 I HAVE REVIEWED THE ABOVE REFERENCED PETITION, AND
 PROVIDE THE FOLLOWING COMMENTS:
 THESE COMMENTS WERE NOT INCLUDED IN THE RESPONSE
 LETTER.
 1. SATISFIED. EAST SIDE OF PROPERTY HAS WATER AND POWER
 EASEMENT. TREES SHOULD NOT BE PLANTED ON EASEMENT
 EXISTING TREES SHOULD BE MOVED TO OTHER LOCATIONS ON
 PROJECT SITE. NO CLOSER THAN 5FT OF WATER MAIN.
 PER SECTION 94-443(A)(2)C. , REQUIRED BUFFER TREES MAY
 BE CLUSTERED AND IF THERE IS ADDITIONAL LANDSCAPE AREA
 ADJACENT TO THE BUFFER STRIP, REQUIRED TREES MAY BE
 PLACED ADJACENT TO THE BUFFER STRIP TO ALLOW A GREATER
 AREA FOR TREE DEVELOPMENT.
 IF THE REQUIRED EAST BUFFER TREES ARE TO BE PLACED IN
 THE LANDSCAPE AREAS ADJACENT TO THE EAST BUFFER, MARK
 THEM ON THE PLAN TO IDENTIFY THE COUNT MEETS THE
 REQUIREMENTS. PALMS MAY ALSO BE USED ADJACENT TO THE
 EASEMENT TO PROVIDE THE INTENDED BUFFERING. SHOW THE
 EXISTING TREES ON THE ADJACENT PROPERTY TO COORDINATE
 PLANTING LOCATIONS SO THERE IS NO CONFLICT.
  
 2. SATISFIED. LANDSCAPE BUFFER ON THE NORTH SIDE HAS
 ONLY ROYAL PALMS. THE BUFFER MUST CONTAIN FLOWERING OR
 SHADE TREES, IT CANNOT BE ENTIRELY PALMS AT LEAST ONE
 SHADE TREE PLANTED FOR EACH 30 LINEAR FEET. 94-443 B.

 UNLESS THERE ARE UTILITY CONFLICTS THAT CAN BE SHOWN ON
 THE PLANS, SHADE TREES MUST BE PROVIDED. SEE DEFINITION
 OF SHADE TREE. THIS WOULD BE A CATEGORY 1 TREE WITH A
 MATURE SPREAD OF AT LEAST 25 FEET.
  
 3. SATISFIED. SUBSTITUTION OF PALM TREES.
 PALM TREES MAY BE SUBSTITUTED FOR NOT MORE THAN 35
 PERCENT OF THE SHADE OR FLOWERING TREES REQUIRED BY
 THIS ARTICLE. HOWEVER, WHEN PALM TREES ARE SUBSTITUTED
 FOR SHADE TREES, THREE PALM TREES SHALL BE PROVIDED FOR
 EACH REQUIRED SHADE TREE. THIS 3:1 SUBSTITUTION SHALL
 NOT BE REQUIRED FOR ROYAL PALM TREES (ROYSTONEA SPP.),
 SENEGAL DATE PALM (PHOENIX RECLINATA), MEDJOOL DATE
 PALM (PHOENIX DACTYLIFERA), BISMARCK PALM (BISMARCKIA
 NOBILIS), AND SILVER DATE PALM (PHOENIX SYLVESTRIS).

 PLANTING & MAINTENANCE AGREEMENT FOR COUNTY RIGHT OF
 WAY PLANTING. PB COUNTY WOULD HAVE TO APPROVE PLANTING
 IN THE RIGHT OF WAY, AND THIS WILL NEED TO BE EXPLORED
 IF IT IS POSSIBLE. SECTION 94-452 ROADWAY

 6. CORRECT THE LANDSCAPE AREA EXHIBIT ON SHEET FOR THE
 FOLLOWING:
 ? SATISFIED. PROVIDED LANDSCAPE AREA SHADED SHOULD ONLY
 INCLUDE TERMINAL LANDSCAPE ISLANDS AND VEHICLE
 OVERHANG.
 ? SATISFIED. BUFFERS ARE NOT PART OF PARKING LANDSCAPE
 AREAS, REMOVE SHADING OF THESE. RECALCULATE PROVIDED
 PARKING LANDSCAPE AREA SQUARE FOOTAGE.
  
 6. SATISFIED. THE NEW PAVED AREA SOUTH OF THE PARCEL
 FOR CROSS ACCESS MUST SHOW SOD FOR SOIL STABILIZATION
 AND CURBS ALONG THE PAVED AREA.
  
 7. SATISFIED. CHANGE NOTE ON MULCH TO SPECIFY CYPRESS
 MULCH IS PROHIBITED AND REQUIRED DEPTH IS 3 INCHES.
  
 8. SATISFIED. LANDSCAPE TERMINAL ISLANDS WITH THE
 REQUIRED TREE MUST BE PROVIDED AT THE EAST ENDS OF THE
 NORTH PARKING AREA. THIS WOULD MAKE 8 REQUIRED TREES
 FOR PARKING TERMINAL ISLANDS.
  
 THE ISLAND WITH THE SIGN IS NOT A REQUIRED INTERIOR
 LANDSCAPE ISLAND, SO A TREE IS NOT REQUIRED. TREES MUST
 BE PROVIDED IN TERMINAL ISLANDS AND THE 75% SHADE TREE
 REQUIREMENT MET.
  
 LANDSCAPE COMMENT RESPONSES WERE NOT FOUND WITH THE
 LATEST SUBMITTAL.
  
 CONDITIONS OF APPROVAL
 1. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES ON
 THE PROPERTY, A TREE ALTERATION PERMIT SHALL BE
 SUBMITTED, REVIEWED AND APPROVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT, PLANNING DIVISION.
  
 2. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF
 RIGHT OF WAY LANDSCAPING AND IRRIGATION APPROVED WITH
 THIS PETITION.
  
 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF
 WAY LANDSCAPING AND IRRIGATION. THIS WILL BE THROUGH A
 SEPARATE MAINTENANCE AGREEMENT WITH THE CITY.
