 REQUIRED.

 3. SATISFIED - THE SURVEY INDICATES THAT THE
 WESTERN-MOST PARKING IS CONTAINED WITHIN THE BOUNDARIES
 OF THE PROPERTY (AS PART OF ?PARCEL TWO?), BUT THIS IS
 SHOWN ON THE PROPERTY APPRAISER?S WEBSITE AS BEING A
 PART OF A PARCEL OWNED BY FEC RAILWAY LLC AND IS THE
 RAILROAD RIGHT-OF-WAY. PLEASE CLARIFY. NOTE THAT IF
 THIS PARKING IS BEING INCLUDED, THE MAIL LIST, MAP,
 ETC. ALL NEED TO BE UPDATED.
  
 4. SATISFIED - SQUARE FOOTAGE AND ACREAGE SHALL BE

 6.1. SATISFIED - THE FLU AMENDMENT TRAFFIC ANALYSIS
 PREPARED BY KIMLEY HORN DATED MAY 9, 2022, STATES IN
 ITS CONCLUSION THAT, BECAUSE OF TRAFFIC LIMITATIONS,
 THE FOLLOWING RESTRICTIONS WOULD BE IN PLACE FOR THE
 AMENDMENT:
  
  - RESTRICTED MAXIMUM DAILY NON-RESIDENTIAL TRIPS:
 18,903 DAILY TRIPS
  - RESTRICTED MAXIMUM AM PEAK HOUR NON-RESIDENTIAL
 TRIPS: 567 PEAK HOUR TRIPS
  - RESTRICTED MAXIMUM PM PEAK HOUR NON-RESIDENTIAL
 TRIPS: 1,931 PEAK HOUR TRIPS
  
 ANY TYPE OF TRAFFIC RESTRICTION PLACED ON THIS FLU
 AMENDMENT SHOULD APPLY TO ALL THE TRIPS GENERATED BY
 THE AMENDMENT AND SHOULD NOT BE LIMITED ONLY TO
 ?NON-RESIDENTIAL TRIPS?. RESIDENTIAL USES ARE NOT
 EXEMPT FROM THE FLU AMENDMENT TRAFFIC REQUIREMENTS. THE
 TRAFFIC ANALYSIS SHALL BE REVISED ACCORDINGLY.
  
 6.2. PARTIALLY SATISFIED - THE FLU AMENDMENT LOS
 ANALYSIS INCLUDED IN THE APPLICATION ONLY INCLUDES THE
 SUMMARY LOS TABLE AND DOES NOT INCLUDE THE FULL LOS
 ANALYSIS AS REQUIRED. IN ADDITION, THE APPLICATION DOES
 NOT INCLUDE A WRITTEN CONFIRMATION FROM THE APPLICABLE
 SERVICE AGENCIES INDICATING THAT SUFFICIENT CAPACITY
 EXISTS TO ACCOMMODATE THE BUILDOUT OF THE PROPOSED FLU
 DESIGNATION. THE LOS ANALYSIS NEEDS TO BE REVISED
 ACCORDINGLY.
  
 6.2.1 NEW COMMENT - ?TABLE 3: CHANGE IN POTABLE WATER
 DEMAND? NEEDS TO BE REVISED. FOR THE EXISTING
 COMMERCIAL (C) FUTURE LAND USE DESIGNATION, THE
 APPLICANT SHOULD USE A POTABLE DEMAND RATE OF .20
 GALLONS PER DAY PER SQUARE FEET (GPD/SF). BASED ON MY
 CALCULATIONS THIS SHOULD RESULT ON AN EXISTING TOTAL
 POTENTIAL DEMAND OF 138,822 GPD. FOR THE PROPOSED
 COMMERCIAL EAST (CE) FUTURE LAND USE DESIGNATION, THE
 APPLICANT NEEDS TO USE THE POTABLE OF DEMAND RATE OF
 272 GALLONS PER CAPITA PER DAY (GPCPD). SINCE THE MOST
 RECENT CENSUS DATA INDICATES THAT THE CITY?S PERSON PER
 HOUSEHOLD (PPH) RATE IS AROUND 2.5, I CALCULATED THE
 TOTAL POTENTIAL DEMAND FOR THE PROPOSED CE FLU TO BE
 THE FOLLOWING: 685 UNITS X 2.5 PPD = 1,712,5 X 272
 (GPCPD) = 465,800 GPD. AS A RESULT, THE NET CHANGE IN
 POTABLE WATER DEMAND SHOULD BE 326,978 GPD.
  
 6.2.2 NEW COMMENT - IN ADDITION TO THE ?FULL? LOS
 ANALYSIS, THE APPLICATION NEEDS TO INCLUDE A REVISED
 LOS SUMMARY TABLE THAT IS CONSISTENT WITH THE DATA IN
 THE FULL ANALYSIS. THE APPLICANT PROVIDED A LOS SUMMARY
 TABLE IN THE FIRST SUBMITTAL BUT SOME OF THE DATA TABLE
 IS NOT CONSISTENT WITH THE MOST RECENT DATA IN THE FULL
 ANALYSIS.

 A) WRITTEN RESPONSES TO COMMENTS MADE BY ALL

 COMMENTS CONTINUE TO NOT BE SUFFICIENTLY ADDRESSED, THE
 APPLICANT WILL BE ACCESSED A RESUBMITTAL FEE. SUCH FEE
 WILL BE 20% OF THE ORIGINAL APPLICATION FEE.
  
 F) TO BE PLACED ON THE AUGUST 16, 2022, PLANNING BOARD
 AGENDA, SIGNS SHALL BE POSTED ON THE PROPERTY NO LATER
 THAN AUGUST 1, 2022. SIGNAGE SHALL CONFORM, AND BE
 INSTALLED ACCORDING TO THE REQUIREMENTS OF THE CITY?S
 ZONING AND LAND DEVELOPMENT REGULATIONS; SUCH
 REQUIREMENTS ARE ALSO PROVIDED IN THE DEVELOPMENT
 APPLICATION. A SIGNED AND NOTARIZED AFFIDAVIT SHALL BE
 PROVIDED BY THE DEADLINE REFERENCED ABOVE.
  
 G) IF AFTER THE CASE HAS BEEN ADVERTISED THE APPLICANT
 DESIRES TO REQUEST A CONTINUANCE, A FEE OF $50 PLUS THE
 COST OF ADVERTISING WILL BE CHARGED.
