2016-06-14 11:55:30EXISTING BURGER KING IS CONSIDERED A NONCONFORMING
 BUILDING AND A NONCONFORMING USE (DRIVE THRU).
  
 1. ACTIVE USE, 60% IS REQUIRED ALONG PALM BEACH LAKES
 BOULEVARD, AND 65% IS REQUIRED ALONG DIXIE HIGHWAY. A
 VARIANCE FROM DAC WILL BE REQUIRED IF NOT IN
 COMPLIANCE.
 2. TRANSPARENCY, 50% IS REQUIRED ALONG PALM BEACH LAKES
 BOULEVARD AND DIXIE HIGHWAY. PROJECT DOES NOT MEET THE
 REQUIREMENT ALONG PALM BEACH LAKES BOULEVARD.
 3. SOUTH WINDOW ALONG DIXIE HIGHWAY MUST BE SHIFTED
 NORTH; CURRENT PLANS SHOW THE WINDOW ADJACENT TO THE
 FREEZER WHICH IS NOT AN ACTIVE USE. FACADE CHANGES WILL
 BE NECESSARY TO KEEP THE WINDOW CENTERED IN
 RELATIONSHIP TO OTHER ELEMENTS.
 4. PLEASE PROVIDE BIKE PARKING DETAILS.
 5. PROVIDE AUTO TURN TO CONFIRM THE MOVEMENT OF THE
 DRIVE THRU IS ADEQUATE.
 6. PRIVATE OPEN SPACE REQUIREMENT IS NOT MET. THE CITY
 WILL INITIATED A CODE AMENDMENT TO DECREASE THE AMOUNT
 REQUIRED, BUT 4.71% WILL STILL BE INSUFFICIENT.
 7. DUMPSTER SHALL REMAIN AT EXISTING LOCATION, WITH
 APPROPRIATE MODIFICATIONS TO MEET CODE. THIS ALLOWS THE
 PARKING TO BE RECONFIGURED AND SUBSEQUENTLY ALLOW
 ADDITIONAL PRIVATE OPEN SPACE.
 8. LANDSCAPE CURBS SHALL BE SHIFTED TO THE LOCATION OF
 WHEEL STOPPERS TO INCREASE LANDSCAPE AREA.
 9. PROPOSED SIGNS SHALL COMPLY WITH SECTION 94-110(D)
 OF THE ZONING CODE.
 10. PLEASE INCLUDE THE BUS STOP/BENCH ON THE SURVEY.
