 JUNE 9, 2016
 I HAVE REVIEWED THE ABOVE REFERENCED PETITION, AND
 PROVIDE THE FOLLOWING COMMENTS:
  
 1. SATISFIED. THE PERVIOUS AREA ONLY EXCEEDS THE
 MINIMUM REQUIRED BY 433 SQUARE FEET. THE STABILIZED
 EMERGENCY ACCESS AREA IS COUNTED AS 100% PERVIOUS.
 PLEASE PROVIDE A DETAIL OF THE STABILIZED SYSTEM AND
 DEDUCT THE AREA THAT IS NOT PERVIOUS. PLEASE BE AWARE
 THAT ANY CHANGES TO THE DESIGN IN THE FUTURE MUST
 ACCOUNT FOR ANY PERVIOUS AREA ALTERATIONS, AND ASSURE
 COMPLIANCE WITH THE MINIMUM REQUIREMENT.
  
 2. NOT SATISFIED. THE WAIVER REQUEST FOR THE DIXIE
 BUFFER SHOULD INDICATE A 10 FOOT BUFFER IS REQUIRED.
 PLEASE CORRECT THE CHART ON FSP-1.
  
 SECTION 94-443 (D) (1) REQUIRES A 10 FOOT BUFFER ALONG
 PUBLIC THOROUGHFARES FOR MULTIFAMILY USES, AND A 5 FOOT
 BUFFER IS REQUIRED FOR COMMERCIAL USES. STAFF CAN
 SUPPORT THE WAIVER REQUEST TO MODIFY THE BUFFER, AS
 LONG AS THE DESIGN INCLUDES THE NUMBER OF TREES AS
 REQUIRED. THE CODE ALLOWS LIMITED CLUSTERING OF BUFFER
 TREES TO ALLOW FOR INTEGRATION OF SIGNAGE AND FUNCTION.
  
 3. NOT SATISFIED. THE WAIVER REQUEST FOR THE SHADE TREE
 REDUCTION SHOULD INDICATE THE CORRECT NUMBER OF TREES.
 LANDSCAPE DATA CHART SHEET LP-1, WAIVER CHART ON FSP-1,
 AND JUSTIFICATION STATEMENT ARE NOT CONSISTENT WITH THE
 QUANTITY.
  
 SEE RESPONSE TO COMMENT 2.
  
 4. SATISFIED. A LANDSCAPE BUFFER OF 5 FEET IN WIDTH IS
 SHOWN ON THE PLAN ALONG THE WEST PROPERTY LINE, YET
 WAIVER REQUEST #6 STILL INDICATES A REQUEST FOR A ZERO
 BUFFER WIDTH. WAIVER MAY NO LONGER BE NEEDED. THE PALMS
 MAY BE SUBSTITUTED FOR THE REQUIRED TREES IF THE TOTAL
 NUMBER OF PALMS SUBSTITUTED FOR SHADE TREES ON SITE
 DOES NOT EXCEED 35%.
  
 5. PARTIALLY SATISFIED. THE CALCULATIONS PROVIDED FOR
 THE PARKING LOT LANDSCAPE REQUIREMENTS DO NOT REPRESENT
 AREAS PROVIDED IN THE PARKING AREAS AS REQUIRED. PLEASE
 REVISE TO SHOW HOW THE LANDSCAPE AREAS WITHIN THE
 PARKING LOT COMPLY WITH SECTION 94-443(C) 3 AND 4.
  
 SOME AREAS DO NOT QUALIFY AS BEING WITHIN THE PARKING
 AREA, AND OTHER AREAS IN LANDSCAPED MEDIANS ARE NOT
 COUNTED.
  
 6. NOT SATISFIED. PLEASE PROVIDE A LANDSCAPE PLAN FOR
 THE ROOFTOP AMENITY DECK. THIS IS MATERIAL IN
 CONSIDERING THE TRUE QUANTITY OF WAIVER REQUEST #8, AND
 FOR TREE MITIGATION.
  
 A PRELIMINARY PLAN CAN BE SUBMITTED AT THIS TIME FOR
 APPROVAL, AND AMENDED AT A LATER DATE, OR A CONDITION
 OF APPROVAL CAN BE ADDED.
  
 7. SATISFIED. WAIVER REQUEST #7 CREATES A NARROW BUFFER
 AREA AT THE SOUTHWEST CORNER OF THE PROPERTY, AND THE
 LIVE OAK PROPOSED DOES NOT FIT THE RESTRICTED SPACE
 BETWEEN THE SIDEWALK AND BUILDING. PLEASE CHANGE TO A
 MORE APPROPRIATE SPECIES.
  
