES
 SHALL BE BORNE BY THE PBDA.
  
 D. PREPARE A CONSTRUCTION SITE SECURITY AND MANAGEMENT
 PLAN FOR APPROVAL BY THE CITY'S POLICE DEPARTMENT CRIME
 PREVENTION THROUGH ENVIRONMENTAL DESIGN (CPTED)
 OFFICIAL.
  
 I. THE APPLICANT, AFTER SITE CLEARING AND PLACEMENT OF
 CONSTRUCTION TRAILERS, SHALL INSTITUTE SECURITY
 MEASURES TO REDUCE OR ELIMINATE OPPORTUNITIES FOR
 THEFT. THE MANAGEMENT PLAN SHALL INCLUDE, BUT NOT BE
 LIMITED TO, TEMPORARY LIGHTING, SECURITY PERSONNEL,
 VEHICLE BARRIERS, CONSTRUCTION/VISITOR PASS,
 REDUCE/MINIMIZE ENTRY/EXIT POINTS, ENCOURAGE
 SUBCONTRACTORS TO SECURE MACHINERY AND TOOLS AT END OF
 WORK DAY, FENCING WITH SCREENING, AND/OR ANY OTHER
 MEASURE DEEMED APPROPRIATE TO PROVIDE A SAFE AND SECURE
 WORKING ENVIRONMENT.
  
 II. THE SECURITY MANAGEMENT PLAN SHALL BE MAINTAINED
 THROUGHOUT THE CONSTRUCTION PHASE OF THE PROJECT.
 NON-COMPLIANCE WITH THE APPROVED PLAN SHALL RESULT IN A
 STOP-WORK ORDER FOR THE ENTIRE PLANNED DEVELOPMENT.
  
 III. "NO TRESPASSING" SIGNS SHALL BE POSTED EVERY 500
 FEET AROUND THE PERIMETER OF THE CONSTRUCTION SITE.
  
 E. RECORD A PLAT FOR THE ENTIRE PBDA CAMPUS. PRIOR TO
 RECORDATION, THE PLAT SHALL BE SUBMITTED FOR REVIEW
 THROUGH THE MINOR SUBDIVISION PROCESS TO INCLUDE ALL
 REQUIRED EASEMENTS. THE RELOCATION AND/OR ABANDONMENT
 OF EASEMENTS WILL REQUIRE APPLICATIONS TO BE FILED WITH
 THE ENGINEERING SERVICES DIVISION.
  
 F. SUBMIT COMPREHENSIVE EMERGENCY PLANS TO THE FIRE
 DEPARTMENT FOR THEIR APPROVAL.
  
 G. SUBMIT TO THE ENGINEERING SERVICES DIVISION SIGNED
 AND SEALED ENGINEERING CALCULATIONS TO DEMONSTRATE THAT
 WATER QUALITY IS BEING MAINTAINED FOR THE SITE AND THAT
 POST DEVELOPMENT OFF-SITE DISCHARGE DOES NOT EXCEED THE
 PREDEVELOPMENT OFF-SITE DISCHARGE.
  
 H. THE PBDA SHALL PROVIDE A TEMPORARY ACCESS, UTILITY
 AND DRAINAGE EASEMENT, APPROVED BY THE ENGINEERING
 SERVICES DEPARTMENT, IN FAVOR OF THE CITY AT THE TIME
 OF THE RECORDATION OF THE PBDA PLAT.
  
 3) IN ACCORDANCE WITH THE TPS APPROVAL LETTER FOR THE
 PALM BEACH DAY ACADEMY CSPD, NO BUILDING PERMIT FOR NEW
 DEVELOPMENT WITHIN THE PALM BEACH DAY ACADEMY CSPD WILL
 BE ISSUED AFTER THE BUILD-OUT DATE OF DECEMBER 31,
 2014, UNLESS THE PALM BEACH COUNTY TRAFFIC DIVISION
 ISSUES AN AMENDED TRAFFIC CONCURRENCY LETTER WITH A NEW
 BUILD-OUT DATE. IN THE EVENT THAT THE PALM BEACH COUNTY
 TRAFFIC DIVISION ISSUES A REVISED TRAFFIC CONCURRENCY
 LETTER, THEN THE BUILD-OUT DATE IN THIS CONDITION SHALL
 BE AMENDED THROUGH THE MINOR AMENDMENT PROCESS.
  
