 2) PLEASE CONSIDER CHANGING THE NAME OF THE PROJECT TO
 INCLUDE "WEST PALM BEACH" IN THE TITLE.
  
 3) PLEASE DESCRIBE WHAT INNOVATIVE LAND PLANNING AND
 DEVELOPMENT TECHNIQUES ARE BEING USED TO CREATE A MORE
 DESIRABLE AND ATTRACTIVE DEVELOPMENT AS PART OF THE
 REDESIGN ON THE MALL SITE.
  
 4) THE SITE SHALL BE DESIGNED TO ENGAGE PBL AND
 CONGRESS:
  
 A. BOTH SIDES OF THE ENTRY DRIVES TO THE SITE SHALL BE
 FRAMED BY BUILDINGS. THE FUTURE BUILDING PADS SHALL BE
 LEFT IN A SODDED STATE UNTIL SUCH TIME AS THE OUTPARCEL
 BUILDING IS CONSTRUCTED.
  
 B. BUILDINGS ALONG PBL AND CONGRESS SHALL BE ORIENTED
 WITH THEIR LONG SIDE PARALLEL TO THE ROW, AND INCLUDE
 FENESTRATION, DOORWAYS, OUTDOOR SEATING, ETC. TO
 PRESENT AN INVITING EXTERIOR APPEARANCE.
  
 C. THE JUSTIFICATION STATEMENT SAYS ONLY THAT
 RESTAURANT USES IN PBA 3, 4 AND 5 WILL BE ENCOURAGED TO
 ENGAGE THE STREET. ALL BUILDINGS, REGARDLESS OF USE, IN
 ANY PBA SHALL ENGAGE THE STREET.
  
 D. THE OUTLET MALL SHALL BE ORIENTED PARALLEL WITH AND
 CLOSER TO PBL. IF NOT, THEN THERE SHALL BE ADDITIONAL
 LINER BUILDINGS CONSTRUCTED ALONG PBL, POSSIBLY HOUSING
 SMALL SERVICE OFFICE OR ADDITIONAL RETAIL, TO SCREEN
 THE LARGE PARKING AREAS.
  
 THE FOLLOWING COMMENTS RELATE SPECIFICALLY TO TEXT
 WITHIN THE DESIGN GUIDELINES:
  
 5) REMOVE THE DEFINITION OF ELECTRONIC MESSAGE BOARD
 AND THE REFERENCES TO THE ELECTRONIC MESSAGE BOARD FROM
 SIGN TYPE 4 (PAGES 1, 12 & 13). THE ZONING AND LAND
 DEVELOPMENT REGULATIONS NEED TO BE AMENDED PRIOR TO THE
 INCLUSION OF AN ELECTRONIC MESSAGE BOARD.
  
 6) OUTDOOR SEATING, COVERED OR UNCOVERED, SHALL BE
 ADDED TO THE DEFINITION OF GROSS FLOOR AREA FOR THE
 CALCULATION OF PARKING. IT WILL NOT BE COUNTED TOWARD
 THE OVERALL DEVELOPMENT SQUARE FOOTAGE, BUT WILL BE
 ADDED AS A SEPARATE LINE ITEM IN THE PARKING TABLE FOR
 THE SPECIFIC PBA (PAGE 1).
  
 7) WHY IS THE GROSS SQUARE [FLOOR] AREA DEFINITION
 REPEATED IN PART III (PAGE 2)?
  
 8) THE APPEAL PROCESS FOR A PD TO THE ZBA REQUIRES A
 DETERMINATION FROM THE CITY?S LEGAL DEPT. (PAGE 3).
  
 9) THE PLANNING DEPARTMENT SHALL BE CHANGED TO PLANNING
 DIVISION (PAGE 3).
  
 10) THE PBA DATA CHART SHALL BE UPDATED AS A MINOR PD

 ARCADES, INDUSTRIAL TYPE USES, MOTOR VEHICLE SALES AND
 SERVICE, BUILDING SUPPLY SALES AND MOTORCYCLE SALES AND
 SERVICE.
  
 B. STAFF HAS A CONCERN WITH THE MOTOR VEHICLE SALES AND
 RENTAL. STAFF IS OK WITH VEHICLE RENTAL, PROVIDED THERE
 IS NO SERVICE OR STORAGE ASSOCIATED WITH THE USE.
  
 C. STAFF DOES NOT WANT CONVENIENCE STORES, BUT IS OK
 WITH FOOD STORES, SPECIALTY (INCLUDING SALES OF
 ALCOHOLIC BEVERAGES). THIS WOULD PERMIT AN UPSCALE OR
 SPECIALIZED MARKET THAT IS LESS THAN 10,000 SQUARE
 FEET.
  
