 I HAVE REVIEWED THE ABOVE REFERENCED PETITION, AND
 PROVIDE THE FOLLOWING COMMENTS:
  
  
 1. SECTION 94-448 (D)(3) REQUIRES NATIVE TREES IN GOOD
 CONDITION TO BE PRESERVED ON SITE OR RELOCATED. ANSI A
 300 (PART 5) STANDARDS SPECIFY EXAMPLES OF SUITABILITY
 RATINGS OF GOOD, MODERATE, OR POOR FOR RELOCATION.
 PROVIDE AN ARBORIST REPORT SHOWING CONDITION AND
 RELOCATION POTENTIAL FOR THE FOR THE ROYAL PALM #21
 PROPOSED TO BE REMOVED.
  
 2. PER SECTION 94-443 (C) (2) REQUIRES SHADE TREES.
 BUFFER TREES ARE PROPOSED THAT ARE NOT SHADE TREES AS
 DEFINED IN SECTION 94-611. UNLESS THERE IS A LIMITATION
 THAT CAN BE CITED, SHADE TREES MUST BE PROVIDED IN ALL
 LANDSCAPE BUFFERS.
  
 3. PER SECTION 94-443(C)(3)A. AND B., TERMINAL
 LANDSCAPE ISLANDS AND INTERIOR ISLANDS MUST HAVE AT
 LEAST 8 FEET WIDE LANDSCAPE AREA AND RUN THE FULL
 LENGTH OF THE ADJACENT PARKING SPACE. EACH AREA SHALL
 HAVE AT LEAST ONE SHADE OR FLOWERING TREE PER ROW OF
 PARKING AND AN INTERIOR ISLAND MUST BE PROVIDED SO
 THERE ARE NO MORE THAN 10 SPACES IN A ROW. THE
 APPLICANT IS AVOIDING THIS REQUIREMENT BY NOT TREATING
 THE PAVED VACUUM SPACES AS PARKING SPACES. THE INTENT
 OF THE CODE IS TO PROVIDE TREE CANOPY FOR PAVED AREAS
 TO REDUCE HEAT ISLAND EFFECTS. THE PROPOSED PALMS AND
 SMALL TREES IN THE INTERIOR OF THE SITE DO NOT MEET THE
 INTENT OF THE CODE. STAFF RECOMMENDS SHADE TREES NEED
 BE ADDED TO THE INTERIOR OF THE SITE TO PROVIDE SHADE.
  
 4. PROVIDE AN EXHIBIT SHOWING THE PARKING AREA SURFACE
 CALCULATIONS, PARKING SPACE AREAS AND LANDSCAPE AREAS
 PROVIDED TO DEMONSTRATE COMPLIANCE WITH SECTIONS 94-443
 (C)(3) AND (4). PROVIDE THE CALCULATIONS IN THE
 LANDSCAPE REQUIREMENT CHART. REFER TO FIGURE XIV-1.
 SHOW THE ACTUAL PROVIDED LANDSCAPE SQUARE FOOTAGE.
  
 CONDITIONS OF APPROVAL
 1. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES ON
 THE PROPERTY, A TREE ALTERATION PERMIT SHALL BE
 SUBMITTED, REVIEWED AND APPROVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT, PLANNING DIVISION.
 2. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF THE
 STREET TREES AND RIGHT OF WAY LANDSCAPING AND
 IRRIGATION APPROVED WITH THIS PETITION.
 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF
 WAY LANDSCAPING AND IRRIGATION. THIS WILL BE THROUGH A
 SEPARATE MAINTENANCE AGREEMENT WITH THE CITY.
