 JANUARY 20, 2017
 I HAVE REVIEWED THE ABOVE REFERENCED PETITION, AND
 PROVIDE THE FOLLOWING COMMENTS:
  
 1. SATISFIED. PLEASE REVISE THE OPEN SPACE DIAGRAM AND
 CALCULATIONS TO SHOW THE REQUIRED 20% TERRACE PRIVATE
 OPEN SPACE ON SHEET LP-2 TO MEET THE REQUIREMENTS FOR
 THE CWD-CD. IT MUST MEET THE DEFINITION FOUND IN
 SECTION 94-109, AND HAVE A LANDSCAPE PLAN PROVIDED.
 THE TERRACE PROVIDED WITHOUT MEETING THE VEGETATIVE
 COVER REQUIREMENT REQUIRES DAC BOARD APPROVAL FOR A
 VARIANCE. STAFF MAY SUPPORT THE VARIANCE DUE TO THE
 HISTORIC VALUE OF THE BUILDING.
  
 2. SATISFIED. THE CWD-10 SITE IS LESS THAN 50,000 SQ
 FT, SO NO PUBLIC OPEN SPACE IS REQUIRED. PLEASE CORRECT
 THE OPEN SPACE CHART TO REFLECT THIS.
  
 3. SATISFIED. PLEASE CLARIFY THE AREA COUNTED AS
 PRIVATE OPEN SPACE TO MEET THE 25% REQUIREMENT ON THE
 CWD-10 SITE, AND SHOW THAT IT MEETS THE REQUIRED
 VEGETATED AND CANOPY AREAS.
  
 THE ROOFTOP GARDEN CATEGORY OF PRIVATE OPEN SPACE
 CONTAINS AMENITIES BY DEFINITION, AND REQUIRES 30%
 VEGETATED AREA AND 20% TREE CANOPY. THE AREA IS
 COMBINED FOR BOTH BUILDINGS AND SHOULD MEET THESE
 REQUIREMENTS FOR THE TOTAL ROOFTOP GARDEN SQUARE
 FOOTAGE.
  
 4. SATISFIED. PLEASE USE THE WATER NEEDS CATEGORY FOR
 EACH SPECIES ON THE PLANT LIST FROM THE SFWMD WATERWISE
 GUIDE TO SHOW COMPLIANCE WITH THE FLORIDA FRIENDLY
 LANDSCAPE CHART SECTION 94-446 (G).
  
 5. NOT SATISFIED. PLEASE PROVIDE A TREE DISPOSITION
 PLAN INDICATING WHETHER THE EXISTING TREES AND PALMS ON
 SITE WILL BE RELOCATED OR REMOVED.
  
 THERE ARE EIGHT EXISTING OAK TREES IN THE PARKING AREA
 OF 531 DATURA, PLEASE PROVIDE A DISPOSITION PLAN.
 THE 8 OAK TREES ARE CLEARLY MARKED ON THE SURVEY
 SUPPLIED BY THE APPLICANT. THEY ARE ALSO CLEARLY
 IDENTIFIABLE ON SITE.
  
 6. SATISFIED. STREET TREES MUST BE 14 FEET MINIMUM.
 PLEASE REVISE AND CONSIDER A DIFFERENT SPECIES IF THE
 OVERHEAD LINES ARE OF CONCERN ON DATURA.
 THE HIGH VOLTAGE TRANSMISSION LINES REQUIRE A 30 FOOT
 SETBACK FOR OAK TREES BY FPL STANDARDS. PLEASE
 RECOMMEND A DIFFERENT STREET TREE SPECIES THAT MEETS
 FPL STANDARDS ALONG DATURA.
  
 CONDITIONS OF APPROVAL
 1. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES ON
 THE PROPERTY, A TREE ALTERATION PERMIT SHALL BE
 SUBMITTED, REVIEWED AND APPROVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT, PLANNING DIVISION.
 2. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF THE
 STREET TREES AND RIGHT OF WAY LANDSCAPING AND
 IRRIGATION APPROVED WITH THIS PETITION.
 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF
 WAY LANDSCAPING AND IRRIGATION. THIS WILL BE THROUGH A
 SEPARATE MAINTENANCE AGREEMENT WITH THE CITY.
