 I HAVE REVIEWED THE ABOVE REFERENCED PETITION, AND
 PROVIDE THE FOLLOWING COMMENTS:
  
  
 1. SATISFIED. SECTION 94-448 (D)(3) REQUIRES NATIVE
 TREES AND PALMS IN GOOD CONDITION TO BE PRESERVED ON
 SITE OR RELOCATED. ANSI A 300 (PART 5) STANDARDS
 SPECIFY EXAMPLES OF SUITABILITY RATINGS OF GOOD,
 MODERATE, OR POOR FOR RELOCATION. PROVIDE AN ARBORISTS
 REPORT RATING THE CONDITION AND RELOCATION POTENTIAL
 FOR THE NATIVE TREES IN THE EXISTING STREETSCAPE AND
 PROVIDE A TREE DISPOSITION PLAN.
 ARBORIST REPORT COULD NOT BE LOCATED IN THE SUBMITTAL.
 PRESERVING THE EXISTING STREET TREES IS NOT FEASIBLE
 DURING CONSTRUCTION OF THE BUILDING. THE INTENT OF THE
 CODE IS THAT THE EXISTING STREET TREES ARE TO BE
 REPLACED WITH TREES AND INFRASTRUCTURE MEETING CURRENT
 STANDARDS.
 12/6/22 THE EXISTING STREET TREES ARE NOT SUSTAINABLE
 FOR THE FUTURE AS THEY ARE REACHING THE END OF THEIR
 SURVIVABILITY DUE TO THE COMPACTED SOIL CONDITIONS THAT
 CURRENTLY SURROUND THE PLANTING LOCATIONS. REPLACING
 WITH NEW TREES AND PROVIDING THE REQUIRED STRUCTURAL
 SOIL AT THE TIME OF CONSTRUCTION AS REQUIRED WILL
 PROVIDE SUSTAINABLE TREE CANOPY FOR THE FUTURE.
  
 2. SATISFIED. PROVIDE A DIAGRAM OF THE REQUIRED AND
 PROVIDED PUBLIC, SEMI-PUBLIC, AND PRIVATE OPEN SPACE
 AREAS AS REQUIRED IN THE NMUD ZONING DISTRICT. IDENTIFY
 THE TYPE OF OPEN SPACE. 10% COMMON PRIVATE OPEN SPACE
 IS REQUIRED. 10% PUBLIC OPEN SPACE IS REQUIRED AND MUST
 BE IN ONE OF THE FORMS OF PER SECTION 94-210 K. 4. THE
 REQUIRED OPEN SPACE NEEDS TO BE QUANTIFIED, IDENTIFIED
 AS TO THE TYPE, AND ALL REQUIREMENTS NEED TO BE SHOWN
 FOR THAT OPEN SPACE TYPE. OPEN SPACE CANNOT BE COVERED
 AREA.

 ADJUSTED TO AVOID CONFLICTS.
 1/12/23 THE LOCATION OF THE WATER UTILITY LINE FROM THE
 24TH STREET SIDE IS SHOWN IN DIRECT CONFLICT WITH A
 PROPOSED TREE. UTILITY LOCATIONS MUST BE ADJUSTED TO

 16. SATISFIED. SHOW LOCATIONS AND PROVIDE A DETAIL FOR
 STRUCTURAL SOIL UNDER THE SIDEWALK/HARDSCAPE AREAS
 ADJACENT TO THE STREET TREES. THIS SHOULD BE A 9 X 14
 FT AREA FOR EACH TREE ADJACENT TO THE CURB THAT WOULD
 BE PLANTING AREA AND STRUCTURAL SOIL.

 17. SATISFIED. REMOVE REFERENCE ON PLANS TO PLEACHED
 TREES, AS THIS IS PROHIBITED BY SECTION 94-448.

 HEDGES ARE LIMITED TO 10 FEET IN HEIGHT.

 THE WEST PROPERTY LINE, PART OF THE BUILDING ENCROACHES

 TREES PLANTED IN PAVED AREAS INTERNAL TO THE SITE TO
 ASSURE THEY ARE SUSTAINABLE.

 20. TREE CANOPY MITIGATION CALCULATIONS MUST BE
 PROVIDED ON SHEET EX-1 AS PART OF THE TREE DISPOSITION
 PLAN. TOTAL MITIGATION SQUARE FOOTAGE DUE AND TOTAL
 TREE CANOPY SQUARE FOOTAGE MITIGATION CREDITS FROM THE
 PLANT LIST MUST BE SHOWN.
  
 21. THE ELECTRIC SERVICE LINES PROPOSED ARE IN CONFLICT
 WITH THE NEW STREET TREES. STAFF DOES NOT SUPPORT
 ADDING NEW OVERHEAD LINES TO NMUD DISTRICT, ALL LINES

 CONDITIONS OF APPROVAL
 1. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES ON
 THE PROPERTY OR IN THE ADJACENT RIGHT OF WAY, A TREE
 ALTERATION PERMIT SHALL BE SUBMITTED, REVIEWED AND
 APPROVED BY THE DEVELOPMENT SERVICES DEPARTMENT,
 PLANNING DIVISION.
 2. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF THE
 STREET TREES AND RIGHT OF WAY LANDSCAPING AND
 IRRIGATION APPROVED WITH THIS PETITION.
 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF
 WAY LANDSCAPING AND IRRIGATION. THIS WILL BE THROUGH A
 SEPARATE MAINTENANCE AGREEMENT WITH THE CITY.
 4. STREETSCAPE IN FDOT RIGHT OF WAY MUST RECEIVE FDOT
 PERMIT APPROVAL PRIOR TO ISSUANCE OF THE CERTIFICATE OF