 D. WHAT TYPE OF ESTABLISHMENTS SERVING ALCOHOLIC
 BEVERAGES ARE CONTEMPLATED FOR THE SITE? THE CITY CODE
 HAS SPECIFIC SEPARATION REQUIREMENTS WHICH MAY RESTRICT
 SOME OF THE POTENTIAL USES AND THEIR LOCATIONS IF NOT
 CONTEMPLATED IN THE USE TABLE.
  
 E. THE MOTOR VEHICLE REPAIR, LIGHT USE SHALL INCLUDE A
 CONDITION THAT BAY DOORS ARE LOCATED TOWARD THE
 INTERIOR OF THE SITE OR ARE SCREENED FROM THE EXTERIOR
 OF THE SITE BY ANOTHER BUILDING. STAFF WOULD PREFER
 THAT ANY MOTOR VEHICLE REPAIR USE BE LOCATED ALONG THE
 I-95 SIDE OF THE SITE.
  
 F. NOTE: FUTURE MOTOR VEHICLE FUEL SALES IN PBA 3 WOULD
 REQUIRE A MAJOR AMENDMENT AND WOULD NOT BE ELIGIBLE AS
 AN ACCESSORY USE. IF IT IS PLANNED TO INCLUDE THIS AS
 AN ALLOWED USE NOW, THEN THE DESIGN GUIDELINES SHALL
 REFLECT THIS AND THE MOTOR VEHICLE FUEL SALES SHALL NOT
 BE LOCATED ON THE CONGRESS FRONTAGE, BUT RATHER ON THE
 WEST SIDE OF PBA 3.
  
 G. WHY ARE DAY CARE FACILITIES, CHILDREN AND PRINCIPAL
 USE, NOT INCLUDED AS PERMITTED USES?
  
 13) PLEASE CLARIFY WHY PBA #2B HAS A SETBACK OF 17 FEET
 TO I-95. THIS WOULD PUSH IT TO THE LANDSCAPE BUFFER AND
 ELIMINATE THE ABILITY TO HAVE BACK OF HOUSE TO THE
 BUILDING AND WOULD CUT OFF THE PERIMETER ROAD FOR THE
 SITE. ADDITIONALLY IT WOULD BIFURCATE THE BUILDING IN
 2A AND 2B AS THE ACCESS ROAD AROUND THE SITE WOULD HAVE
 TO PASS BETWEEN THE BUILDINGS (PAGE 4).
  
 14) STAFF IS REQUIRING BUILD-TO LINES ALONG PALM BEACH
 LAKES AND CONGRESS OF NO GREATER THAN 20 FEET AND 15
 FEET, RESPECTIVELY, SO AS TO CREATE A STREET WALL ALONG
 THE STREETS (PAGE 4) SIMILAR TO THE TARGET PROJECT (8
 FEET).
  
 15) ADD ?SUBJECT TO BUILDING SEPARATION REQUIREMENTS OF
 THE BUILDING CODE? TO THE SECTION REGARDING THE
 INTERIOR PLACEMENT OF BUILDINGS ALONG FUTURE PARCEL
 LINES. ADDITIONALLY, NO BUILDING SHALL STRADDLE A
 PARCEL LINE (PAGE 5).
  
 16) CODE CITATION FOR BUILDING HEIGHTS SHALL BE
 94-145(6)B, BUT WHY INCLUDE THIS AS THE SETBACK/HEIGHT
 REQUIREMENT CAN BE ESTABLISHED BY THE DESIGN GUIDELINES
 (PAGE 5)? ADDITIONALLY, IS THERE A PLAN TO CONSTRUCT A
 75 FOOT TALL RETAIL BUILDING?
  
 17) STAFF RECOMMENDS THE SCREENING HEIGHTS FOR PBA 2B
 AND 3 TO NOT EXCEED 10 FEET IN HEIGHT (ABOVE THE ROOF
 LINE). STAFF WOULD ALSO LIKE A MAXIMUM HEIGHT FOR THE
 OTHER ELEMENTS LISTED AND NOT A BLANKET NO HEIGHT LIMIT
 (PAGE 5).
  
 18) PLEASE CLARIFY - IF THE DEVELOPMENT REGULATIONS ARE
 TO BE TAKEN FOR THE SITE AS A WHOLE AND NOT AN
 INDIVIDUAL SUBDIVIDED PARCEL, WHY IS THE LOT AREA AT
 10,000 SQ. FT WHEN THE SITE IS 86 ACRES AND THE LOT
 WIDTH AT 75 FEET (PAGE 5)?
  