 8. SATISFIED. THE GUMBO LIMBO TREES PROPOSED ALONG THE
 NORTH PROPERTY LINE WILL NOT PROVIDE BUFFERING FROM THE
 ADJACENT USE FOR A SUBSTANTIAL PART OF THE YEAR DUE TO
 LEAF DROP. PLEASE CONSIDER A MIX OF SPECIES TO PROVIDE
 MORE DIVERSITY AND YEAR ROUND BUFFERING.
  
 9. PLEASE CORRECT THE TREE DISPOSITION PLAN FOR THE
 FOLLOWING:
 ? SATISFIED. TREES TO BE RELOCATED NEED TO BE TAGGED
 WITH THEIR IDENTIFYING NUMBER, AND LOCATION SHOWN BY
 NUMBER ON THE PROPOSED LANDSCAPE PLAN
 ? NOT SATISFIED. PROVIDE THE CATEGORY AND QUANTITY FOR
 EACH TREE TO BE REPLACED 1:1 AND PROVIDE THE MITIGATION
 FOR THE TREE CANOPY REPLACEMENT AS A SEPARATE QUANTITY.
 ? NOT SATISFIED. PROVIDE AN ADDITIONAL COLUMN TO RECORD
 TREE CANOPY WIDTH 35 FEET OR MORE.
  
 10. SATISFIED. PLEASE PROVIDE A PLAN FOR THE RELOCATION
 SHOWING HOW TREES TO BE RELOCATED WILL BE STORED OR
 PLACED PERMANENTLY DURING DEMOLITION AND CONSTRUCTION.
 THIS NEEDS TO BE ADDRESSED AT A CONCEPTUAL LEVEL PRIOR
 TO APPROVAL TO ASSURE THAT IT IS POSSIBLE.
  
 11. SATISFIED. STREET TREES LOCATED IN A SIDEWALK SHALL
 HAVE STRUCTURAL SOIL EXTENDING 5 FEET IN ALL DIRECTIONS
 FROM THE TREE GRATE AND PLANTING PIT UP TO THE CURB.
 INDICATE STRUCTURAL SOIL LOCATIONS ON THE LANDSCAPE
 PLAN AND CORRECT THE TYPICAL STRUCTURAL SOIL DETAIL ON
 THE LANDSCAPE DETAIL PAGE.
  
 12. NOT SATISFIED. THE TREE GRATES WILL BE U S FOUNDRY
 9531 IF NO LIGHTING IS GOING TO BE INSTALLED. PLEASE
 VERIFY IF 9530 IS TO BE USED THAT LIGHTING WILL BE
 INSTALLED.
  
 A RESPONSE WAS NOT PROVIDED.
  
 13. SATISFIED. THERE ARE LOCATIONS OF LIGHTING ON THE
 LANDSCAPE PLAN THAT APPEAR TO CONFLICT WITH
 LANDSCAPING. PLEASE PROVIDE THE HEIGHT OF THE FIXTURES
 IN THESE AREAS.
  
 14. SATISFIED. PLEASE SHOW LOCATIONS OF ROOT BARRIERS
 TO PROTECT INFRASTRUCTURE AND TREES FROM CONFLICTS.
 THIS INCLUDES WATER, SEWER, DRAINAGE, SIDEWALKS AND
 CURBS, AND ANY FIELD STRUCTURES THAT COULD BE IMPACTED
 BY TREE ROOTS.
  
 15. SATISFIED. PLEASE SHOW LOCATIONS OF ALL GROUND
 MOUNTED EQUIPMENT INCLUDING FPL TRANSFORMERS, A/C
 UNITS, ETC., AND PROVIDE SCREENING FOR ALL GROUND
 MOUNTED EQUIPMENT AND UTILITIES. THERE ARE STILL SOME
 AREAS THAT NEED SCREENING.
  
 PLEASE UNDERSTAND THAT ADDITIONAL INFORMATION MAY BE
 REQUESTED, AND STAFF MAY HAVE ADDITIONAL COMMENTS AS
 THE REVIEW PROCESS CONTINUES.
  
  
 CONDITIONS OF APPROVAL
 1. PRIOR TO THE REMOVAL OR RELOCATION OF ANY TREES ON
 THE PROPERTY, A TREE ALTERATION PERMIT SHALL BE
 SUBMITTED, REVIEWED AND APPROVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT, PLANNING DIVISION.
 2. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE PERMITTING AND INSTALLATION OF THE
 STREET TREES, TREE GRATES, AND RIGHT OF WAY LANDSCAPING
 AND IRRIGATION APPROVED WITH THIS PETITION.
 3. THE APPLICANT, SUCCESSORS AND ASSIGNS SHALL BE
 RESPONSIBLE FOR THE MAINTENANCE OF THE ROAD RIGHT OF
 WAY LANDSCAPING, TREE GRATES AND IRRIGATION ADJACENT TO
 THE PROPERTY. THIS WILL BE THROUGH A SEPARATE
 MAINTENANCE AGREEMENT WITH THE CITY.
