 1. ALL CONSTRUCTION SHALL BE DEVELOPED IN ACCORDANCE
 WITH THE FOLLOWING PLANS: "DONNIE KIRKHAM, WEST PALM
 BEACH, FL," SHEETS P-1, CS-1, CS-2 AND PR-1, LAST
 REVISED ON MARCH 3, 2022, SIGNED AND SEALED BY
 CHRISTOPHER R. CROUSHORE, P.E., OF CROUSHORE MARINE
 ENGINEERING, INC., AND RECEIVED BY THE DEVELOPMENT
 SERVICES DEPARTMENT ??? PLANNING DIVISION ON MAY 18,
 2022. (EXHIBIT C)
  
 2. THE DOCK SHALL NOT BE USED FOR ANY COMMERCIAL
 PURPOSE, INCLUDING, BUT NOT LIMITED TO, PROVIDING
 ACCESS TO ANY COMMERCIAL ENTERPRISE, DOCKING A BOAT FOR
 A FEE, FISHING VENTURES FOR A FEE, MARINE SALVAGE
 VENTURES, TEACHING OR TRAINING OF ANY MARINE-RELATED
 ACTIVITY, AND THE SALE OF MARINE-RELATED PRODUCTS.
  
 3. ALL DOLPHINS OR FREESTANDING PILINGS SHALL HAVE A
 REFLECTORIZED BAND OF AT LEAST FIVE (5) INCHES IN WIDTH
 LOCATED APPROXIMATELY 24-INCHES FROM THE TOP OF THE
 DOLPHIN OR FREESTANDING PILING. REFLECTORIZED TABLE
 SHALL BE FORMULATED FOR MARINE USE AND BE OF AN
 IRIDESCENT SILVER COLOR.
  
 4. THROUGHOUT CONSTRUCTION OF THE DOCK, TURBIDITY
 CONTROL MEASURES SHALL BE UTILIZED.
  
 5. PRIOR TO THE ISSUANCE OF A CERTIFICATE OF COMPLETION
 FOR THE PROPOSED DOCK, ALL MOORING SLIPS SHALL BE
 PROVIDED WITH APPROPRIATE CONNECTIONS FOR POTABLE WATER
 AND ELECTRICAL SERVICE.
  
 6. THE DEVELOPMENT APPROVED HEREBY SHALL BE COMMENCED
 WITHIN THIRTY-SIX (36) MONTHS OF THE DATE OF THIS
 APPROVAL. IF DEVELOPMENT OF THE APPROVAL IS NOT
 COMMENCED WITHIN SAID THIRTY-SIX (36) MONTH PERIOD,
 THIS DEVELOPMENT ORDER INCLUDING BUILDING PERMITS SHALL
 AUTOMATICALLY EXPIRE AND NO FURTHER DEVELOPMENT ORDERS
 SHALL BE ISSUED FOR THE DEVELOPMENT. THE TERMS
 "COMMENCEMENT" AND "DEVELOPMENT" ARE DEFINED AT SECTION
 94-40 OF THE CODE OF THE CITY OF WEST PALM BEACH,
 FLORIDA.
  
 IF REQUESTED PRIOR TO THE EXPIRATION OF THE THIRTY-SIX
 (36) MONTH PERIOD DESCRIBED PREVIOUSLY, THE WEST PALM
 BEACH DEVELOPMENT SERVICES DIRECTOR, OR HIS/HER
 DESIGNEE, IS AUTHORIZED TO GRANT ONE (1) EXTENSION OF
 TIME FOR COMMENCEMENT OF DEVELOPMENT UPON A SHOWING BY
 THE APPLICANT/OWNER THAT A GOOD FAITH EFFORT HAS BEEN
 MADE TO ACQUIRE A BUILDING PERMIT AND TO COMMENCE THE
 CONSTRUCTION OF SITE IMPROVEMENTS WHICH HAVE BEEN
 PREVENTED BY REASONS BEYOND THE CONTROL OF THE
 APPLICANT/OWNER. NO EXTENSION SHALL BE GRANTED BY THE
 DEVELOPMENT SERVICES DIRECTOR, OR HIS/HER DESIGNEE,
 WHICH EXCEEDS TWENTY-FOUR (24) MONTHS FROM THE DATE OF
 THE EXPIRATION OF THE INITIAL THIRTY-SIX (36) MONTH
 COMMENCEMENT PERIOD. A DENIAL OF A REQUESTED EXTENSION
 BY THE DEVELOPMENT SERVICES DIRECTOR, OR HIS/HER
 DESIGNEE, MAY BE APPEALED BY THE APPLICANT/OWNER TO THE
 WEST PALM BEACH ZONING BOARD OF APPEALS.
