2016-02-23 09:24:301. FINAL APPROVAL OF THE ENGINEERING DESIGN SHALL BE
 BASED UPON A SEPARATE SUBMITTAL TO, AND REVIEW BY, THE
 CITY?S PUBLIC WORKS DEPARTMENT ? ENGINEERING DIVISION.
  
 2. ALL GATES THAT ARE TO BE LOCKED AT ANY TIME SHALL BE
 PROVIDED WITH A KNOX PADLOCK FOR 24-HOUR EMERGENCY
 ACCESS.
  
 3. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT:
  
  A. AN APPLICATION FOR A UNITY OF TITLE SHALL BE
 SUBMITTED TO THE CITY?S PUBLIC WORKS DEPARTMENT ?
 ENGINEERING DIVISION, AND SUCH UNITY OF TITLE SHALL BE
 RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY,
 FOR ALL REAL PROPERTY CONTAINED WITHIN THE IPD. A
 CERTIFIED COPY OF THE RECORDED UNITY OF TITLE SHALL BE
 PROVIDED TO THE DEVELOPMENT SERVICES DEPARTMENT -
 PLANNING DIVISION.
  
 4. IN THE EVENT THAT THE OFF-SITE PARKING LOT SHOWN ON
 THE PROPOSED SITE PLAN IS NOT APPROVED, OR THE LEASE
 WITH FDOT IS TERMINATED, THE APPLICANT SHALL INSTALL
 PHASE II OF THE LANDSCAPE PLAN, BRINGING THE BUFFER
 INTO COMPLIANCE. ALL WORK SHALL BE COMPLETED WITHIN 180
 DAYS OF ABANDONMENT, DISCONTINUANCE, OR OTHER FORM OF
 TERMINATION OF THE OFF-SITE PARKING LOT.
  
 5. WAIVERS TO THE FOLLOWING SECTIONS OF THE CITY?S
 ZONING AND LAND DEVELOPMENT REGULATIONS (ZLDRS) SHALL
 BE LIMITED TO THOSE AREAS WITHIN THE SUBJECT PROPERTY
 THAT ARE DEEMED LEGAL NON-CONFORMITIES AS OF THE
 EFFECTIVE DATE OF THIS APPROVAL. GRANTING OF THESE
 WAIVERS SHALL NOT BE CONSTRUED SO AS TO PERMIT FURTHER
 EXPANSION, NOR INCREASE TO THE NON-CONFORMITY:
  
  A. SECTION 94-244 - TABLE VIII-4 - FRONT SETBACK
  
  B. SECTION 94-244 - TABLE VIII-4 - SIDE SETBACK
  
  C. SECTION 94-302(C)(1) - MAXIMUM WALL HEIGHT
