 PLEASE PROVIDE A WRITTEN RESPONSE TO THE FOLLOWING
 REVIEW COMMENTS:
  
 1. BUILDING #1 IS SHOWN ENCROACHING INTO THE SOUTH
 DIXIE HIGHWAY RIGHT-OF-WAY AND DOES NOT COMPLY WITH THE
 MINIMUM SETBACK REQUIREMENTS. - PLEASE CLARIFY YOUR
 RESPONSE OF "SEEKING A TRANSFER OF THE PARCEL FROM THE
 CITY..." THERE HAVE BEEN NO DISCUSSIONS WITH STAFF
 REGARDING THIS AND WHETHER OR NOT THE CITY AGREES WITH
 THE APPLICANT'S POSITION REGARDING THE PROPERTIES
 STATUS/DISPOSITION. DISCUSSIONS NEED TO OCCUR BETWEEN
 THE APPLICANT AND VARIOUS CITY STAFF REGARDING THIS
 MATTER TO ENSURE THAT ALL PARTIES ARE ON THE SAME PAGE.
 THIS DETERMINES WHETHER OR NOT THE PROJECT (AS
 CURRENTLY DESIGNED) COMPLIES WITH THE MINIMUM SETBACK
 REQUIREMENTS.
  
 2. STAFF HAS CONCERNS WITH THE FOLLOWING ELEMENTS:
  
  C. THE PROPOSED INGRESS/EGRESS POINT ON HAMPTON ROAD,
 ADJACENT TO RAILROAD TRACKS AND THE POTENTIAL IMPACT TO
 THE RESIDENTIAL NEIGHBORHOOD TO THE WEST. - WE WOULD
 LIKE TO HEAR WHAT THE FEEDBACK FROM THE NEIGHBORHOOD
 WILL BE ON THIS ISSUE.
  
  D. PARKING CALCULATION UTILIZING RETAIL USES ONLY. HOW
 WILL RESTAURANT USES BE ACCOUNTED FOR? WILL THERE BE A
 PROHIBITION ON RESTAURANT USES? WILL A MONITORING TABLE
 BE REQUIRED? - THE SITE PLAN STILL REFERENCES THE
 "SHARED PARKING TABLE" UNDER THE "PARKING PROVIDED"
 PORTION OF THE SITE DATA TABLE.
  
 3. TRAFFIC CONCURRENCY APPROVAL SHALL BE OBTAINED FROM
 PALM BEACH COUNTY.
  
 6. WILL A LIST OF PERMITTED/PROHIBITED USES BE
 DEVELOPED FOR THE CPD? - THE PROPOSED LIST OF USES
 INCLUDE RESTAURANTS; PLEASEE REFER TO COMMENT #2D ABOVE
 REGARDING THE IMPACT ON THE PARKING IF RESTAURANT USES
 ARE ALLOWED.
  
 8. THE PRE-APPLICATION LETTER FROM FDOT INDICATES 4,500
 SQUARE FEET OF RESTAURANT USE, BUT THIS IS NOT
 INDICATED ANYWHERE ELSE ON THE SITE PLAN, ETC. PLEASE
 CLARIFY AND ENSURE THAT ALL PROPOSALS ARE CONSISTENT. -
 WHAT IS THE STATUS OF GETTING THE REVISED LETTER FROM
 FDOT?
  
 13. PLEASE EXPLAIN HOW THE FAR WAS CALCULATED. FAR
 INCLUDES AIR-CONDITIONED OR FULLY ENCLOSED STORAGE
 SPACES, ENCLOSED AREAS ON THE ROOFTOP SUCH AS BATHROOMS
 AND LOBBIES, STAIRS AND ELEVATOR AREAS, AND EXTERNAL
 UNENCLOSED CIRCULATION AREAS. THE FAR CALCULATION SHALL
 NOT INCLUDE PARKING AREAS; UNENCLOSED COLONNADES,
 PORCHES AND BALCONIES; MECHANICAL AND ELECTRICAL
 SPACES; TRASH ROOMS; AND STORAGE SPACES WITHOUT WINDOWS
 AND ENCLOSED BY SURFACES THAT ALLOW FOR NATURAL
 VENTILATION OR OUTSIDE AIR CIRCULATION. THE FLOOR AREA
 SHALL BE MEASURED FROM THE OUTSIDE FACE OF EXTERIOR
 WALLS. - THE FAR ON THE SITE PLAN (DATED 3/22/18)
 INDICATES THAT THE FAR IS 0.57. PURSUANT TO THE ZONING
 AND LAND DEVELOPMENT REGULATIONS, THE FAR NEEDS TO
 INCLUDE THE RESIDENTIAL BUILDINGS. IT IS MY
 UNDERSTANDING THAT THIS HAS ALREADY BEEN ADDRESSED, BUT
 WAS NOT DONE UNTIL AFTER THE 3/22/18 SUBMITTAL.
  
