 REQUIRED. ANY OWNER, OR AUTHORIZED AGENT SHALL OBTAIN A
 PERMIT FOR A CHANGE IN OCCUPANCY.
 THE CITY RECORDS DO NOT INDICATE ANY CHANGE OF
 OCCUPANCY FOR 228 OR 318. PLEASE BE AWARE THAT THE
 CHANGE OF OCCUPANCY IS NOT THE TRIGGERING EVENT THAT
 INACTS THE ACCESSIBILITY REQUIREMENTS. THE TRIGGERING
 EVENT IS THE ALTERED AREAS (FBC-B-11-4.1.1(1)(A) AAND
 SECTION 11-4.1.3 ALTERED PORTIONS OF EXISTING
 BUILDINGSAND FACILITIES REQUIRED TO BE ACCESSIBLE BY
 SECTION 11-4.1.6SHALL COMPLY WITH THIS CODE. THIS
 PERMIT INDICATES $19,242.00 AMOUNT OF WORK TO BE
 COMPLETED UNDERTHIS PERMIT. 11-4.1.6(2) REQUIRES AN
 ADDITIONAL $3848.00 AMOUNT OF WORK TO BE ACCOMPLISHED
 TO BRING THIS UNIT UP TO MEET THE ACCESSIBILTY CODE,
 WHEN THE MONIES ARE SPENT THE CONTRACTOR DOES NOT HAVE
 TO DO ANY MORE WORK. AS LISTED BELOW ITEM 3 WE HAVE
 ASKED FOR EITHER THE CONTRACTOR OR DESIGNER OF RECORD
 TO CREATE A LIST ITEMIZING WHERE THES MONIES HAVE BEEN
 SPENT IN THE ORDER LISTED IN COMMENT 2A.
  
 THE PERMIT IS NOT ONLY A CHANGE IN OCCUPANCY BUT A
 LEVEL II ALTERATION. THE EXIST BLDG CODE LEVEL LI
 CHAPTER ALSO HAS A PORTION THAT DEALS WITH
 ACCESSIBILITY 706.1, THIS IS THE TRIGGERING DEVICE FOR
 THE ACCESSIBLITY REQUIREMENTS.
  
 1) THE PLANS SHEET A-1 INDICATE THIS TENANT BUILD OUT
 TO BE A CLASSROOM. PLEASE PROVIDE THE AGES OF THE
 OCCUPANTS AND ACTIVITY. FBC-B EDUCATIONAL OCCUPANCY ARE
 OCCUPANTS THAT ARE SIX OR MORE PEOPLE GATHERED TOGRTHER
 THROUGH THE 12TH GRADE. STUDENTS OVER THE 12TH GRADE
 THE OCCUPANCY TYPE IS CONSIDERED A BUSINESS OCCUPANCY.
 FBC-B 304.1 & 305.1.
  
 2) FOR UNIT # 228 THIS IS CONSIDERED A CHANGE OF
 OCCUPANCY FROM A R2 RESIDENTIAL UNIT TO EITHER B OR E
 DEPENDING ON THE AGE OF THE STUDENTS. THIS REVIEW WILL
 BE ASSUMED AS A BUSINESS OCCUPANCY. PLEASE NOTE THE 2ND
 & 3RD FLOORS WERE BUILT TO THE FAIR HOUSING STANDARDS
 SINCE THESE UNITS WERE DESIGNED AS A R2 OCCUPANCY.
 PLEASE REVIEW THE 2007/09 EXISTING BUILDING CODE 912.8
 ACCESSIBILITY , EXISTING BUILDINGS OR PORTIONS THEREOF
 THAT UNDER GO A CHANGE OF OCCUPANCY CLASSIFICATION
 SHALL COMPLY WITH CHAPTER 11 OF THE FLORIDA BUILDING
 CODE, BUILDING.
  
 2A) THE 2007/09 FBC-B CHAPTER 11-4.1.6(2) THIS SECTION
 INDICATES THAT WHEN ALTERATIONS ARE DONE 20 % OF THE
 COST OF THE ALTERATIONS OVER AND ABOVE THE CONTRACT
 VALUE NEED TO GO TO ACCESSIBILITY TO BRING THE
 BUILDING( UNIT) INTO CODE COMPLIANCE WITH THE
 ACCESSIBILITY CODE. THE CODE INDICATES HOW THESE FUNDS
 ARE TO BE ALLOWCATED.
 DUTY TO PROVIDE ACCESSIBLE FEATURES IN THE EVENT OF
 DISPROPORTIONALITY.
  
 (1) WHEN THE COST OF ALTERATIONS NECESSARY TO MAKE THE
 PATH OF TRAVEL TO THE ALTERED AREA FULLY ACCESSIBLE IS
 DISPROPORTIONATE TO THE COST OF THE OVERALL ALTERATION,
 THE PATH OF TRAVEL SHALL BE MADE ACCESSIBLE TO THE
 EXTENT THAT IT CAN BE MADE ACCESSIBLE WITHOUT INCURRING
 DISPROPORTIONATE COSTS.
  
 (2)(A) IN CHOOSING WHICH ACCESSIBLE ELEMENTS TO
 PROVIDE, PRIORITY SHOULD BE GIVEN TO THOSE ELEMENTS
 THAT WILL PROVIDE THE GREATEST ACCESS, IN THE FOLLOWING
 ORDER:
  
 (I) AN ACCESSIBLE ENTRANCE;
  
 (II) AN ACCESSIBLE ROUTE TO THE ALTERED AREA:
  
 (III) AT LEAST ONE ACCESSIBLE RESTROOM FOR EACH SEX OR
 A SINGLE UNISEX RESTROOM:
  
 (IV) ACCESSIBLE TELEPHONES;
  
 (V) ACCESSIBLE DRINKING FOUNTAINS; AND
  
 (VI) WHEN POSSIBLE, ADDITIONAL ACCESSIBLE ELEMENTS SUCH
 AS PARKING, STORAGE, AND ALARMS.
  
 2B) A ACCESSIBLE ENTRANCE IS REQUIRED MISSING THE
 REQUIRED 18" ON THE INTERIOR SIDE OF THE ENTRY DOOR.

 2C) THE SAME REQUIREMENT IS MISSING ON THE IT CLOSET
  
 3) THE NEXT AREA IN QUESTION IS AT THE RESSTROOM AREA.
 THE PLANS INDICATE A NEW WALL BEING PLACED BETWEEN THE
 TUB AND WATER CLOSET PLEASE PROVIDE A WALL DETAIL
 INDICATING THE LOCATION OF THE NEW WALL INREGARDS TO
 THE TUB AND THE DISTANCE AWAY FROM THE FINISHED WALL TO
 THE CENTERLINE OF THE WATER CLOSET, IT APPEARS THE
 CENTERLINE DISTANCE WILL NOT BE CLOSE TO THE REQUIRED
 18 INCHES. 2007/09 FBC-B 11-4.11-4.16.2/ 11-4.16.3 &
 FIGURE 11-28.
  
 PLEASE PROVIDE AN ITEMIZED LIST WHERE THESE FUNDS WILL
 BE USED IN MAKING THESE TENAT SPACES CLOSER TO CODE
 COMPLIANCE FOR ACCESSIBIITY.
