 7) THE SOUTHEAST MOST LIGHT POLE IS NOT SHOWN IN THE
 SAME LOCATION ON THE SITE AND LANDSCAPE PLANS.
  
 8)MOST OF THE LIGHT POLES ARE WITHIN 5 FEET OF LIVE
 OAKS OR OTHER TREES.THE TREES OR THE LOCATION OF THE
 LIGHT POLES SHALL BE ADJUSTED SO THAT TREES TO NOT GROW
 INTO THE LIGHT POLES, MAKING THEM INEFFECTIVE.
  
 9) THE TWO SOUTHERNMOST CATCH BASINS ON THE EAST
 PROPERTY LINE WILL NOT BE ABLE TO SUPPORT A WHEEL STOP
 AND THUS THERE WILL BE INADEQUATE PROTECTION OF THE
 TREES SHOWN AT THE HEAD OF THE SPACE.THE TREES SHALL
 BE MOVED FROM DIRECTLY IN FRONT OF THE SPACE (NOTE THAT
 THE COMBINATION OF THE LIGHT POLE AND CATCH BASIN
 LOCATIONS MAY REQUIRE THE REMOVAL OF A TREE AND
 RELOCATION OF ANOTHER SO THE REMAINING TREE WILL AVOID
 OBSTACLES AND HAVE ROOM TO GROW).
  
 10) SOME OF THE FIRE HYDRANTS CONFLICT WITH THE TREE
 PLACEMENT.
  
 11) THE NEW SIGN SHOWN ON THE SOUTHWEST CORNER OF THE
 SITE HAS NEVER APPEARED ON ANY PREVIOUS PLAN.A SIGN
 AT THIS LOCATION REQUIRES THE APPROVAL OF A MINOR
 PLANNED DEVELOPMENT AMENDMENT.NOTE THAT IT SHALL BE 5
 FEET FROM THE PREMIER PARK DRIVE RIGHT-OF-WAY LINE AND
 24 FEET FROM THE PROPERTY LINE OF BUILDING #2.THE
 SIGN LOCATION ALSO INTERFERES WITH THE APPROVED
 LANDSCAPE PLANS AND IS NOT SHOWN ON THE CIVIL PLANS.
  
 12) NO BUILDING PERMITS WILL BE ISSUED FOR BUILDING #3
 UNTIL UNTIL THE DEVELOPER FINALIZES THE PROPORTIONATE
 SHARE AGREEMENTS WITH PALM BEACH COUNTY.
  
 13) NOT ALL CONDITIONS OF ORD. NO. 3987-06 HAVE BEEN
 MET - REPEAT COMMENT.VERIFICATION FROM PALM BEACH
 COUNTY SHALL BE PROVIDED TO RELEASE THE TRAFFIC
 CONDITIONS.THE USE TABLE ITEMS HAVE NOT BEEN
 SUBMITTED.
  
 A. THE PROPERTY OWNER SHALL POST SURETY IN THE AMOUNT
 OF ONE HUNDRED FIFTY THOUSAND DOLLARS ($150,000.00)
 WITHIN TWELVE (12) MONTHS OF THIS DEVELOPMENT ORDER
 (DUE BY OCTOBER 10, 2007) IN A FORM ACCEPTABLE TO THE

 THAT CAN BE MADE AVAILABLE TO THE COUNTY FOR THE
 WIDENING OF 45TH STREET FROM TWO (2) LANES TO FOUR (4)
 LANES FROM HAVERHILL ROAD TO THE FLORIDA TURNPIKE.IF
 THERE IS EXCESS CAPACITY AVAILABLE, THE PROPERTY OWNER
 SHALL MAKE THAT CAPACITY AVAILABLE TO THE COUNTY
 THROUGH THE DEDICATION OF A TWENTY FOOT (20') DRAINAGE
 EASEMENT FROM THE ROAD RIGHT-OF-WAY TO THE ULTIMATE
 OUTFALL.THE DRAINAGE EASEMENT SHALL COVER THE ENTIRE
 POND.
  
 C. NO MORE THAN 1,146 NEW DAILY TRIPS MAY BE PERMITTED
 UNTIL CONTRACT IS LET FOR WIDENING OF HAVERHILL ROAD TO
 FIVE (5) LANES, FROM 45TH STREET TO CARIBBEAN
 BOULEVARD.
  
