2019-08-12 11:10:44PLEASE NOTE THAT ALL THE CONDITIONS OUTLINED IN
 RESOLUTION NO. 128-19, APPROVING THE LAST MAJOR PD
 AMENDMENT TO THE PALMS GATEWAY CPD ARE STILL VALID AND
 SHALL ALSO APPLY TO THE APPROVAL OF THIS AMENDMENT. THE
 CONDITIONS FROM RESOLUTION NO. 128-19 ARE AS FOLLOWS:
  
 1.) NO BUILDING PERMITS FOR THE CONSTRUCTION OF THE
 APPROVED USES SPECIFIED IN THE TRAFFIC PERFORMANCE
 STANDARDS (TPS) REVIEW LETTER (#180513), DATED FEBRUARY
 13, 2019, BY THE PALM BEACH COUNTY TRAFFIC DIVISION,
 SHALL BE ISSUED AFTER AUGUST 5, 2022. ALL OTHER
 EXISTING CONDITIONS IN THE PREVIOUS TPS APPROVAL LETTER
 (#160704) ISSUED BY THE COUNTY AND DATED DECEMBER 14,
 2016 SHALL REMAIN VALID.
  
 2.) PRIOR TO BUILDING PERMIT ISSUANCE FOR THE
 MITSUBISHI DEVELOPMENT ON TRACT #3, DOCUMENTATION THAT
 THE PROPOSED CHANGES TO POND 1 ON TRACTS 3 AND 4 HAS
 BEEN APPROVED BY THE REQUIRED PARTIES PURSUANT TO THE
 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS
 AND RECIPROCAL EASEMENT AGREEMENT RECORDED BEGINNING ON
 PAGE 1743 OF PALM BEACH COUNTY OFFICIAL RECORDS BOOK
 29483 SHALL BE SUBMITTED TO THE DEVELOPMENT SERVICES
 DEPARTMENT ? PLANNING DIVISION.
  
 3.) PRIOR TO THE REMOVAL AND RELOCATION OF ANY TREES ON
 THE PROPERTY, A TREE ALTERNATION PERMIT SHALL BE
 SUBMITTED, REVIEWED AND APPROVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT ? PLANNING DIVISION.
  
 4.) ALL PRIVATE DEVELOPMENT PROJECTS, INCLUDING NEW
 CONSTRUCTION, OR THE RENOVATION OR IMPROVEMENT OF ANY
 EXISTING BUILDING, WHERE THE TOTAL CONSTRUCTION COSTS
 ARE EQUAL TO OR GREATER THAN $750,000 IS SUBJECT TO THE
 ART IN PUBLIC PLACES REQUIREMENTS OF CHAPTER 78,
 ARTICLE V, OF THE CITY?S CODE OF ORDINANCES.
