 RESUBMITTED PLANS OR THE SUBMITTAL OF INFORMATION/PLANS
 TO ADDRESS THE COMMENTS MAY RESULT IN ADDITIONAL
 COMMENTS.
  
 - THE PPRC COMMENTS SHALL BE SUFFICIENTLY ADDRESSED AND
 SUBMITTED TO THE PLANNING DIVISION BY 5 PM ON FRIDAY,
 MARCH 26, 2021, TO BE ELIGIBLE TO BE SCHEDULED FOR THE
 MAY 18, 2021 PLANNING BOARD MEETING.
  
 - PLEASE NOTE THAT IF THE PLANNING DIVISION HAS NOT
 RECEIVED A RESPONSE TO THE PPRC COMMENTS WITHIN 60 DAYS
 FROM THE DATE OF THE PPRC MEETING (BY MAY 11, 2021),
 THE CASE SHALL BE CONSIDERED WITHDRAWN. ANY FURTHER
 ACTION SHALL REQUIRE A NEW DEVELOPMENT APPLICATION.
  
 - PLEASE NOTE THAT YOU WILL BE PERMITTED ONE (1)
 RESUBMITTAL AT NO ADDITIONAL COST. IF PREVIOUSLY-ISSUED
 COMMENTS CONTINUE TO NOT BE SUFFICIENTLY ADDRESSED, THE
 APPLICANT WILL BE ASSESSED A RESUBMITTAL FEE. SUCH FEE
 WILL BE 20% OF THE ORIGINAL APPLICATION FEE ($600).
  
 - PUBLIC HEARING NOTIFICATION SIGNAGE SHALL BE POSTED
 IN ACCORDANCE WITH THE REQUIREMENTS OF SECTION
 94-39(I)(5) OF THE ZONING AND LAND DEVELOPMENT
 REGULATIONS.
  
 1) THE CHINESE RESTAURANT SITE IS PART OF WHAT WAS
 PARCEL 3 OF THE PALM BEACH LAKES INN AND GOLF COURSE
 CPD AND COVERED BY ORDINANCE NO. 2622-93. PLEASE
 PROVIDE A RESPONSE/STATUS UPDATE TO THE CONDITIONS
 LISTED IN SECTION 5, SUBSECTIONS 3, 7, 8 AND 9 OF
 ORDINANCE NO. 2622-93.
  
 2) EVEN THOUGH THE TRAFFIC STATEMENT FOR THE
 REDEVELOPMENT SHOWS A REDUCTION IN TRIPS FOR THE
 MAJORITY OF THE TESTED TIME FRAMES, YOU ARE STILL
 REQUIRED TO SUBMIT AN APPROVED TRAFFIC PERFORMANCE
 STANDARDS LETTER FROM PALM BEACH COUNTY ENGINEERING. AN
 APPROVAL LETTER IS REQUIRED PRIOR TO SCHEDULING FOR
 PLANNING BOARD.
  
 3) THANK YOU FOR PROVIDING A COPY OF THE EASEMENT WITH
 COVENANTS AND RESTRICTIONS. IT INDICATES THAT BEST BUY
 HAS AN INTEREST IN THE CROSS ACCESS, SPECIFICALLY A
 DRIVE TO EXECUTIVE CENTER DRIVE. PLEASE PROVIDE
 VERIFICATION THAT BEST BUY HAS RELEASED THEIR INTEREST
 IN THE EASEMENT. THE SITE PLAN SHOWS THE DUMPSTER AND
 LANDSCAPING OBSTRUCTING BEST BUY FROM UTILIZING THE
 EASEMENT. PLEASE NOTE THAT REGARDLESS OF WHAT IS STATED
 IN THE EASEMENT, BEST BUY HAS NO RIGHTS TO THE
 INSTALLATION OF AN OFF PREMISE SIGN, WHICH WOULD BE IN
 VIOLATION OF THE ZONING AND LAND DEVELOPMENT
 REGULATIONS.
  
 4) THANK YOU FOR SHOWING THE CROSS ACCESS DRIVEWAY WITH
 THE BRANDSMART/BJS SITE CONSTRUCTED TO THE PROPERTY
 LINE. NOTE: THE RECENT BRANDSMART/BJS RESUBMITTAL DID
 NOT SHOW THEIR SIDE OF THE DRIVEWAY LINED UP WITH THE
 FLAMINGO PROPOSED LOCATION. STAFF WILL BE MAKING THAT
 COMMENT ON THEIR REVIEW; HOWEVER, YOU WILL NEED TO SHOW
 THE CORRECT TRAFFIC MARKINGS ON THE SITE PLAN (EXAMPLE
 STOP BAR AND SIGN FOR VEHICLES EXITING THE
 BRANDSMART/BJS SITE), EVEN THOUGH THEY WILL NOT NEED TO
 BE INSTALLED UNTIL THE CONNECTION IS COMPLETED.
  