 15. BICYCLE PARKING SHALL BE PROVIDED FOR THE MIXED-USE
 BUILDINGS ALONG SOUTH DIXIE HIGHWAY. - STAFF RECOGNIZES
 THAT BIKE STORAGE HAS BEEN PROVIDED FOR
 RESIDENTS/TENANTS, BUT BIKE RACKS NEED TO BE PROVIDED
 THROUGHOUT THE NON-RESIDENTIAL PORTION OF THE SITE SO
 THAT THEY CAN BE UTILIZED BY PATRONS OF THE
 NON-RESIDENTIAL USES.
  
 18. HOW WILL SIGNAGE BE ADDRESSED WITHIN THE PLANNED
 DEVELOPMENT? - NO SIGN PROGRAM IS BEING DEVELOPED? IF
 NOT, THEN ALL SIGNAGE WILL BE REGULATED BY THE GENERAL
 COMMERCIAL (GC) PROVISIONS OF THE CITY'S SIGN CODE.
  
 20. THE TRASH COMPACTOR AT THE SOUTH END OF THE
 PROPERTY SEEMS LIKE IT WOULD BE DIFFICULT TO
 LOAD/UNLOAD. THE TURNING MOVEMENTS SHOWN ON SHEET C6.00
 DON?T SEEM CONDUCIVE TO ACTUALLY PICKING IT UP. THE
 GATE CONFIGURATION APPEARS TO CONFLICT WITH THE
 MOVEMENTS AS WELL. - THE REVISED LOCATION OF THE
 DUMPSTER REQUIRES THE OPENING OF BOTH (IN-BOUND AND
 OUT-BOUND) GATES; PLEASE EXPLAIN HOW THIS WILL
 FUNCTION.
  
 29. HAS ANY COORDINATION BEEN MADE WITH THE SCHOOL
 DISTRICT WITH REGARD TO THE PROVISION OF SCHOOL BUS
 PICK-UP/DROP-OFF AND HOW THAT WOULD OCCUR WITHIN THE
 PROPOSED DEVELOPMENT? - PLEASE PROVIDE AN UPDATE.
  
 ADDITIONAL COMMENTS:
  
 31. TURN-AROUND SPACES NEED TO BE PROVIDED BEFORE THE
 GATES.
  
 32. NEIGHBORHOOD OUTREACH NEEDS TO OCCUR BEFORE
 SCHEDULING OR NOTIFICATION OF ANY PUBLIC HEARING (I.E.
 PLANNING BOARD). RESIDENT COMMENTS FROM THE OUTREACH
 MEETINGS NEEDS TO BE CONSIDERED AND POTENTIALLY
 INCORPORATED INTO THE PROPOSED DEVELOPMENT.

 PROVIDED, ALONG WITH ONE (1) REDUCED COPY (11IN X
 17IN), AND AN ELECTRONIC COPY OF ALL PLANS.
  
 C) PLEASE NOTE THAT RE-SUBMITTALS MAY BE SUBJECT TO
 ADDITIONAL COMMENTS.
  
 D) IF NO RESPONSE IS RECEIVED WITHIN 60 DAYS OF THE
 ISSUANCE OF THESE COMMENTS, THE APPLICATION WILL BE
 CONSIDERED WITHDRAWN AND ANY FURTHER ACTION WILL
 REQUIRE SUBMISSION OF A NEW DEVELOPMENT APPLICATION.
  
 E) PLEASE NOTE THAT YOU WILL BE PERMITTED ONE (1)
 RESUBMITTAL AT NO ADDITIONAL COST. IF PREVIOUSLY-ISSUED
 COMMENTS CONTINUE TO NOT BE SUFFICIENTLY ADDRESSED, THE
 APPLICANT WILL BE ACCESSED A RESUBMITTAL FEE. SUCH FEE
 WILL BE 20% OF THE ORIGINAL APPLICATION FEE.
  
 F) IN ORDER TO BE CONSIDERED FOR THE JUNE 19, 2018,
 PLANNING BOARD AGENDA, ALL COMMENTS SHALL BE
 SATISFACTORILY ADDRESSED. PLEASE SUBMIT ALL REVISED
 DOCUMENTS/PLANS NO LATER THAN MAY 12, 2018.
  
 G) TO BE PLACED ON THE JUNE 19, 2018, PLANNING BOARD
 AGENDA, SIGNS SHALL BE POSTED ON THE PROPERTY NO LATER
 THAN JUNE 4, 2018. SIGNAGE SHALL CONFORM AND BE
 INSTALLED WITH THE REQUIREMENTS OF THE CITY?S ZONING
 AND LAND DEVELOPMENT REGULATIONS, AS ALSO PROVIDED IN
 THE DEVELOPMENT APPLICATION. A SIGNED AND NOTARIZED
 AFFIDAVIT SHALL BE PROVIDED BY THE DEADLINE REFERENCED
 ABOVE.