 19) THE DESIGN OF THE SITE, AS PRESENTED, IS NOTE SITE
 PLANNED AS AN URBAN DEVELOPMENT, BUT RATHER FOLLOWING A
 SUBURBAN MODEL, AS SUCH THE CODE REQUIRED MINIMUM OF
 15% LANDSCAPE IS INADEQUATE. IF THE DEVELOPMENT IS TO
 CONTINUE WITH THIS DESIGN, THEN IT SHALL HAVE AT LEAST
 AT LEAST 20% LANDSCAPE ON THE SITE AND THE
 CORRESPONDING 20% PERVIOUS AREA (PAGE 5).
  
 20) SIDEWALKS SHALL BE PROVIDED ON BOTH SIDES OF ALL OF
 THE ENTRY ROADS AND INTERIOR SPINE ROADS AND PROVIDE A
 CONTINUOUS PEDESTRIAN NETWORK THROUGHOUT THE SITE
 (DIAGRAM PAGE 6).
  
 21) EACH NEWLY CREATED PARCEL SHALL HAVE FRONTAGE ON A
 DEDICATED ROADWAY (PAGE 6).
  
 22) THE JUSTIFICATION STATEMENT MENTIONS A STRONG
 PEDESTRIAN LINK BETWEEN PBA1 AND 2A, YET THIS IS NOT
 REFLECTED IN THE DESIGN GUIDELINES. THE DESIGN
 GUIDELINES SHALL INCLUDE A CIRCULATION SECTION WHICH
 INCLUDES PROVISIONS FOR INTERNAL CIRCULATION BETWEEN
 ALL THE BUILDINGS AND CIRCULATION LEADING ONTO THE SITE
 FROM THE EXTERIOR SIDEWALK NETWORK, TO INCLUDE
 ENHANCING THE EXISTING PEDESTRIAN CROSSINGS AT CONGRESS
 AND PALM BEACH LAKES. THE SITE SHALL BE DESIGNED FOR
 COMFORTABLE PEDESTRIAN EXPERIENCE TRAVERSING THE SITE.
  
 23) NO DRIVE THROUGH RESTAURANTS SHALL BE PERMITTED IN
 PBAS 1, 2A, 2B & 3 (PAGE 6).
  
 24) RESTAURANTS IN PBA 1 SHALL ADHERE TO THE SAME
 PARKING REQUIREMENTS AS THOSE IN PBA 4 & 5 (PAGE 6).
  
 25) DRIVE THRU FACILITIES, TO INCLUDE CIRCULATION
 LANES, SHALL ONLY BE LOCATED ON THE BUILDING FRONTAGE
 NOT VISIBLE TO PALM BEACH LAKES AND CONGRESS.
  
 26) MEDICAL OFFICE WISHING TO LOCATE WITHIN THE
 DEVELOPMENT SHALL BE PARKED AT A 1 PER 200 SQ. FT.
 RATIO?
  
 27) PLEASE DESCRIBE WHAT/HOW MUCH IS MEANT BY SHORT
 TERM PARKING DEFICIENCIES DURING CONSTRUCTION. (PAGE
 6). SUFFICIENT PARKING SHALL BE MAINTAINED/CONSTRUCTED
 TO SERVE THE USES IN OPERATION.
  
 28) THE CONSTRUCTION AND DEMOLITION PHASING PLANS SHALL
 INCLUDE PARKING AND ACCESS PROVISIONS (PEDESTRIAN,
 VEHICULAR, INCLUDING PALM TRAN, AND EMERGENCY) (PAGE
 7).
  
 29) UNDEVELOPED "PAVED" AREAS MAY BE USED FOR PARKING
 PROVIDE THAT THEY CONFORM TO THE PARKING LOST DESIGN
 STANDARDS, INCLUDING STRIPING, DIMENSIONS, AND
 LANDSCAPE (PAGE 7).
  
 30) 50 BICYCLE PARKING SPACES ARE NOT SUFFICIENT TO
 SERVE THIS SITE (PAGE 7). THIS IS ONLY 18% OF THE CODE
 REQUIREMENT. BICYCLE PARKING/RACKS SHALL BE DISTRIBUTED
 AMONG ALL BUILDINGS THROUGHOUT THE SITE. ONE RACK PER
 BUILDING IS NOT APPROPRIATE IN PBAS 1, 2A AND 2B.
  
