 1.) CAREFUL CONSIDERATION MUST BE APPLIED TO THE LIST
 OF PERMITTED USES BASED ON THE VISION, OVERALL SIZE AND
 DESIGN OF THE CPD. THERE ARE ISSUES WITH SOME OF THE
 PROPOSED USES PERMITTED BY RIGHT (I.E. USES LISTED AS
 PXR IN THE ZLDRS HAVE ADDITIONAL STATE REQUIREMENTS AND
 CANNOT BE LISTED AS BY-RIGHT USES); IN OTHER CASES,
 OTHER USES (I.E. HOTELS/MOTELS) ARE NOT APPROPRIATE
 BASED ON THE SIZE AND OVERALL MASTER DESIGN OF THE
 SITE; AND SOME USES ARE JUST NOT APPROPRIATE (I.E. BAIT
 AND TACKLE STORES, ETC.) GIVEN THE CHARACTER OF THE
 AREA. PLEASE ADDRESS.
  
 2.) THE LIST OF PERMITTED USES MAY BE SIMPLIFIED BY
 SPECIFYING ONLY THOSE USES PERMITTED WITHIN THE CPD;
 AND ALL OTHER USES SHALL BE PROHIBITED.
  
 3.) ACCORDING TO THE DESIGN GUIDELINES, THE MINIMUM
 BUILDING SETBACK ALONG 45TH STREET IS 15 FEET. IT IS
 HIGHLY ENCOURAGED THAT A MAXIMUM BUILDING SETBACK IS
 ESTABLISHED TO MAINTAIN THE RELATIONSHIP BETWEEN THE
 STREET AND ANY FUTURE BUILDING ALONG 45TH STREET.
 SIMILAR REGULATIONS SHOULD ALSO BE APPLIED TO NEW
 BUILDINGS ALONG MILITARY TRAIL.
  
 4.) THE GUIDELINES MAY WANT TO ELABORATE ON PEDESTRIAN
 ENTRANCES/BUILDING FRONTAGE REQUIREMENTS TO ENCOURAGE
 SOME CONCEPTS OF NEW URBANISM.
  
  
 GENERAL COMMENTS:
  
 1.) THE ADDRESS LIST AFFIDAVIT WAS SIGNED AND SEALED BY
 A NOTARY WHO HAS AN EXPIRED COMMISSION (APRIL 14,
 2020). THEREFORE, THE SIGNED ADDRESS LIST AFFIDAVIT IS
 NOT VALID. PLEASE ADDRESS.
  
 2.) WATER AND SEWER SERVICE IS PROVIDED BY THE CITY OF
 RIVIERA BEACH. A LETTER FROM THE CITY OF RIVIERA BEACH
 CONFIRMING THAT THE CITY HAS REVIEWED THE PROPOSAL FOR
 WATER AND SEWER IS REQUIRED. THE LETTER MUST STATE THAT
 THE CITY WILL NOT HAVE ANY ISSUES WITH SERVICING THE
 PROPOSED PROJECT.

 STANDARDS (TPS) OF THE COUNTY. PLEASE NOTE THAT THE
 PROJECT WILL NOT MOVE FORWARD TO THE PUBLIC HEARING
 STAGE WITHOUT THE TPS LETTER FROM THE COUNTY.

 COMPATIBLE/COMPLIMENTARY AND HOW THE USES WILL ENHANCE
 THE VISION OF THE CPD. B) PROPOSED DEVELOPMENT BUILDING
 SQUARE FOOTAGES ARE INCONSISTENT WITH THE NUMBERS
 PROVIDE IN THE TRAFFIC IMPACT STATEMENT; C) CHECK THE
 SURROUNDING LAND USE AND ZONING TABLE. THERE ARE
 INACCURACIES WITHIN THE INFORMATION PROVIDED IN THE
 TABLE; D) PLEASE ADDRESS WHY THE APPLICATION IS SEEKING
 A REZONING TO CPD. IT MAY BE HELPFUL TO REVIEW SEC.
 94-207 OF THE ZONING AND LAND DEVELOPMENT REGULATIONS
 (ZLDRS), TO ASSIST IN PROVIDING MORE INFORMATION IN THE
 REQUEST FOR THE CPD. AT THIS POINT IN TIME, THERE IS NO
 RELEVANCE TO THE REQUEST FOR THE CPD, AS THE
 DEVELOPMENT OF THE CONVENIENCE STORE AND ACCESSORY GAS
 STATION COULD BE BUILT WITHIN THE GENERAL COMMERCIAL
 (GC) ZONING DISTRICT WITH ADDITIONAL STANDARDS; E)
 UNIFIED CONTROL PURSUANT TO ZLDR S.94-207(B)(8); F)
 SCHEDULE OF DEVELOPMENT WHICH IDENTIFIES THE
 ANTICIPATED PROJECT START AND COMPLETION DATES, STAGES
 OF DEVELOPMENT (IF ANY) AND THE LOCATION OF COMMON OPEN
 SPACE TO BE PROVIDED AT EACH STAGE. [ZLDR

 MASTER DEVELOPMENT PLAN (SHEET MP-1):
  
 1.) PLEASE REVIEW AND ENSURE THE PARKING CALCULATIONS
 FOR ALL PROPOSED AND FUTURE DEVELOPMENTS MEETS THE
 REQUIREMENT FOR THE ALLOWABLE NUMBER OF ACCESS POINTS
 INTO THE DEVELOPMENT. A WAIVER WILL BE REQUIRED FOR THE
 CPD IF THE DEVELOPMENT CANNOT MEET THE STANDARDS OF
 ZLDR S.94-312.