 4) PROVIDE VERIFICATION THAT THE FOLLOWING CONDITIONS
 OUTLINED IN RESOLUTION NO. 341-10 HAVE BEEN MET:
  
 A. PALM BEACH DAY ACADEMY SHALL RECORD A PLAT FOR THE
 ENTIRE CAMPUS. PRIOR TO RECORDATION, THE PALM BEACH DAY
 ACADEMY SHALL MAKE APPLICATION TO THE PLANNING AND
 ZONING DEPARTMENT FOR THE REVIEW OF THE PLAT THROUGH
 THE MINOR SUBDIVISION PROCESS WITH FINAL PLAT APPROVAL
 THROUGH AN APPLICATION SUBMITTED TO THE CITY'S
 ENGINEERING SERVICES DEPARTMENT. ALL REQUIRED EASEMENTS
 SHALL BE PROVIDED EITHER BY PLAT OR SEPARATE
 INSTRUMENT, IN A FORM ACCEPTABLE TO THE CITY.
  
 B. IN THE EVENT THE UTILITIES ARE RELOCATED TO ANOTHER
 AREA OF THE PALM BEACH DAY ACADEMY CAMPUS, THE PALM
 BEACH DAY ACADEMY SHALL GRANT TO THE CITY A UTILITY
 EASEMENT OVER, UNDER AND THROUGH SUCH AREA OF THE
 CAMPUS.
  
 C. PALM BEACH DAY ACADEMY SHALL SUBMIT AN APPLICATION
 TO THE ENGINEERING SERVICES DEPARTMENT FOR THE
 REALIGNMENT OF THE TUXEDO AND COCOANUT LANES AND THE
 RELOCATION OF ANY CITY UTILITIES. AFTER THE ENGINEERING
 SERVICES DEPARTMENT APPROVAL, THE PALM BEACH DAY
 ACADEMY SHALL, AT ITS OWN COST AND EXPENSE, REALIGN THE
 INTERSECTION OF TUXEDO AND COCOANUT LANES AND RELOCATE
 ANY AND ALL UTILITY LINES LOCATED WITHIN THE ABANDONED
 RIGHT-OF-WAY. THE PALM BEACH DAY ACADEMY SHALL POST A
 BOND TO THE CITY IN THE AGREED AMOUNT OF THE ESTIMATED
 COSTS ASSOCIATED WITH THE RELOCATION OF THE ROADWAY AND
 THE UTILITY LINES PRIOR TO THE RECORDATION OF THE PALM
 BEACH DAY ACADEMY PLAT.
  
 D. PALM BEACH DAY ACADEMY SHALL PROVIDE TO THE CITY A
 TEMPORARY ACCESS EASEMENT, AND TEMPORARY UTILITIES AND
 DRAINAGE EASEMENTS OVER AND ACROSS THE ABANDONED
 RIGHT-OF-WAY, IN FORM APPROVED BY THE OFFICE OF THE
 CITY ATTORNEY, AT THE TIME OF THE RECORDATION OF THE
 PALM BEACH DAY ACADEMY PLAT.
  
 E. PALM BEACH DAY ACADEMY SHALL TENDER AND DELIVER
 $11,000 TO THE CITY AS COMPENSATION FOR THE VALUE OF
 THE RIGHT-OF-WAY AND ASSOCIATED DEVELOPMENT RIGHTS.
  
