| | USED AS PART OF THE SETBACK WAIVER RECOMMENDATION BY |
| | STAFF. |

| | 2) WHILE NOT AFFECTING THE FURTHER PROCESSING OF THE |
| | APPLICATION, THE APPLICANT IS ON NOTICE THAT THE |
| | EXISTING BOATHOUSE ROOF, THE PILINGS EAST OF NEW LOT 2 |
| | AND THE WOOD PILING EAST OF THE DOCK SHALL BE REMOVED |
| | AS NONE OF THESE WERE INSTALLED IN ACCORDANCE WITH A |
| | PERMIT ISSUED BY THE CITY. THE ORIGINAL BOATHOUSE ROOF, |
| | WHILE INCLUDED ON THE ORIGINAL 1963 DOCK PERMIT, WAS |
| | REMOVED FROM THE DOCK FOR A PERIOD IN EXCESS OF 12 |
| | MONTHS AND THUS LOST ANY GRANDFATHERED STATUS. |

| | 3) ALL DEMOLITION SHALL OCCUR WITH A PERMIT WILL BE A |
| | CONDITION OF ANY CITY APPROVAL ACTION. |
