 MEMORANDUM/LETTERS SUBMITTED BY RUDEN MCCLOSKY, DATED
 JUNE 18, 2009, FROM SUSAN P. MOTLEY, ESQ. AND KIMLEY
 HORN AND ASSOCIATES, INC. FROM CHRISTOPHER HEGGEN,
 P.E., DATED JUNE 23, 2009, INDICATE JUSTIFICATION
 STATEMENTS TO ALLOW THE REQUEST OF AN EXPANSION OF 5,
 203 SQUARE FEET TO THE EXISTING BUILDING (EXPAND THE
 VESTIBULE, ADD A LIQUOR STORE TO THE FRONT AND PROVIDE
 AN EXPANSION AT THE TRUCK DOCK) TO BE CONSIDERED A
 "MINOR AMENDMENT' NEED CLARIFICATION.
  
  ACCORDING TO THE MAJOR AMENDMENT TO THE NORTH TRAIL
 PLAZA CPD VIA ORDINANCE 3378-00, THE SAM'S CLUB STORE
 SIZE WAS 130,138 SQUARE FEET. CLARIFY THE ADDITIONAL
 SQUARE FOOTAGE THAT IS NOW SHOWN FOR THE EXISTING
 BUILDING OF 132,154 SQUARE FEET. ADDITIONALLY, SAM'S IS
 NOW REQUESTING AN ADDITIONAL 5, 203 SQUARE FEET FOR A
 TOTAL OF 137,357 SQUARE FEET, WHICH RESULTS IN OVER THE
 5% THRESHOLD INCREASE IN THE TOTAL SQUARE OF THE
 ORIGINALLY APPROVED SAM'S CLUB. PURSUANT TO THE ZONING
 AND LAND DEVELOPMENT REGULATIONS ("ZLDR") SECTION
 94-207(E)(1)(A), AN INCREASE OF ANY BUILDING BY MORE
 THAN FIVE PERCENT REQUIRES A MAJOR AMENDMENT TO THE
 APPROVED PLANNED DEVELOPMENT.
  
 RE-SUBMITTAL: SHOW BUILDING SQUARE FOOTAGE APPROVALS OF
 ORDINANCES/MINOR AMENDMENTS ON SITE PLAN (AS SHOWN ON
 GREG WILFONG'S SPREADSHEET REFLECTING THE SAME),
 INCLUDING BUT NOT LIMITED TO SHEET 6040.
  
  SECTION 94-207(E)(1)(F), NOTES THAT ANY INCREASE IN
 THE TRAFFIC IMPACT ABOVE THAT ESTABLISHED IN THE MASTER
 PLAN APPROVED BY THE CITY COMMISSION ALSO REQUIRES A
 MAJOR AMENDMENT. THE SUBMITTED TABLE I THAT IS PART OF

 THESE AREAS WILL BE SCREENED TO MEET THE ZONING CODE
 REQUIREMENTS FOR SCREENING EQUIPMENT AND LOADING AREAS.
 THE REQUIREMENTS WILL BE FOR A COMBINATION OF A
 FENCE/WALL AND LANDSCAPING. PROVIDE DETAILS
 ACCORDINGLY, INCLUDING IRRIGATION ON LANDSCAPE AND SITE
 PLANS. THE ADDITION OF THESE REQUIREMENTS SHALL ALSO
 MEET THE PROVISIONS FOR CLEARANCE REQUIREMENTS FOR THE
 COMPACTOR. THEREFORE, THIS NEEDS TO BE TAKEN INTO
 CONSIDERATION SINCE A TWO-WAY TRAFFIC ACCESS CAN NOT BE
 LESS THAN 24 FEET IN WIDTH. CONSULT WITH THE
 ENGINEERING AND FIRE DEPARTMENT ACCORDINGLY AND SHOW
 WRITTEN PROOF THAT SUCH PROPOSAL IS ADEQUATE FROM SAID

 SIGNAGE AT A SMALL SIZE THAN ACTUAL. MEASUREMENT SHALL
