 NOTE: THE PLANS SHOW WORK ON 3 PARCELS - BANK,
 COMMERCIAL AND ENTRY ROAD - EACH HAVING A DISTINCT PCN.
 PER ROBERT BROWN, ASSISTANT CONSTRUCTION SERVICES
 DIRECTOR, A SEPARATE BUILDING PERMIT IS REQUIRED FOR
 THE WORK ON EACH PARCEL. ZONING WILL NOT APPROVE THE
 PERMITS FOR THE BANK BUILDING AND BANK PARCEL SITE WORK
 UNTIL THE PERMITS FOR THE SITE WORK AND LANDSCAPE ON
 THE ENTRY ROAD TRACT AND THE COMMERCIAL TRACT ARE
 SUBMITTED.
  
 1) REPEAT COMMENT: PROVIDE PROOF THAT THE FOLLOWING
 CONDITIONS FROM ORDINANCE NO. 4162-08 HAVE BEEN MET:
  
 A. THE DEVELOPER SHALL INSTALL A TRAFFIC SIGNAL AT THE
 INTERSECTION OF OKEECHOBEE BOULEVARD AND BENOIST FARMS
 ROAD, UPON MEETING THE WARRANTS IDENTIFIED IN THE
 LATEST EDITION OF THE MANUAL ON UNIFORM TRAFFIC CONTROL
 DEVICES (MUTCD). THE TRAFFIC DATA SHALL BE COLLECTED
 DURING PEAK SEASON OR ADJUSTED TO PEAK SEASON
 CONDITIONS BASED ON PALM BEACH COUNTY CRITERIA FOR TWO
 (2) CONSECUTIVE YEARS AFTER THE FINAL CERTIFICATE OF
 OCCUPANCY FOR THE OAKTON COMMONS CPD IS ISSUED. PRIOR
 TO THE ISSUANCE OF THE FIRST BUILDING PERMIT FOR THE
 FIRST COMMERCIAL BUILDING WITHIN THE OAKTON COMMONS CPD
 FOLLOWING THE ADOPTION OF THIS ORDINANCE, THE DEVELOPER
 SHALL PROVIDE WRITTEN VERIFICATION FROM THE PALM BEACH
 COUNTY ENGINEERING AND PUBLIC WORKS DEPARTMENT THAT ANY
 REQUIRED BOND HAS BEEN POSTED AND A PUBLIC FACILITIES
 AGREEMENT HAS BEEN EXECUTED WITH THE COUNTY. IF A BOND
 AND/OR PUBLIC FACILITIES AGREEMENT IS NOT REQUIRED,
 THEN IT SHALL BE STATED IN THE WRITTEN VERIFICATION
 FROM PALM BEACH COUNTY.
  
 B. PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY
 FOR ANY NEW BUILDING(S) WITHIN THE OAKTON COMMONS CPD,
 THE DEVELOPER SHALL PROVIDE THE FOLLOWING EXCLUSIVE
 TURN LANES AT THE PROJECT ACCESS DRIVEWAYS, WHERE NOT
 EXISTING, WHICH SERVICE THE NEW BUILDING(S) FROM THE
 REQUIRED TURN LANE(S):
  
 1. EXCLUSIVE WEST BOUND RIGHT-TURN LANE ALONG
 OKEECHOBEE BOULEVARD, ONTO THE PROJECT ACCESS AT THE
 INTERSECTION OF BENOIST FARMS ROAD.
 2. EXCLUSIVE EAST BOUND LEFT-TURN LANE ALONG OKEECHOBEE
 BOULEVARD, ONTO THE PROJECT ACCESS AT THE INTERSECTION
 OF BENOIST FARMS ROAD.
 3. WEST BOUND RIGHT-TURN LANE ALONG OKEECHOBEE
 BOULEVARD, ONTO THE WESTERN PROJECT ACCESS LOCATION.
 4. NOTWITHSTANDING THE FOREGOING PROVISIONS, IF
 CONSTRUCTION OF THE TURN LANE(S) IS INCLUDED IN THE
 FLORIDA DEPARTMENT OF TRANSPORTATION/PALM BEACH COUNTY
 CONTRACT TO WIDEN OKEECHOBEE BOULEVARD, THE CITY SHALL
 NOT DELAY THE ISSUANCE OF THE CERTIFICATE OF OCCUPANCY
 SOLELY BECAUSE THE FDOT/COUNTY ROAD CONTRACTOR HAS NOT
 COMPLETED INSTALLATION OF THE TURN LANE(S) PRIOR TO THE
 DEVELOPER'S REQUEST FOR THE CERTIFICATE OF OCCUPANCY.
  
 C. THE DEVELOPER SHALL PROVIDE THE CITY'S PLANNING AND
 ZONING DEPARTMENT DOCUMENTATION FROM PALM BEACH COUNTY
 OR THE FLORIDA DEPARTMENT OF TRANSPORTATION THAT THE
 EXCLUSIVE TURN LANE(S) HAS BEEN BUILT TO THE APPLICABLE
 STANDARDS OR EVIDENCE THAT THE CONSTRUCTION OF THE TURN
 LANE(S) IS INCLUDED IN THE CONTRACT TO WIDEN OKEECHOBEE
 BOULEVARD AND WILL BE CONSTRUCTED BY FDOT/COUNTY'S
 CONTRACTOR.
  
