 PLEASE ADDRESS ALL COMMENTS IN WRITING. PLEASE NOTE
 THAT THE CHANGES ON THE RESUBMITTED PLANS MAY RESULT IN
 ADDITIONAL COMMENTS.
  
 1) THE NORTHERN PORTION OF THE PROPOSED LOGGIA IS SHOWN
 WITHIN THE 12 FOOT PUBLIC UTILITY EASEMENT. THE CITY
 DOES NOT PERMIT BUILDINGS MAY BE CONSTRUCTED WITHIN
 UTILITY EASEMENTS.
  
 2) PLEASE NOTE THAT THE FLAGLER PROMENADE PLAT
 PROHIBITS "BUILDINGS, ANY KIND OF CONSTRUCTION OR
 TREES" WITHIN THE EASEMENTS ON THE PLAT. IN ADDITION TO
 THE LOGGIA, THERE IS SPA EQUIPMENT, THE COURTYARD, AND
 OTHER PAVED AREAS SHOWN WITHIN THE 12 FOOT PUBLIC
 UTILITY EASEMENT. PLEASE PROVIDE VERIFICATION THAT THE
 "ANY KIND OF CONSTRUCTION" PORTION OF THIS LANGUAGE NO
 LONGER APPLIES IN ORDER TO CONSTRUCT THE SPA EQUIPMENT,
 THE COURTYARD, AND OTHER AT GRADE PAVED AREAS WITHIN
 THE 12 FOOT PUBLIC UTILITY EASEMENT.
  
 3) IF THE VERIFICATION OUTLINED IN NO. 2 ABOVE IS
 PROVIDED, THEN RELEASES FROM ALL THE UTILITY PROVIDERS,
 FPL, FPU, COMCAST AND BELLSOUTH, AND THE CITY OF WEST
 PALM BEACH SHALL BE PROVIDED IN ORDER TO CONSTRUCT THE
 SPA EQUIPMENT, THE COURTYARD, AND OTHER AT GRADE PAVED
 AREAS WITHIN THE 12 FOOT PUBLIC UTILITY EASEMENT. THE
 FPL LETTER PROVIDED WITH THE APPLICATION WAS ONLY FOR
 THE BUILDING WALL, WHICH MAY NOT BE PLACED WITHIN THE
 EASEMENT.
  
 4) THE SITE PLAN DOES NOT ACCURATELY DEPICT THE NEW
 CONSTRUCTION SHOWN ON SHEET S-1, SPECIFICALLY THE NEW
 CONSTRUCTION WEST OF THE EXTENDED LOGGIA.
  
 5) VERIFY WITH THE CONSTRUCTION SERVICES DEPARTMENT
 THAT THE SPA AND SPA EQUIPMENT DO NOT REQUIRE A
 SEPARATE PERMIT APPLICATION. ADDITIONALLY, PLEASE
 VERIFY WHETHER THE PROPOSED SPA REQUIRES A PROTECTIVE
 BARRIER.
  
 6) THE SPA EQUIPMENT PAD(S) IS SHOWN DIFFERENTLY ON
 SHEETS SP-1, E-1 AND A-1. ALL PLANS SHALL SHOW SAME
 CONDITIONS.
  
 7) PROVIDE THE SETBACK DIMENSION FROM THE ULTIMATE
 CONFIGURATION OF THE SPA EQUIPMENT TO THE NORTH
 PROPERTY LINE. THE EQUIPMENT MAY BE NO CLOSER THAN 6.45
 FEET FROM THE NORTH PROPERTY LINE (4 FEET INTO A
 REQUIRED SETBACK).
  
 8) DESCRIBE HOW THE "FIREWOOD STORAGE" AREA WILL
 FUNCTION. IS IT JUST STACKED FIREWOOD, OR WILL IT BE
 WITHIN A STRUCTURE OR ENCLOSURE? IF IN A STRUCTURE OR
 ENCLOSURE, THEN IT SHALL ADHERE TO THE EASEMENT AND
 REAR SETBACK PROVISIONS OUTLINED IN COMMENTS NO. 2 AND
 7, ABOVE.
  
 9) THE VALUE OF THE CONSTRUCTION ($200,000) EXCEEDS 50%
 OF THE IMPROVEMENT VALUE ($352,838) ACCORDING TO THE
 P.B.C. PROPERTY APPRAISER'S OFFICE; THEREFORE, PURSUANT
 TO SECTION 94-441(C)(2) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS (ZLDR), THE LANDSCAPE ON THE
 SITE SHALL BE IN COMPLIANCE WITH ALL APPLICABLE
 REGULATIONS FOUND IN ARTICLE XIV OF THE ZLDR. IF THE
 SITE CONFORMS TO ARTICLE XIV, THEN TWO (2) COPIES OF A
 LANDSCAPE PLAN SHALL BE SUBMITTED WITH THE PERMIT. IF
 THE SITE DOES NOT CONFORM TO ARTICLE XIV, THEN A
 SEPARATE LANDSCAPE PERMIT AND IRRIGATION PERMIT SHALL
 BE SUBMITTED TO INSTALL THE MATERIAL TO BRING THE SITE
 INTO CONFORMITY PRIOR TO THE ZONING APPROVAL OF THIS
 PERMIT.
  
 10) SHEET SP-1 REFERS TO A LANDSCAPE PLAN, BUT THERE
 WAS NO COPY OF THE PLAN SUBMITTED WITH THE APPLICATION.
  
 11) THE 2009 AERIAL OF THE PROPERTY SHOWS TREES IN THE
 LOCATION OF THE PROPOSED WORK. TREES MAY ONLY BE
 REMOVED AFTER A TREE ALTERATION PERMIT HAS BEEN ISSUED
 BY THE PLANNING & ZONING DEPARTMENT. PLEASE NOTE THAT
 THE REMOVAL OF TREES (AND SHRUBS) MAY NOT RESULT IN THE
 SITE NOT MEETING THE MINIMUM REQUIREMENTS OUTLINED IN
 THE ZONING AND LAND DEVELOPMENT REGULATIONS.
 ADDITIONALLY, THERE MAY BE NO NET LOSS OF TREE CANOPY.
  
 12) PLEASE VERIFY THAT THE PLANS CALL OUT ALL OF THE
 WORK BEING PERFORMED. THERE APPEAR TO BE FEATURES ON
 SHEET SP-1 THAT ARE NOT CALLED OUT AS NEW WORK, YET DO
 NOT APPEAR ON THE SURVEY.