 5) PROVIDE A COPY OF THE WARRANTY DEED AND THE FPU, FPL
 AND COMCAST LETTERS OF NO OBJECTION.
  
 6) PROVIDE COPIES OF ALL THE EASEMENTS/RESTRICTIONS
 AFFECTING THE SITE. A QUICK REVIEW OF THE TWO 30 FOOT
 I.E.E. LISTED ON THE SURVEY DO NOT SHOW THE EASEMENT
 EXTENDING TO THE PROPOSED NEW ACCESS CONNECTION TO THE
 DRIVEWAY BETWEEN THE GAS STATION AND THE RESTAURANT
 PARCEL. PLEASE PROVIDE VERIFICATION THAT YOU HAVE
 ACCESS RIGHTS TO THE PARCEL AS SHOWN.
  
 7) PLEASE CONSIDER MAKING THE EMPLOYEE/ADA PARKING
 SPACES ONLY NINE (9) FEET WIDE AND 18 FEET DEEP
 INCLUDING THE TWO (2) FOOT OVERHANG TO REDUCE THE
 AMOUNT OF PAVEMENT WITHIN THE PARKING AREA. THESE
 SPACES DO NOT NEED THE EXTRA SIZE THAT THE VACUUM
 SPACES REQUIRE.
  
 8) THE JUSTIFICATION STATEMENT STATES THAT THE SIDEWALK
 ALONG EXECUTIVE CENTER DRIVE WILL BE WIDENED TO AN 8-10
 FOOT MULTIPURPOSE PATH; HOWEVER, THE SITE PLAN CALLS
 OUT A 7-9 FOOT WIDTH THAT MATCHES THE EXISTING
 CONDITION SHOWN ON THE SURVEY. PLEASE EXPLAIN OR AMEND
 THE JUSTIFICATION STATEMENT.
  
 9) THE ZONING AND LAND DEVELOPMENT REGULATIONS REQUIRE
 THAT ANY SOURCE OF ILLUMINATION LOCATED WITHIN A
 COMMERCIAL PLANNED DEVELOPMENT DISTRICT SHALL NOT
 EXCEED ONE FOOTCANDLE AT OR BEYOND THE BOUNDARIES OF
 SUCH DEVELOPMENT. THE PHOTOMETRIC PLAN SHOWS THIS
 MAXIMUM BEING EXCEEDED ALONG EXECUTIVE CENTER DRIVE.
 THE BOUNDARY WITH BEST BUY DOES NOT MATCH THE SITE
 PLAN, BUT STILL APPEARS TO EXCEED THE PERMITTED LIGHT
 LEVELS.
  
 10) PROVIDE THE DETAILS OF THE PAY LANE STRUCTURE. THE
 POSTS ON THE EAST SIDE OF THE STRUCTURE ARE LOCATED
 WITHIN THE REQUIRED FIVE (5) FOOT SIDE SETBACK, WHICH
 IS NOT PERMITTED.
  
 11) THE PROPOSED BICYCLE RACK NEEDS TO HAVE A SUPPORT
 POST DIMENSION BETWEEN 22 AND 24 INCHES AS OPPOSED TO
 THE 14.375 INCHES SPECIFIED ON THE BICYCLE RACK DETAIL.
 THE NARROW DIMENSION IS NOT ADEQUATE TO APPROPRIATELY
 SECURE A BICYCLE.
  
 12) PROVIDE THE BICYCLE PAD DIMENSIONS ON THE OVERALL
 SITE OR CIVIL PLAN AS WELL AS THE ARCHITECTURAL SITE
 PLAN.
  
 13) THE FLAG POLE MAY NOT EXCEED 50 FEET IN HEIGHT AND
 MAY NOT FLY A FLAG WITH THE NAME OR LOGO OF THE
 BUSINESS.
  
 14) NONE OF THE PLANT MATERIALS ARE LABELED ON THE
 LANDSCAPE PLAN. STAFF CANNOT VERIFY COMPLIANCE WITH THE
 LANDSCAPE CODE REQUIREMENTS.
  
