 1. RESPOND TO COMMENTS IN WRITING.
  
 2. PURSUANT TO THE ZONING CODE, SECTION 94-305(5), AN
 AWNING SHALL NOT PROJECT MORE THAN FOUR (4) FEET INTO
 ANY SETBACK OR BE SUPPORTED BY ANY MEANS OTHER THAN
 ATTACHMENT TO THE BUILDING. THE MINIMUM SIDE SETBACK IS
 FIVE (5) FEET FOR THE BUILDING, THEREFORE, THE AWNING
 CAN ENCROACH UP TO ONE (1) FOOT AWAY FROM THE PROPERTY
 LINE, HOWEVER, THE AWNING IS SUPPORTED BY COLUMNS,
 THEREFORE, IT CANNOT ENCROACH AS PROPOSED ON THE
 SURVEY.
  
 PURSUANT TO SECTION 94-305(2), STRUCTURAL INTRUSIONS -
 THE COLUMNS (POSTS) SHALL NOT EXTEND NO FURTHER THAN
 THREE (3) FEET INTO ANY SETBACK.
  
 RESUBMITTAL: THE SURVEY SHOWS THAT THE SHED IS
 ENCROACHING ON THE PROPERTY LINE. IT NEEDS TO BE
 REMOVED. THE COVERED AREA, AWNING, IS ALSO ENCROACHING
 ON THE PROPERTY LINE. THE POSTS ARE OVER THE PROPERTY
 LINE OR IMMEDIATELY ADJACENT TO THE PROPERTY LINE. THE
 POSTS AS NOTED ON THE COMMENT ABOVE SHALL NOT EXTEND NO
 FURTHER THAN THREE (3) FEET INTO ANY SETBACK. STAFF HAS
 PREVIOUSLY MET WITH CONTRACTOR (STUART LEDIS) TO
 EXPLAIN THE ISSUE WITH THE LOCATION OF THE PROPERTY
 BASED ON THE SURVEY. THE CITY RECOGNIZES THE SURVEY AS
 A LEGAL INSTRUMENT THAT DEPICTS THE PROPERTY LINES AND
 HAS BEEN REVIEWED BY THE VINCE NOEL THE CITY SURVEYOR
 WHO ALSO AGREES WITH THE LEGAL DESCRIPTION OF THE
 SURVEY.
