| | 94-302(C), WHICH ONLY PERMITS WALLS AND FENCES TO BE 48 |
| | INCHES HIGH WITHIN THE FRONT SETBACK. THE HEIGHT IS |
| | MEASURED FROM THE EXTERIOR OF THE WALL, WHICH IN THIS |
| | EXCEEDS THE 48 INCHES IN HEIGHT. THE RESPONSE COMMENTS |
| | STATE THAT THIS WAS PREVIOUSLY APPROVED, WHICH IS |
| | INCORRECT. STAFF HAD REQUESTED INFORMATION ON THIS |

| | WITH THIS CURRENT APPLICATION. STAFF WILL CONDITION |

| | FOR THE ATHLETIC COMPLEX, EITHER THE WALL IS |
| | CONSTRUCTED AT THE CODE PERMITTED 48 INCHES IN HEIGHT |
| | WITHIN THE FRONT SETBACK, THE WALL IS MOVED OUT OF THE |
| | SETBACK, OR A MAJOR PLANNED DEVELOPMENT AMENDMENT IS |

| | WILL BE APPROVED AS PART OF THE BUILDING PERMIT |
