 NOTED DISCREPANCIES IN THE DECLARATION:
  
 A. THE THIRD WHEREAS CLAUSE INCORRECTLY STATES THAT THE
 GROUND LEASE PARCEL CONTAINS NO PARKING FACILITIES
 (THERE ARE 38 FULL PARKING SPACES ON THE GROUND LEASE
 PARCEL) AND THAT THE GROUND LEASE PARCEL IS NOT
 ADJACENT TO A PUBLIC ROADWAY (IT DIRECTLY ABUTS THE
 45TH STREET RIGHT-OF-WAY). THIS DOES NOT AFFECT THE
 SUBDIVISION, BUT SHOULD BE CORRECTED.
  
 B. SECTION 3 STATES THAT THE DECLARANT NEEDS TO PROVIDE
 105 PARKING SPACES, 6 OF THEM ADA PARKING SPACES,
 WITHIN THE EASEMENT PROPERTY. THERE ARE ONLY 99 FULL
 PARKING SPACES (3 SPACES BISECTED BY THE PROPERTY LINE)
 AND 4 ADA PARKING SPACES WITHIN THE EASEMENT PROPERTY.
 SINCE MOB 1 REQUIRES 130 PARKING SPACES, WHICH IS MET
 BY THE 99 PARKING SPACES IN THE EASEMENT PROPERTY AND
 THE 38 PARKING SPACES ON PARCEL B. THE 130 REQUIRED
 PARKING SPACES REQUIRE THAT A MINIMUM OF 5 ADA PARKING
 SPACES BE PROVIDED. SINCE THE NEW PARCEL B, NOR THE
 CURRENT DECLARATION OR THE PROPOSED FIRST AMENDMENT
 PROVIDE FOR THE 5TH REQUIRED ADA PARKING SPACE, MOB 1
 DOES NOT MEET THE CODE REQUIRED PARKING MINIMUMS. THE
 ENTIRE JFK NORTH CAMPUS DOES MEET ITS ADA REQUIREMENTS,
 WHICH IS WHY STAFF SUGGESTED THAT THE REVISED CROSS
 PARKING AGREEMENT COVER THE ENTIRE CAMPUS AND NOT JUST
 A SPECIFIC AREA. THE SUBDIVISION CANNOT MOVE FORWARD
 UNTIL THIS IS CORRECTED. PLEASE NOTE THAT RESTRIPING
 SOME OF THE EXCESS PARKING SPACES TO CREATE AN
 ADDITIONAL ADA SPACE WILL REQUIRE BOTH A BUILDING
 PERMIT AND A MINOR AMENDMENT CORRECT THE PARKING TABLE
 ON THE OVERALL JFK NORTH CAMPUS MASTER PLAN.
  
 2) FIRST AMENDMENT TO ACCESS AND PARKING EASEMENT
 DECLARATION NOT YET RECORDED.

 INCLUDE PLACES FOR THE PLAT RECORDING INFORMATION TO BE

 AMENDMENT. HOWEVER, THE PLAT HAS PLACES THAT THE FIRST
 AMENDMENT RECORDING INFORMATION NEEDS TO BE FILLED IN
 PRIOR TO THE RECORDING OF THE PLAT. SINCE EITHER THE
 PLAT OF THE FIRST AMENDMENT NEED TO BE RECORDED FIRST,
 THE INFORMATION FROM THE OTHER INSTRUMENT IS UNABLE TO
