 2010 EXISTING BUILDING CODE LEVEL II 701.3
 COMPLIANCE. ALL NEW CONSTRUCTION ELEMENTS, COMPONENTS,
 SYSTEMS, AND SPACES SHALL COMPLY WITH THE REQUIREMENTS
 OF THE FLORIDA BUILDING CODE, BUILDING.
  
 1ST REVIEW
 ACTION: DENIED
  
 1) PLEASE REVIEW ADDRESSINGS COMMENTS IT APPEARS THAT
 THE PLANS HAVE THE WRONG ADDRESS AND WILL NEED TO BE
 CORRECTED.
  
 2) THE PERMIT APPLICATION UNDER THE HEADING DESCRIPTION
 OF WORK INDICATES:
 A) REPAIR DAMAGED FRONT OF BUILDING AND REPLACE ROTTEN
 WOOD
 B) BUILD A ADA COMPLIANT BATHROOMINSIDE UNIT
  
 2A) REPAIR DAMAGE TO FRONT OF BUILDING.
 PLEASE PROVIDE A COST BREAK DOWN TO WHAT PORTION OF THE
 FUNDS ARE TO BE USED FOR THE REPAIR OF THE DAMAGED
 FRONT AND WHAT WILL GO TOWARDS TTHE NEW ADA BATHROOM.
 AT THIS TIME IT CAN NOT BE DETERMINED IF THE REPAIRS
 ARE TO BE CONSIDERED UNDER SECTION 2010 EXISTING
 BUILDING CODE 506.2.1.
  
 506.2.1 FOR DAMAGE LESS THAN SUBSTANTIAL STRUCTURAL
 DAMAGE, THE DAMAGED ELEMENTS SHALL BE PERMITTED TO BE
 RESTORED TO THEIR PREDAMAGE CONDITION.
  
 506.2.2 REPAIRS FOR SUBSTANTIAL STRUCTURAL DAMAGE TO
 ELEMENTS OF THE LATERAL-FORCE-RESISTING SYSTEM.
 A BUILDING THAT HAS SUSTAINED SUBSTANTIAL STRUCTURAL
 DAMAGE TO THE ELEMENTS OF ITS LATERAL FORCE-RESISTING
 SYSTEM SHALL BE EVALUATED IN ACCORDANCE WITH SECTION
 506.2.2.1, AND EITHER REPAIRED IN ACCORDANCE WITH
 SECTION 506.2.2.2 OR REPAIRED AND REHABILITATED IN
 ACCORDANCE WITH SECTION 506.2.2.3 DEPENDING ON THE
 RESULTS OF THE EVALUATION.
  
 506.2.2.1 EVALUATION. THE BUILDING SHALL BE EVALUATED
 BY A REGISTERED DESIGN PROFESSIONAL, AND THE EVALUATION
 FINDINGS SHALL BE SUBMITTED TO THE CODE OFFICIAL. THE
 EVALUATION SHALL ESTABLISH WHETHER THE DAMAGED
 BUILDING, IF REPAIRED TO ITS PREDAMAGED STATE, WOULD
 COMPLY WITH THE PROVISIONS OF THE CODES THAT WERE IN
 EFFECT WHEN THE BUILDING WAS PERMITTED.
  
 506.2.2.2 EXTENT OF REPAIR FOR COMPLIANT BUILDINGS. IF
 THE EVALUATION ESTABLISHES THAT THE BUILDING IN ITS
 PREDAMAGE CONDITION COMPLIES WITH THE PROVISIONS OF
 SECTION 506.2.2.1, THEN THE DAMAGED ELEMENTS SHALL BE
 PERMITTED TO BE RESTORED TO THEIR PREDAMAGE CONDITION.
  
 506.2.2.3 EXTENT OF REPAIR FOR NONCOMPLIANT BUILDINGS.
 IF THE EVALUATION DOES NOT ESTABLISH THAT THE BUILDING
 IN ITS PREDAMAGE CONDITION COMPLIES WITH THE PROVISIONS
 OF SECTION 506.2.2.1, THEN THE BUILDING SHALL BE
 REHABILITATED TO COMPLY WITH THE PROVISIONS OF THIS
 SECTION. THE WIND LOAD FOR THE REPAIR AND
 REHABILITATION SHALL BE THOSE REQUIRED BY THE BUILDING
 CODE IN EFFECT AT THE TIME OF ORIGINAL CONSTRUCTION,
 UNLESS THE DAMAGE WAS CAUSED BY WIND, IN WHICH CASE THE
 WIND LOADS SHALL BE IN ACCORDANCE WITH THE FLORIDA
 BUILDING CODE, BUILDING.
  