 15) THE EAST AND SOUTH BUFFERS DO NOT APPEAR TO MEET
 THE MINIMUM NUMBER OF REQUIRED TREES NOR DO THEY MEET
 THE REQUIRED SPACING OF THE TREES DUE TO THE DRAINAGE
 EASEMENTS. YOU HAVE NOT DEMONSTRATED COMPLIANCE WITH
 THE LANDSCAPE REQUIREMENTS.
  
 16) FREESTANDING SIGNS ARE REQUIRED TO BE A MINIMUM OF
 24 FEET FROM ADJOINING LOT LINES. THE MONUMENT SIGN
 LOCATION DOES NOT COMPLY WITH THIS SETBACK REQUIREMENT.
 WHAT IS THE PROPOSED HEIGHT OF THE SIGN?
  
 17) DIRECTIONAL SIGNS ARE REQUIRED TO BE A MINIMUM OF
 20 FEET FROM ANOTHER LOT LINE. THE PROPOSED DIRECTIONAL
 SIGNS DO NOT MEET THIS REQUIREMENT. NO DETAILS ON THE
 DIRECTIONAL SIGNS WERE PROVIDED TO VERIFY CODE
 COMPLIANCE. NOTE: DEPENDING ON WHAT THE SIGNS ARE FOR,
 THEY MAY ACTUALLY BE PARKING AREA INSTRUCTIONAL SIGNS,
 WHICH HAVE DIFFERENT SETBACK PROVISIONS.
  
 18) THE DUMPSTER ENCLOSURES DO NOT MEET THE MINIMUM
 CITY STANDARDS.
  
 19) THE CONCEPTUAL ENGINEERING PLAN SHOWS THE PROPOSED
 CONTROL STRUCTURE AND OUTFALL PIPE WITHIN THE LANDSCAPE
 BUFFER ON THE BRANDSMART/BJS SITE. THIS NEEDS TO BE
 RELOCATED TO UNDERNEATH A PAVED AREA SO AS NOT TO
 IMPACT REQUIRED LANDSCAPE BUFFERS.
  
 20) WHAT IS LOCATED WITHIN THE DRAINAGE EASEMENTS? WHAT
 IS THE OPPORTUNITY TO ABANDON, REVISE OR RELOCATE THEM?
 THE NON-EXCLUSIVE OUTFALL DRAINAGE EASEMENT RECORDED IN
 ORB 11870 PG 300 INCLUDES PROVISIONS FOR TERMINATION OF
 THE EASEMENTS OF PORTIONS OF EASEMENTS THAT ARE NO
 LONGER NEEDED.
  
 21) TURN OFF THE TREE DISPOSITION LAYER ON THE SITE
 PLAN. THIS NEEDS TO BE SHOWN ON A SEPARATE PLAN AS IT
 IMPEDES THE READABILITY OF THE SITE PLAN.
  
 22) PLEASE CONSIDER USING A PERVIOUS PAVEMENT
 UNDERNEATH THE VACUUM AREA PARKING SPOTS.
  
 23) STAFF HAS NOTED THAT THERE IS NO INTERNAL
 PEDESTRIAN CIRCULATION BETWEEN THE MARATHON GAS
 STATION, THE PROPOSED FLAMINGO CAR WASH SITE AND THE
 BEST BUY. IN ORDER TO COMPLY WITH THE PEDESTRIAN
 CIRCULATION SITE DESIGN QUALITATIVE DEVELOPMENT
 STANDARDS, YOU WILL NEED TO PROVIDE A FIVE (5) FOOT
 WIDE SIDEWALK ALONG THE WEST PROPERTY LINE OF THE SITE
 FROM EXECUTIVE CENTER DRIVE TO THE BEST BUY PROPERTY
 LINE. THE LANDSCAPE BUFFER WOULD BE SHIFTED TO THE
 SIDEWALK AND YOUR EXISTING CURB LINE.
  
 24) THE BENCHES ALONG EXECUTIVE CENTER DRIVE NEED TO
 MEET CPTED STANDARDS.
  
 25) PLEASE CLARIFY THE INTENT OF THE USE CHART THAT IS
 INCLUDED WITH THE SITE PLAN.
  
 26) IN ORDER TO PROVIDE FOR A UNIFORM STREETSCAPE ON
 THIS SIDE OF EXECUTIVE CENTER DRIVE AND PROVIDE SHADE,
 THE NORTHERN BUFFER TREES NEED TO BE GUMBO LIMBO TREES.
