 PLEASE PROVIDE A WRITTEN RESPONSE TO THE FOLLOWING
 REVIEW COMMENTS:
  
 1. IT APPEARS THAT THERE ARE LIENS AGAINST THE
 PROPERTY, AS WELL AS OTHER PROPERTY OWNERS. PURSUANT TO
 SECTION 94-10 OF THE CITY?S ZONING AND LAND DEVELOPMENT
 REGULATIONS, NO APPLICATIONS WILL BE PROCESSED BY THE
 CITY UNTIL FINANCIAL DEBTS TO THE CITY ARE RESOLVED.
  
 2. NOTE THAT ALL NEW PRIVATE DEVELOPMENT, NEW
 CONSTRUCTION, RENOVATION OR REMODELING, WHERE TOTAL
 VERTICAL CONSTRUCTION COSTS OF ALL BUILDINGS ON A
 PROJECT SITE ARE EQUAL TO OR GREATER THAN $500,000.00,
 IS SUBJECT TO THE ART IN PUBLIC PLACES REQUIREMENTS
 OUTLINED IN CHAPTER 78, ARTICLE V OF THE CITY?S CODE OF
 ORDINANCES.
  
 3. PLEASE ADDRESS THE COMMENTS FROM THE PALM BEACH
 COUNTY DEPARTMENT OF ENGINEERING ? TRAFFIC DIVISION,
 IDENTIFIED IN THEIR LETTER DATED 4/2/2015.
  
 4. PURSUANT TO THE DEVELOPMENT APPLICATION, THE SURVEY
 SHALL BE AN ALTA/ACSM LAND TITLE SURVEY, SHALL INCLUDE
 ALL ITEMS LISTED IN SECTION K OF THE DEVELOPMENT
 APPLICATION, AND SHALL BE ACCOMPANIED BY A CURRENT
 OWNERSHIP AND ENCUMBRANCE (O&E) REPORT, OR A CURRENT
 TITLE POLICY.
  
 5. AN OVERALL SITE PLAN SHALL BE PROVIDED FOR THE
 ENTIRE CPD, AND THE SITE DATA TABLE AND ALL
 CALCULATIONS SHALL BE ADJUSTED TO SHOW COMPLIANCE
 ACROSS THE ENTIRE SITE, NOT JUST THE LEASE AREA.
  
 6. PLEASE REVIEW ALL CALCULATIONS IN THE SITE DATA
 TABLE, INCLUDING BUILDING AREA, PARKING, ETC. THEY
 APPEAR TO BE INCORRECT.
  
 7. OUTSTANDING UTILITY LETTERS SHALL BE PROVIDED.
  
 8. THE AREA ALONG 45TH STREET SHOULD BE MODIFIED. IT
 WAS DISCUSSED IN PREVIOUS MEETINGS THAT THE EXISTING
 PARKING WAS GOING TO BE REMOVED SO THAT ADDITIONAL
 LANDSCAPING COULD BE INSTALLED, INCLUDING UNDULATIONS
 IN THE GRADE TO ENHANCE THE BUFFER AND SCREEN PUMP AREA
 FROM THE 45TH STREET RIGHT-OF-WAY. PLEASE NOTE, IT IS
 STILL THE PREFERENCE OF STAFF THAT THE LOCATIONS OF THE
 BUILDING AND PUMP ISLANDS BE REVERSED.
  
 9. STAFF STILL HAS CONCERN WITH REGARD TO THAT AREA
 DESIGNATED FOR THE FUEL TANKS AND THE LARGE AMOUNT OF
 OPEN IMPERVIOUS SURFACE AREA.
  
 10. THERE NEEDS TO BE AN ACCESSIBLE ROUTE FROM THE
 PUBLIC RIGHT-OF-WAY TO RETAIL AND CONVENIENCE STORE.
  
 11. THE WIDTH OF THE DRIVE AISLE BETWEEN THE BUILDING
 AND PUMP ISLANDS SHOULD BE REDUCED FROM 30 FEET DOWN TO
 24 FEET.
  
 12. THE DRIVE AISLE BETWEEN THE LOADING SPACE AND THE
 DUMPSTER SHOULD BE REDUCED FROM 27.4 FEET TO 24 FEET
 AND LANDSCAPING SHOULD BE INSTALLED ALONG THE BACKSIDE
 OF THE BUILDING.
  