 SUBSTANTIAL DAMAGE. DAMAGE OF ANY ORIGIN SUSTAINED BY A
 STRUCTURE WHEREBY THE COST OF RESTORING THE STRUCTURE
 TO ITS BEFORE-DAMAGED CONDITION WOULD EQUAL OR EXCEED
 50 PERCENT OF THE MARKET VALUE OF THE STRUCTURE BEFORE
 THE DAMAGE OCCURRED. [B]
  
 SUBSTANTIAL STRUCTURAL DAMAGE. A CONDITION WHERE:
 1. IN ANY STORY, THE ELEMENTS OF THE LATERAL
 FORCE-RESISTING SYSTEM HAVE SUFFERED DAMAGE SUCH THAT
 THE LATERAL LOAD-CARRYING CAPACITY OF THE STRUCTURE IN
 ANY HORIZONTAL DIRECTION HAS BEEN REDUCED BY MORE THAN
 20 PERCENT FROM ITS PRE-DAMAGED CONDITION; OR
 2. THE CAPACITY OF ANY VERTICAL LOAD-CARRYING
 COMPONENT, OR ANY GROUP OF SUCH COMPONENTS, THAT
 SUPPORTS MORE THAN 30 PERCENT OF THE TOTAL AREA OF THE
 STRUCTURE?S FLOOR(S) AND ROOF(S) HAS BEEN REDUCED MORE
 THAN 20 PERCENT FROM ITS PREDAMAGED CONDITION AND THE
 REMAINING CAPACITY OF SUCH AFFECTED ELEMENTS, WITH
 RESPECT TO ALL DEAD AND LIVE LOADS, IS LESS THAN 75
 PERCENT OF THAT REQUIRED BY THE FLORIDA BUILDING CODE,
 BUILDING FOR NEW BUILDINGS OF SIMILAR STRUCTURE,
 PURPOSE AND LOCATION.
  
 2B) AGAIN IN TRYING TO DETERMINE THE FUNDS THAT ARE
 GOING TO THE ACCESSIBLE RESTROOM PLEASE SEE SECTION
 2010 EXISTING BUILDING CODE LEVEL II 701.3 COMPLIANCE.
 ALL NEW CONSTRUCTION ELEMENTS, COMPONENTS, SYSTEMS, AND
 SPACES SHALL COMPLY WITH THE REQUIREMENTS OF THE
 FLORIDA BUILDING CODE, BUILDING VERSES DISPROPORTIONATE
 COST.
  
 2010 FLORIDA ACCESSIBILITY CODE 202.4.2 ACCESSIBLE
 FEATURES IN THE EVENT OF DISPROPORTIONALITY.
 WHEN THE COST OF ALTERATIONS NECESSARY TO MAKE THE PATH
 OF TRAVEL TO THE ALTERED AREA FULLY ACCESSIBLE IS
 DISPROPORTIONATE TO THE COST OF THE OVERALL ALTERATION,
 THE PATH OF TRAVEL SHALL BE MADE ACCESSIBLE TO THE
 EXTENT THAT IT CAN BE MADE ACCESSIBLE WITHOUT INCURRING
 DISPROPORTIONATE COSTS. IN CHOOSING WHICH ACCESSIBLE
 ELEMENTS TO PROVIDE, PRIORITY SHOULD BE GIVEN TO THOSE
 ELEMENTS THAT WILL PROVIDE THE GREATEST ACCESS, IN THE
 FOLLOWING ORDER: (I) AN ACCESSIBLE ENTRANCE; (II) AN
 ACCESSIBLE ROUTE TO THE ALTERED AREA; (III) AT LEAST
 ONE ACCESSIBLE RESTROOM FOR EACH SEX OR A SINGLE UNISEX
 RESTROOM; (IV) ACCESSIBLE TELEPHONES; (V) ACCESSIBLE
 DRINKING FOUNTAINS; AND (VI) WHEN POSSIBLE, ADDITIONAL
 ACCESSIBLE ELEMENTS SUCH AS PARKING, STORAGE, AND
 ALARMS.

 3) PLANS FAIL TO PROVIDE BACKING AND GRAB BARS FOR THE
 WATER CLOSET AND TUB. SEE 604.5 GRAB BARS FOR TUB AND

 BARS.
