 1.) THE SIGNED LETTER FROM THE PROPERTY OWNER AT 326
 VALENCIA ROAD, EXEMPTING THE PROJECT FROM PROVIDING THE
 REQUIRED OPAQUE FENCE/WALL BETWEEN PROPERTIES, MUST BE
 NOTARIZED PER SEC. 94-443(A) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS (ZLDRS).
  
 2.) A SIGNED AND NOTARIZED LETTER FROM THE PROPERTY
 OWNER AT 320 VALENCIA ROAD SHALL BE PROVIDED TO EXEMPT
 THE PROJECT FROM PROVIDING THE REQUIRED OPAQUE
 FENCE/WALL BETWEEN PROPERTIES. IF THIS CANNOT BE
 ACHIEVED, THE APPLICANT WILL BE REQUIRED TO PROVIDE THE
 OPAQUE FENCE/WALL PER SEC. 94-443(A) OF THE ZLDRS. IT
 WAS RECOMMENDED BY STAFF THAT THE FENCE/WALL BE PLACE 1
 FT. OFF THE PROPERTY LINE, WITHIN THE 5 FT. WIDE
 LANDSCAPE BUFFER/UTILITY EASEMENT.
  
 3.) IN ADDITION TO A NOTATION IN THE SITE PLAN (SEE
 SITE PLAN COMMENT), IT MUST BE CLEAR IN THE
 JUSTIFICATION STATEMENT THAT THE 12 FT. WIDE CONCRETE
 SLAB "TO SEAT SMALL GROUPS," IS NOT MEANT FOR
 ADDITIONAL PATRON SEATING BEYOND THE 166 SEATS APPROVED
 FOR THE PROJECT. ANY ADDITIONAL SEATING BEYOND THE
 APPROVED 166 SEATS WILL IMPACT THE PARKING REQUIREMENT
 AND ADDITIONAL PARKING SPACES WILL NEED TO BE PROVIDED
 FOR THE PROJECT.
  
 4.) ALL FINAL PLANS (I.E. ARCHITECTURAL, CIVIL AND
 LANDSCAPE PLANS) SHALL BE SIGNED, DATED AND SEALED BY
 THE ENGINEERING, ARCHITECT AND LANDSCAPE ARCHITECT.
  
  
 SITE PLAN COMMENTS:
  
 1.) PLEASE PROVIDE THE FOLLOWING NOTE ALONG THE EAST
 PROPERTY LINE (ALONG THE ADJACENT LOT LINE FOR 326
 VALENCIA ROAD): "EXISTING CHAIN LINK FENCE AND HEDGE ON
 THE PROPERTY AT 326 VALENCIA ROAD TO REMAIN PER SIGNED
 AND NOTARIZED LETTER FROM THE PROPERTY OWNER AT 326
 VALENCIA ROAD (LETTER ON FILE WITH THE DEVELOPMENT
 SERVICES DEPARTMENT ? PLANNING DIVISION)."
  
 2.) PLEASE ADDRESS THE FOLLOWING IN THE ZONING AND SITE
 DATA CALCULATIONS: A) PER THE DEFINITION FOR "BUILDING"
 IN THE ZLDRS, THE SMOKER AREA MUST BE INCLUDED IN THE
 BUILDING AREA CALCULATIONS. THE BUILDING CALCULATIONS
 ONLY REFLECT THE EXISTING BUILDING AND THE NEW WALK- IN
 COOLER. REVISE CALCULATIONS WHERE NECESSARY. B) THE
 DATA INDICATES THAT THERE ARE 26 PARKING SPACES
 PROVIDED; HOWEVER, ONLY 25 PARKING SPACES HAVE BEEN
 COUNTED IN THE SITE PLAN. PLEASE ADDRESS FOR
 CONSISTENCY.
  
 3.) ALTHOUGH PROVIDED IN THE ARCHITECTURAL ELEVATIONS,
 PLEASE NOTE THE HEIGHT OF THE WALL FOR THE ELECTRICAL
 EQUIPMENT ON THE SOUTH SIDE OF THE BUILDING IN THE SITE
 PLAN FOR REFERENCE.
  
 4.) A ROW OF 5 PARKING SPACES HAVE BEEN COUNTED ALONG
 THE WEST SIDE OF THE PROPERTY (NOT 4 SPACES). PLEASE
 CORRECT FOR CONSISTENCY.
  
 5.) PLEASE UPDATE SHEET A002 IN THE PREVIOUS APPROVED
 SITE PLAN AND INCLUDE THE UPDATED SHEET AS PART OF THE
 MINOR SITE PLAN AMENDMENT PLAN SET. PARKING STALL
 STRIPING/BIKE PARKING DETAIL MUST BE INCLUDED AS PART
 OF THE REVISION AND THE "EXISTING SIGN DETAIL" MUST BE
 ELIMINATED FROM SHEET A002, AS THE EXISTING SIGN WILL
 BE REMOVED FROM THE SITE AND A NEW FREESTANDING SIGN
 WILL BE PROVIDED IN ITS PLACE.
  
  
 INSTRUCTIONS FOR RESUBMITTAL:
  
 * PLEASE PROVIDE RESPONSES TO REVIEW COMMENTS IN
 WRITTEN FORMAT.
  
 * WHEN RESUBMITTING, PLEASE PROVIDE A MINIMUM OF 4
 PAPER COPIES, ONE REDUCED COPY IN 11 INCHES X 17
 INCHES, AND AN ELECTRONIC COPY OF ALL DOCUMENTS AND
 PLANS.
  
 * PLEASE NOTE THAT CHANGES ON THE RESUBMITTED PLANS MAY
 RESULT IN ADDITIONAL COMMENTS.
  
 * PLEASE NOTE THAT YOU WILL BE PERMITTED ONE (1)
 RESUBMITTAL AT NO ADDITIONAL COST. IF PREVIOUSLY-ISSUED
 COMMENTS CONTINUE TO NOT BE SUFFICIENTLY ADDRESSED, THE
 APPLICANT WILL BE ASSESSED A RESUBMITTAL FEE. SUCH FEE
 WILL BE 20% OF THE ORIGINAL APPLICATION FEE ($60).

 CONDITIONS OF APPROVAL:
  
 * SIGNAGE IS NOT A PART OF THIS APPROVAL. ALL SIGNAGE
 FOR THE PROJECT SHALL BE REVIEWED AT THE TIME OF
 BUILDING PERMIT FOR CONSISTENCY WITH THE ZONING AND
 LAND DEVELOPMENT REGULATIONS (ZLDRS).
  
 * SIGNED EASEMENT CONSENT FROM ALL UTILITY PROVIDERS
 (AT&T, COMCAST, FPL, FPU AND THE CITY OF WEST PALM
 BEACH) FOR THE 8-FOOT TALL OPAQUE FENCE LOCATED WITHIN
 THE 5 FT. UTILITY EASEMENT ALONG THE EAST PROPERTY LINE
 SHALL BE PROVIDED TO STAFF PRIOR TO THE ISSUANCE OF THE
 BUILDING PERMIT FOR THE FENCE.
  
 * THE APPLICANT WILL BE REQUIRED TO MAINTAIN THE EAST
 LANDSCAPE BUFFER AND 8 FT. HIGH FENCE WITHIN THE 5 FT.
 WIDE UTILITY EASEMENT AS PROVIDED IN THE APPROVED SITE
 AND LANDSCAPE PLANS AT ALL TIMES.