 13. FOUNDATION PLANTING SHOULD BE INSTALLED ACROSS THE
 FRONT (NORTH SIDE) OF THE BUILDING.
  
 14. THE ELEVATIONS INDICATE THE INSTALLATION OF A
 ?REDBOX? VENDING MACHINE AS WELL AS AN ICE MACHINE.
 THESE ITEMS SHOULD BE LOCATED WITHIN THE BUILDING.
 ADDITIONALLY, THEY IMPEDE WITH THE SIDEWALK PROPOSED IN
 FRONT OF THE BUILDING.
  
 15. THE ELEVATIONS ALSO INDICATE A PROPANE STORAGE UNIT
 IN FRONT OF THE BUILDING. THIS SHOULD BE RELOCATED AND
 SCREENED, AND SHOULD NOT ENCROACH INTO THE REQUIRE
 SIDEWALK.
  
 16. BICYCLE PARKING SHALL BE PROVIDED AND A DETAIL
 SHALL BE INCLUDED ON THE PLANS.
  
 17. A DETAIL SHALL BE PROVIDED FOR THE DUMPSTER
 ENCLOSURE.
  
 18. A PARKING DETAIL SHALL BE PROVIDED.
  
 19. ADDITIONAL ENHANCEMENTS NEED TO BE MADE TO THE
 ELEVATIONS. STAFF HAS CONCERN WITH REGARD TO THE FACT
 THAT THERE IS LITTLE ARCHITECTURAL DETAIL, NO RELIEF,
 ETC.
  
 20. THE PROPOSED DEVELOPMENT SHALL BE REVIEWED AND
 APPROVED BY THE CITY?S POLICE DEPARTMENT. PLEASE
 COORDINATE WITH OFFICER SETH BUXTON (561-822-1620 OR
 [email protected]).
  
 21. LOCATION OF THE PROPOSED FREE-STANDING SIGN
 CONFLICTS WITH EXISTING PALM TREES.
  
 22. ALL SITE LIGHTING SHALL BE FULL CUT-OFF.
  
 23. ALL CANOPY LIGHTS SHALL BE RECESSED.
  
 24. THE ELEVATIONS INDICATE WALL-MOUNTED LIGHTING THAT
 IS NOT REFLECTED IN THE PHOTOMETRIC PLANS.
  
 25. THE SITE PLAN SHALL NOTE THE LOCATION OF ALL
 FREESTANDING SIGNS, SETBACKS FROM ADJACENT PROPERTY
 LINES AND/OR RIGHTS-OF-WAY, ETC.
  
 26. AN ACCESSIBLE PARKING SPACE WILL BE REQUIRED FOR
 THE RETAIL SPACE; PLEASE CONFIRM WITH THE CITY?S
 BUILDING DIVISION.

 A) WRITTEN RESPONSES TO COMMENTS MADE BY ALL
 DEPARTMENTS SHALL BE PROVIDED UPON RESUBMISSION.
  
 B) 15 SETS OF REVISED PLANS AND/OR DOCUMENTS SHALL BE
 PROVIDED, ALONG WITH ONE (1) REDUCED COPY (11IN X
 17IN), AND AN ELECTRONIC COPY OF ALL PLANS.
  
 C) PLEASE NOTE THAT RE-SUBMITTALS MAY BE SUBJECT TO
 ADDITIONAL COMMENTS.
  
 D) IF NO RESPONSE IS RECEIVED WITHIN 60 DAYS OF THE
 ISSUANCE OF THESE COMMENTS, THE APPLICATION WILL BE
 CONSIDERED WITHDRAWN AND ANY FURTHER ACTION WILL
 REQUIRE SUBMISSION OF A NEW DEVELOPMENT APPLICATION.
  
 E) PLEASE NOTE THAT YOU WILL BE PERMITTED ONE (1)

 THE DEVELOPMENT APPLICATION. A SIGNED AND NOTARIZED
 AFFIDAVIT SHALL BE PROVIDED BY THE DEADLINE REFERENCED