 31) WHAT ARE THE PROPOSED LOADING SPACE PARAMETERS
 PROPOSED FOR THE SITE (SIZE AND NUMBER)?
  
 32) PROVIDE A SECTION ON THE PROVISION OF PARK AND RIDE
 PARKING FOR 200 SPACES, WITH DIRECTIONAL SIGNAGE TO THE
 SPACES. THESE SPACES ARE PART OF THE REQUIRED TOTAL OF
 PARKING SPACES FOR THE SITE, NOT ADDITIONAL SPACES,
 WHICH MAY BE USED FOR PARK AND RIDE PURPOSES. AT LEAST
 A PORTION OF THE PARK AND RIDE DESIGNATED SPACES SHALL
 BE LOCATED IN CLOSE PROXIMITY TO THE PALM TRAN BUS
 TRANSFER FACILITY.
  
 33) PERIMETER LANDSCAPE IS REQUIRED TO BE SHOWN WITH
 THE FIRST FSPR FOR DEVELOPMENT (PAGE 7). THE ENTIRE
 PERIMETER LANDSCAPE SHALL BE INSTALLED WITH THE FIRST
 PHASE OF DEVELOPMENT.
  
 34) THE EXEMPTION TO THE ROW LANDSCAPE BUFFERS SHALL
 APPLY TO VEHICULAR ACCESS TO THE SITE, NOT FOR ON-SITE
 CIRCULATION, AND FOR BUILDINGS AND OUTDOOR SEATING
 (PAGE 7). THE BUFFER MAY NOT BE REDUCED FOR ON-SITE
 VEHICULAR USE OF ANY KIND.
  
 35) THE WALL ALONG THE RESIDENTIAL PROPERTY LINE MAY
 NOT SHARE THE SPACE WITH THE 10 FOOT LANDSCAPE BUFFER
 AND SHALL BE LOCATED ON THE INTERIOR SIDE OF THE
 LANDSCAPE BUFFER (PAGE 7).
  
 36) WHAT IS IN THE FPL EASEMENT ALONG I-95 AND HOW WILL
 IT AFFECT THE MATERIALS THAT ARE ALLOWED, I.E. RIGHT
 TREE RIGHT PLACE (PAGE 7)?
  
 37) PLANNED DEVELOPMENTS ARE TO CREATE MORE DESIRABLE
 AND ATTRACTIVE DEVELOPMENTS. AS SUCH THE FOUNDATION
 PLANTING SHALL BE 40% OF THE LINEAR FRONTAGE (PAGE 7).
  
 38) PBA 1 FOUNDATION PLANTING SHALL APPLY TO THE NORTH,
 EAST AND SOUTH SIDES OF THE BUILDING AND PBA 3 SHALL
 APPLY TO THE EAST AND SOUTH SIDES OF THE BUILDING

 29) WHERE IS THE PLAN TO USE PLANTERS AND POTS INSTEAD
 OF PLANTING BEDS FOR FOUNDATION PLANTING? IF USED, THEN
 ONLY THE WIDTH OF THE PLANTER OR POT MAY COUNT TO MEET
 THE FOUNDATION PLATING AND NO MORE THAN 25% OF THE
 FOUNDATION PLANTING MAY BE REPLACED WITH PLANTERS AND
 POTS. PLANTING IN POTS AND PLANTERS MAY NOT BE USED TO
 MEET THE LANDSCAPE OR PERMEABLE SURFACE REQUIREMENTS OF
 THE PD (PAGE 8).
  
 30) THE JUSTIFICATION STATEMENT MENTIONS THE RELOCATION
 OF TREES DUE TO UTILITY CONFLICTS, BUT NO METHODOLOGY
 IS DESCRIBED IN THE DESIGN GUIDELINES. STAFF HAS
 CONCERNS WITH THIS BLANKET STATEMENT AS IT DOES NOT
 ENCOURAGE THE DESIGN OF THE UTILITY SYSTEM TO RESPECT
 THE ULTIMATE REQUIRED ABOVE GROUND LANDSCAPE
 IMPROVEMENTS.
  
 31) LIGHTING SHALL BE FLUSH MOUNTED OR RECESSED (PAGE
 8).
  
 32) PLEASE PROVIDE A PATTERN BOOK TO EFFECTIVELY
 DEMONSTRATE THE ARCHITECTURAL DESIGN STANDARDS AND HOW
 THE SITE WILL DEVELOP WITH A UNIFORM IDENTITY OVER TIME