 D. PROOF PROVIDED
  
 E. PRIOR TO THE SUBMITTAL OF THE FIRST BUILDING PERMIT
 FOR THE COMMERCIAL POD, THE DEVELOPER SHALL RECORD AN
 EASEMENT TO ALLOW FOR JOINT USE OF THE COMMERCIAL
 PARKING FOR PARK AND RIDE PURPOSES. THE EASEMENT
 LANGUAGE SHALL BE REVIEWED AND APPROVED BY THE PLANNING
 AND ZONING DEPARTMENT AND THE OFFICE OF THE CITY
 ATTORNEY PRIOR TO RECORDATION.
  
 2) PROVIDE PROOF THAT THE FOLLOWING CONDITIONS FROM THE
 APRIL 23, 2009, BANK MINOR AMENDMENT APPROVAL LETTER
 HAVE BEEN MET:
  
 A. CONDITION MET
  
 B. THE EAST SIDE OF THE ENTRY ROAD WITHIN TRACT A SHALL
 BE PLANTED WITH MATERIAL CONSISTENT WITH THE LANDSCAPE
 PROPOSED ON THE WEST SIDE OF THE ENTRY ROAD. THE
 SPECIFIC MATERIAL SHALL BE APPROVED BY THE PLANNING AND
 ZONING DEPARTMENT PRIOR TO INSTALLATION AND REFLECTED
 ON THE LANDSCAPE PLANS. PLEASE NOTE THAT THE RESPONSE
 PROVIDED WITH THE RESUBMITTAL IS INADEQUATE. THERE ARE
 AREAS IN THE ENTRY ROAD TRACT THAT CAN SUPPORT
 LANDSCAPE AND WOULD NOT INTERFERE WITH THE HEDGE AND
 SOD PLANTED ON THE FIRE STATION SITE. THESE SHALL BE
 PLANTED AS OUTLINED IN THE LANDSCAPE REVIEW COMMENTS.
  
 3) REPEAT COMMENT: THERE ARE A NUMBER OF DISCREPANCIES
 AMONG THE LATEST PLANS APPROVED BY THE PLANNING AND
 ZONING DEPARTMENT AND THE SITE, LANDSCAPE AND CIVIL
 PLANS SUBMITTED AS PART OF THE PERMIT. ADDITIONALLY,
 THERE ARE DISCREPANCIES AMONG THE PLANS SUBMITTED AS
 PART OF THE PERMIT. ALL PLANS SHALL BE INTERNALLY
 CONSISTENT AS WELL AS BE CONSISTENT WITH THE PLANS
 APPROVED BY THE PLANNING AND ZONING DEPARTMENT. SAMPLE
 OF INCONSISTENCIES IDENTIFIED BELOW:

 THE EAST, NORTH AND WEST SIDES OF THE SITE AND DUE TO
 THE RELOCATED WATER MAIN. THESE CHANGES REQUIRE THE
 APPROVAL OF A MINOR PLANNED DEVELOPMENT AMENDMENT.

 DETAIL ON SHEET SP.1. PLEASE NOTE THAT NEITHER DETAIL
 SHOWS THE CONDITION WITH THE WHEEL STOPS. THE WHEEL
 STOPS SHALL BE LOCATED TWO (2) FEET FROM THE END OF THE
 SPACE. THE HC LOGO SHALL BE LOCATED TWO (2) FEET FROM
 THE OPEN END OF THE PARKING SPACE. THERE SHALL BE 12
 INCHES DIMENSIONED ON THE INSIDE OF THE DOUBLE
 STRIPPING (HARD TO DISTINGUISH THAT THE 16 INCHES SHOWN
 ON PLANS IS TO THE CENTER LINE OF EACH DOUBLE STRIP).

 AND LANDSCAPE PLANS FOR THE LIMITS OF WORK. THERE SEEM
 TO BE CONTRADICTIONS WITH THE DETAIL AND THE LIMITS OF
 WORK (PHASE LINE). THE CIVIL PAVING AND DRAINAGE PLANS
 MAKE NO REFERENCE TO A "D" CURB BEING INSTALLED. IT IS
 ONLY SHOWN ON THE DETAIL. THIS HAS THE POTENTIAL OF THE
 "D" CURB NOT BEING INSTALLED IN THE FIELD BY THE
 CONTRACTOR. ADDITIONALLY, WHILE THE DETAILS ON THE
 CIVIL AND LANDSCAPE PLANS SHOW THE CURB, SOD AND SLOPE
 THAT WILL SEPARATE THE NORTHERN DRIVE AISLE FROM THE
 PRESERVE AREA, THIS IS SHOWN ON PHASE II AND THUS
 CREATES CONFUSION IF WILL BE INSTALLED AS PART OF THE
 PHASE I WORK. THIS NEEDS TO BE CLEARLY STATED AND SHOWN
 ON THE PLANS.