 5) PROVIDE VERIFICATION THAT THE FOLLOWING CONDITIONS
 OUTLINED IN RESOLUTION NO. 342-10 HAVE BEEN MET:
  
 A. PALM BEACH DAY ACADEMY SHALL RECORD A PLAT FOR THE
 ENTIRE CAMPUS. PRIOR TO RECORDATION, THE PALM BEACH DAY
 ACADEMY SHALL MAKE APPLICATION TO THE PLANNING AND
 ZONING DEPARTMENT FOR THE REVIEW OF THE PLAT THROUGH
 THE MINOR SUBDIVISION PROCESS WITH FINAL PLAT APPROVAL
 THROUGH AN APPLICATION SUBMITTED TO THE CITY'S
 ENGINEERING SERVICES DEPARTMENT. ALL REQUIRED EASEMENTS
 SHALL BE PROVIDED EITHER BY PLAT OR SEPARATE
 INSTRUMENT, IN A FORM ACCEPTABLE TO THE CITY.
  
 B. PALM BEACH DAY ACADEMY SHALL SUBMIT AN APPLICATION
 TO THE ENGINEERING SERVICES DEPARTMENT FOR THE
 REALIGNMENT OF THE TUXEDO AND COCOANUT LANES AND THE
 RELOCATION OF ANY CITY UTILITIES. AFTER THE ENGINEERING
 SERVICES DEPARTMENT APPROVAL, THE PALM BEACH DAY
 ACADEMY SHALL, AT ITS OWN COST AND EXPENSE, REALIGN THE
 INTERSECTION OF TUXEDO AND COCOANUT LANES AND RELOCATE
 ANY AND ALL UTILITY LINES LOCATED WITHIN THE ABANDONED
 RIGHT-OF-WAY. THE PALM BEACH DAY ACADEMY SHALL POST A
 BOND TO THE CITY IN THE AGREED AMOUNT OF THE ESTIMATED
 COSTS ASSOCIATED WITH THE RELOCATION OF THE ROADWAY AND

 AREA OF THE PALM BEACH DAY ACADEMY CAMPUS, THE PALM
 BEACH DAY ACADEMY SHALL GRANT TO THE CITY A UTILITY
 EASEMENT OVER, UNDER AND THROUGH SUCH AREA OF THE
 CAMPUS.
  
 D. PALM BEACH DAY ACADEMY SHALL PROVIDE TO THE CITY
 TEMPORARY UTILITIES AND DRAINAGE EASEMENTS OVER AND
 ACROSS THE ABANDONED RIGHT-OF-WAY, IN FORM APPROVED BY
 THE CITY ATTORNEY'S OFFICE, AT THE TIME OF THE
 RECORDATION OF THE PALM BEACH DAY ACADEMY PLAT.
  
 E. PALM BEACH DAY ACADEMY SHALL TENDER AND DELIVER
 $24,000 TO THE CITY AS COMPENSATION FOR THE VALUE OF
 THE RIGHT-OF-WAY AND ASSOCIATED DEVELOPMENT RIGHTS.
  
 6) ZONING STAFF UNDERSTANDS THAT THERE WILL BE CHANGES
 TO THE BUILDING AND SITE SUBMITTED IN THE NEAR FUTURE.
 IN LIGHT OF THE CONDITIONS LISTED ABOVE THAT HAVE NOT
 BEEN ADDRESSED, ZONING STAFF WILL NOT REVIEW THE
 SUBMITTED BUILDING PLANS UNTIL THE AMENDMENT HAS BEEN
 REVIEWED AND APPROVED.
  
 7) A RIGHT-OF-WAY PERMIT IS REQUIRED FOR THE WORK
 WITHIN FLAGLER DRIVE, TUXEDO LANE AND COCOANUT LANE.
  
 8) SEPARATE PERMITS, WITH PLANS, WILL BE REQUIRED FOR:
  
 A. LANDSCAPE
 B. AWNINGS AND CANOPIES
 C. SIGNS
 D. PARKING AND SIDEWALKS
 E. BICYCLE RACKS, BENCHES, TRASH CANS AND OTHER SITE
 AMENITIES
 F. FENCES, WALLS AND GATES
 G. SITE LIGHTING
  
 9) THIS BUILDING IS SUBJECT TO THE ARTS IN PUBLIC
 PLACES REQUIREMENTS.