 D. NO BUILDING PERMITS FOR DEVELOPMENT GENERATING MORE
 THAT 85 NEW EXTERNAL PM PEAK HOUR TRIPS PRIOR TO
 LETTING OF THE CONTRACT FOR THE FOUR (4) LANING OF
 HAVERHILL ROAD, FROM BEELINE HIGHWAY TO 45TH STREET.
  
 E.NO BUILDING PERMITS FOR DEVELOPMENT GENERATING MORE
 THAT 103 NEW EXTERNAL PM PEAK HOUR TRIPS PRIOR TO
 LETTING OF THE CONTRACT FOR THE FOLLOWING IMPROVEMENTS
 AT THE INTERSECTION OF HAVERHILL ROAD AND ROEBUCK
 ROAD:
  
 1. ADDITION OF A SECOND EXCLUSIVE NORTHBOUND LEFT TURN
 LANE.
  
 2. ADDITION OF A SECOND EXCLUSIVE EASTBOUND LEFT TURN
 LANE.
  
 3. RECONFIGURE THE WESTBOUND APPROACH TO PROVIDE ONE
 EXCLUSIVE LEFT TURN LANE, TWO THROUGH LANES AND ONE
 EXCLUSIVE RIGHT-TURN LANE.
  
 F. NO BUILDING PERMITS FOR DEVELOPMENT GENERATING MORE
 THAN 261 NEW EXTERNAL AM PEAK HOUR TRIPS PRIOR TO THE
 LETTING OF THE CONTRACT FOR THE ADDITION OF A SECOND
 NORTHBOUND THROUGH LANE AT THE INTERSECTION OF
 HAVERHILL ROAD AND 45TH STREET.
  
 G. WITHIN SIX (6) MONTHS FROM THE DATE OF THE
 DEVELOPMENT ORDER (DUE BY APRIL 10, 2007), THE
 DEVELOPER MUST ENTER INTO A PUBLIC FACILITIES AGREEMENT
 (PFA) WITH PALM BEACH COUNTY TO FUND AND/OR TO
 CONSTRUCT ANY AND ALL IMPROVEMENTS AS THE TERM IS
 DEFINED BY THE TRAFFIC PERFORMANCE STANDARDS ORDINANCE.
 THE PFA MUST BE IN A FORM ACCEPTABLE TO THE COUNTY
 ENGINEER.THE CITY SHALL NOT ISSUE ANY BUILDING
 PERMITS ASSOCIATED WITH THE PROJECT UNLESS AND UNTIL
 THE PFA HAS BEEN APPROVED BY THE BOARD OF COUNTY
 COMMISSIONERS.
  
 H. A USE CHART SHALL BE SUBMITTED TO THE PLANNING AND
 ZONING AND CONSTRUCTION SERVICES DEPARTMENTS CONCURRENT
 WITH ALL BUILDING PERMIT AND/OR OCCUPATIONAL LICENSE
 APPLICATIONS STATING THE SQUARE FOOTAGE DEVOTED TO THE
 USES WITHIN BUILDINGS 1, 2 AND 3.THE SPECIFIC SQUARE
 FOOTAGE USE WITHIN EACH BUILDING MAY NOT EXCEED THE
 ALLOWANCES OUTLINED IN THE BUILDING USE SQUARE FOOTAGE
 TABLE (EXHIBIT F), UNLESS THE PROPERTY OWNER PROVIDES A
 TRAFFIC EQUIVALENCY STATEMENT, PREPARED BY A LICENSED
 TRAFFIC ENGINEER, DEMONSTRATING THAT THE APPROVED
 TRAFFIC CONCURRENCY FOR THE PROJECT IS NOT EXCEEDED.
  
 I. A TRAFFIC STATEMENT, PREPARED BY A LICENSED TRAFFIC
 ENGINEER, SHALL BE SUBMITTED TO THE PLANNING AND ZONING
 AND CONSTRUCTION SERVICES DEPARTMENTS CONCURRENT WITH
 ALL BUILDING PERMIT APPLICATIONS OUTLINING THE NUMBER
 OF DAILY TRIPS, AM TRIPS AND PM TRIPS GENERATED FOR
 EACH USE AND ITS SQUARE FOOTAGE FOR EACH BUILDING.THE
 TRAFFIC STATEMENT SHALL INCLUDE THE TRIPS ASSOCIATED
 WITH THE SPECIFIC USE AND A CUMULATIVE TABLE FOR ALL OF
 THE USES APPROVED IN THE PREMIER PARK OF COMMERCE CPD.