 WHAT DO THESE ARROWS REPRESENT? IT WOULD BE HELPFUL TO
 PROVIDE A LEGEND. B) THE PROPOSED AREAS OF FAST FOOD
 RESTAURANT WITH DRIVE-THROUGH SHOULD BE CLARIFIED FOR
 CONSISTENCY (I.E. PLAN INDICATES THAT THOSE PORTIONS OF
 THE CPD ARE DEDICATED FOR FAST-FOOD RESTAURANT ONLY).
 C) THE ZONING DESIGNATION TO THE NORTHEAST IS
 INDUSTRIAL (NOT GENERAL INDUSTRIAL). D) DISCUSSION WITH
 STAFF IS NEEDED TO DETERMINE IF THE WAWA SITE PLAN
 SHOULD BE ILLUSTRATED IN THE MASTER PLAN OR ON A
 OVERALL SITE PLAN SHEET (WHICH WILL BE UPDATED AS
 DEVELOPMENT OCCURS ON THE PROPERTY.)
  
 3.) IN THE SCHEDULE OF USES: IT SHOULD REFERENCE THE
 PERMITTED USES AS THOSE USES LISTED IN THE ADOPTED
 DESIGN GUIDELINES DOCUMENT. (PLEASE SEE STAFF NOTES IN
 THE DESIGN GUIDELINES DOCUMENT SECTION).
  
 4.) PLEASE ADDRESS THE FOLLOWING IN THE OVERALL CPD
 SITE DATA TABULAR: A) TOTAL FAR IS 0.12 (NOT 0.11). B)
 CLARIFY FAST FOOD RESTAURANT WITH DRIVE-THROUGH FOR
 CONSISTENCY.
  
 5.) PLEASE ADDRESS THE FOLLOWING IN THE OVERALL SITE
 DEVELOPMENT REGULATIONS TABULAR: A) THE MINIMUM REAR
 (WEST) BUILDING SETBACK IS 15 FT. SINCE IT ABUTS A
 RESIDENTIAL ZONING DISTRICT (NOT 5 FT.). THIS SHOULD BE
 CLARIFIED FOR CONSISTENCY WITH THE ZLDRS.
  
 6.) PER ZLDR S.94-207(B)(9), THE LEGAL DESCRIPTION FOR
 THE CPD SHALL BE PROVIDED IN THE MASTER PLAN DOCUMENT.
  
  
 SITE PLAN COMMENTS:
  
 1.) IT IS RECOMMENDED THAT THE APPLICANT CONSIDER
 MOVING THE BUILDING CLOSER TO 45TH STREET TO IMPROVE
 THE RELATIONSHIP BETWEEN THE BUILDING AND THE STREET.
  
 [5/11/2020 MODIFIED COMMENT #1: ALTHOUGH THE PROPOSED
 DESIGN GUIDELINES SPECIFIES A MINIMUM SETBACK OF 15 FT.
 FOR THE RETAIL/RESTAURANT BUILDINGS ALONG 45TH STREET,
 A MAXIMUM BUILDING SETBACK SHOULD ALSO BE ESTABLISHED
 TO ENCOURAGE THE BUILDINGS MAINTAIN AN ACTIVE
 RELATIONSHIP WITH THE STREET FRONTAGE ALONG 45TH
 STREET. NOTED EXCEPTION FOR BUILDING SETBACK FOR THE
 AREA DESIGNATED FOR THE CONVENIENCE
 STORE/GAS STATION SHALL ALSO BE NOTED IN THE DESIGN
 GUIDELINES.]
  
 2.) THE PROPOSED FREESTANDING SIGNS ALONG 45TH STREET

 VEHICLES FROM CONFLICTING WITH THE PROPOSED AIR PUMP
 PARKING ONLY SIGN. PLEASE ADDRESS.
  
 5.) NO INFORMATION PROVIDED ON THE HEIGHT IN THE
 BOLLARD DETAIL (SHEET SP-2).
  
 6.) THE BICYCLE RACK SHALL BE LOCATED NEAR THE
 PRINCIPAL ENTRANCE OF THE BUILDING AS PRACTICABLE. THE
 CURRENT LOCATION OF THE BICYCLE RACK IS INCONSISTENT
