| | 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE |
| | RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF |
| | WAY LANDSCAPING AND IRRIGATION ADJACENT TO THE |
| | DEVELOPMENT. THIS WILL BE THROUGH A SEPARATE |
| | MAINTENANCE AGREEMENT WITH THE CITY. |

| | 4. IRRIGATION FOR STREET TREES AND LANDSCAPING IN THE |
| | RIGHT OF WAYS SHALL BE PROVIDED BY THE APPLICANT, |
| | SUCCESSORS AND ASSIGNS FROM THE SUBJECT DEVELOPMENT. |
| | ALL EXISTING CITY IRRIGATION LINES RUNNING TO |
| | INDIVIDUAL AREAS OR TREES SHALL BE REMOVED AND CAPPED |
| | IN SUCH A WAY TO ENSURE CITY IRRIGATION SUPPLY LINES |
| | SHALL REMAIN INTACT AND CONTINUOUS FOR OTHER AREAS |
| | SERVED BY THE LINES. |
