2009-12-17 13:29:13INTERIOR ALTERATION TO A PRIMARY FUNCTION WITHOUT A
 CHANGE IN OCCUPANCY. BOTH DISPROPORTIONATE COST AND
 TECHNICAL INFEASIBLITY APPLY TO THIS PROJECT. BASED
 UPON DISCUSSION AND REVIEW OF THE PROJECT ESTIMATED
 BUDGET AND DOCUMENTATION PROVIDED BY THE ARCHITECT OF
 RECORD IT NOW APPEARS CLEAR THAT THE COST TO COMPLETELY
 REBUILD A COMPLIANT BATHROOM WILL EXCEED 20% OF THE
 PROJECT COST. FURTHER IT IS A CHANGE IN USE WITHOUT A
 CHANGE IN OCCUPANCY IN ACCORDANCE WITH THE FLORIDA
 EXISTING BUILDING CODE. SINCE THE CHANGE IN USE DOES
 NOT CREATE A MORE INTENSIVE USE OF THE EXISTING
 PLUMBING FIXTURES THE EXISTING FIXTURES ARE DEEMED
 "COMPLIANT" BY RULE. ACCORDINGLY THE EXISTING BOTTLE
 WATER DISPENSER IS ALLOWED TO REMAIN AS THE SOLE
 DRINKING FOUNTAIN PURSUANT TO THE PRIOR RULE. THEREFORE
 ONLY THE IMPROVEMENTS TO ACCESIBILITY AS PROPOSED BY
 THE ARCHITECT ARE REQUIRED AND ARE DEEMED ACCEPTABLE TO
 THIS REVIEWER AT THE TIME OF REVIEW.
