2023-05-10 14:03:05THE PROVISIONS IN RESOLUTION NO. 17-22 SHALL REMAIN IN
 EFFECT, IN ADDITION TO THE FOLLOWING ADDITIONAL
 CONDITIONS:
  
 1. THE ABANDONMENT OF THE 12,596 SQUARE FOOT PORTION OF
 GRUBER PLACE AS IDENTIFIED IN PLANNING BOARD CASE NO.
 1111AAA, SHALL BE APPROVED BY THE CITY COMMISSION PRIOR
 TO THE ISSUANCE OF ANY BUILDING PERMITS ASSOCIATED WITH
 THE CONSTRUCTION OF THE NEW BUSINESS SCHOOL BUILDING.
  
 2. AT ANY TIME SHOULD THERE BE AN APPLICATION FOR THE
 REDEVELOPMENT OF A SITE THAT IS CURRENTLY LEASED BY THE
 UNIVERSITY TO PROVIDE THE NECESSARY PARKING FOR THE
 PBAU CSPD AND/OR IF CHANGES ARE MADE TO A PARKING LEASE
 AGREEMENT THAT IMPACTS THE UNIVERSITY'S PARKING
 INVENTORY, THE UNIVERSITY SHALL SUBMIT AN UPDATED
 PARKING REPORT THAT DEMONSTRATES THAT THE UNIVERSITY
 WILL CONTINUE TO MEET THE PARKING DEMAND THAT'S
 AVAILABLE TO ITS STAFF, STUDENTS AND VISITORS. THE
 STANDARDS FOR THIS PARKING REPORT SHALL BE CONSISTENT
 WITH THE REQUIREMENTS OF THE ANNUAL PARKING STUDY AS
 PROVIDED IN RESOLUTION NO. 277-20. THE PARKING REPORT
 SHALL BE SUBMITTED TO THE DEVELOPMENT SERVICES
 DEPARTMENT - PLANNING DIVISION FOR REVIEW.
  
 3. PRIOR TO THE SUBMISSION OF A BUILDING PERMIT FOR THE
 CONSTRUCTION OF THE NEW BUSINESS SCHOOL BUILDING, THE
 APPLICANT SHALL PROVIDE A CONSTRUCTION MANAGEMENT PLAN.
 THE CONSTRUCTION MANAGEMENT PLAN SHALL BE CONSISTENT
 WITH THE REQUIREMENTS OF SECTION 86-246 OF THE CITY OF
 WEST PALM BEACH CODE OF ORDINANCES.
  
 4. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES, A
 TREE ALTERATION PERMIT SHALL BE SUBMITTED, REVIEWED AND
 APPROVED BY THE DEVELOPMENT SERVICES DEPARTMENT -
 PLANNING DIVISION.
  
 5. PRIOR TO THE ISSUANCE OF THE FIRST BUILDING PERMIT
 FOR THE NEW BUSINESS SCHOOL BUILDING, THE APPLICANT
 SHALL SUBMIT A REVISED LANDSCAPE PLAN WITH A TREE
 ALTERATION PERMIT SHOWING THE LOCATIONS AND SPECIES OF
 TREES TO MEET THE TREE MITIGATION REQUIRED FOR THE
 PROJECT. ALL MITIGATION TREES SHALL BE PLANTED IN
 ACCORDANCE WITH THE APPROVED PLANS AND PRIOR TO THE
 ISSUANCE OF A CERTIFICATE OF OCCUPANCY (C.O.).
  
 6. FINAL APPROVAL OF THE ENGINEERING DESIGN SHALL BE
 BASED UPON SUBMITTAL OF A SEPARATE ENGINEERING PERMIT
 APPLICATION TO, AND REVIEWED BY, THE CITY'S PUBLIC
 WORKS AND ENGINEERING DEPARTMENTS.
  
 7. PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY
 (C.O.), THE SUBJECT PROPERTY SHALL BE RE-PLATTED IN
 ACCORDANCE WITH ALL APPLICABLE STATUTES, REGULATIONS,
 AND THE CITY'S POLICIES AND PROCEDURES.
  
 8. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF THE
 RIGHT-OF-WAY LANDSCAPING AND IRRIGATION APPROVED WITH
 THIS APPLICATION.
  
 9. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF ALL STREETSCAPE,
 LANDSCAPING AND IRRIGATION IMPROVEMENTS WITHIN THE
 RIGHT-OF-WAY APPROVED WITH THIS APPLICATION. A SEPARATE
 MAINTENANCE AGREEMENT SHALL BE REQUIRED AND EXECUTED
 PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY
 (C.O.).
  
 10. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE DRAINAGE SYSTEM
 PIPES AND STRUCTURES WITHIN THE RIGHT-OF-WAY UPSTREAM
 OF CONTROL STRUCTURE CB-1. A MAINTENANCE AGREEMENT MAY
 NEED TO BE PROVIDED TO THE CITY.
