| CURRENT CONDITIONS BECAUSE BOTH PROPERTIES ARE UNDER |
| THE OWNERSHIP OF DIFFERENT CORPORATIONS. IN DISCUSSING |
| THE UNITY OF CONTROL, IT WAS THEIR (THE CITY ATTORNEY'S |
| OFFICE) LEGAL OPINION THAT THIS WAS NOT A VIABLE |
| OPTION. THEY (THE CITY ATTORNEY'S OFFICE) INDICATED |
| THAT EITHER THE TWO (2) PROPERTIES COULD BE BROUGHT |
| UNDER THE OWNERSHIP OF THE SAME CORPORATION AND A UNITY |
| OF TITLE FILED, OR THAT YOU CAN UTILIZE THE PROCESS |
| OUTLINED IN SECTION 94-485(B)(1) OF THE CITY'S ZONING |
| AND LAND DEVELOPMENT REGULATIONS (WHICH REQUIRES A |
| SPECIAL USE PERMIT)." PLANNING STAFF HAS NOT RECEIVED |
| ANY COMMUNICATION FROM MR. KINO ON HOW THE PROPERTY |
| OWNER WISHES TO PROCEED. |

| 2. AT&T INDICATED IN THEIR LETTER THAT COORDINATION |
| WILL NEED TO BE MADE PRIOR TO "DEMOLITION". PLEASE |

| A. PLANS SHALL BE APPROVED BY KELLY TUCKER-CARSILLO, |
| CRIME PREVENTION OFFICER, WITH THE CITY'S POLICE |
| DEPARTMENT. PLEASE PROVIDE DOCUMENTATION INDICATING |
| THAT PLANS HAVE BEEN REVIEWED AND APPROVED. |
| B. A CONSTRUCTION SITE SECURITY AND MANAGEMENT PLAN |
| SHALL BE APPROVED BY THE CITY'S CRIME PREVENTION |
| OFFICER. PLEASE PROVIDE DOCUMENTATION INDICATING THAT |
| SUCH PLAN HAS BEEN PREPARED AND APPROVED. |
