 1) BASED ON THE REBRANDING OF THE RETAIL COMPONENT OF
 THE CITYPLACE DISTRICT (THE CPD) AS ROSEMARY SQUARE, IS
 IT THE INTENT TO CHANGE THE NOMENCLATURE FOR THE
 PARCELS UNDER THE CONTROL OF CITYPLACE RETAIL, LLC, TO
 REFLECT THE ROSEMARY SQUARE AS PART OF THIS
 APPLICATION? EXAMPLE: ROSEMARY SQUARE REGULATING PLAN
 INSTEAD OF CITYPLACE CORE REGULATING PLAN. ROSEMARY
 SQUARE CORE SUBAREA, ETC.
  
 2) THE FOLLOWING TEXT IS TO BE MOVED FROM THE ROSEMARY
 RETAIL CORRIDOR SUBAREA TO THE NEW CITYPLACE (ROSEMARY
 SQUARE?) NORTH SUBAREA AS IT SPECIFICALLY PERTAINED TO
 THE PUBLIX BLOCK:
  
 FOR THE BLOCK THAT HAS FRONTAGE ON BOTH ROSEMARY AVENUE
 AND SAPODILLA AVENUE, THERE SHALL BE GROUND LEVEL
 RESIDENTIAL USES FACING SAPODILLA AVENUE AND THE
 EXISTING RESIDENTIAL USES ALONG FERN STREET.
  
 3) THE APPLICATION INCLUDES THE ADDITION OF THE USE
 "INDUSTRIAL - BAKERY" TO THE ROSEMARY RETAIL CORRIDOR.
 THE JUSTIFICATION STATEMENT PROVIDES NO SUPPORT
 INFORMATION FOR THIS REQUEST.
  
 A. THE CITYPLACE DRI DOES NOT INCLUDE INDUSTRIAL OR
 MANUFACTURING AS A USE CATEGORY, SO IT CANNOT BE ADDED
 AS A USE CATEGORY IN THE CPD TO HAVE IT BE A PERMITTED
 USE. NOTE: THE CITY'S MASTER USE LIST CALCIFIES THIS
 USE AS BAKERY PRODUCTS MANUFACTURING.
  
 B. STAFF DISCUSSED THIS ITEM WITH THE CITY ATTORNEY'S
 OFFICE. YOU MUST PROVIDE EXACTLY WHAT THE PROPOSED
 BUSINESS PLANS TO DO, INCLUDING:
  
 I. THE SQUARE FOOTAGE OF THE BAY AND ITS BREAKDOWN.
 II. WHAT SPECIFIC PRODUCT(S) ARE BEING MANUFACTURED FOR
 OFF-SITE SALES?
 III. THE MACHINERY TO BE USED (BOTH TO MANUFACTURE AND
 TO PACKAGE) THE PRODUCT.
 IV. HOW IS THE PRODUCT BEING PACKAGED?
 V. THE HOURS OF THE MANUFACTURING.
 VI. THE HOURS FOR THE DELIVERY PICK-UP FOR THE PRODUCT
 DISTRIBUTION.
  
 C. STAFF ACKNOWLEDGES THAT THE PROPOSED REGULATIONS
 INCLUDE FOUR CRITERIA FOR THE USE; HOWEVER, THESE ARE
 NOT SUFFICIENT WITHOUT THE ADDITIONAL INFORMATION
 REQUIRED FROM COMMENT 3)B. WHAT IS THE MAXIMUM SIZE OF
 THE MANUFACTURING PART OF THE BAY?
  
 4) SINCE CITYPLACE RETAIL LLC HAS ACQUIRED THE GARAGES
 AND THE CHURCH PLAZA FROM THE CRA, THESE AREAS NEED TO
 BE INCORPORATED IN THE SUBAREA REGULATIONS AS PART OF
 THIS MAJOR AMENDMENT.
  
 5) CITYPLACE NORTH SUBAREA
  
 A. THE CURRENT REGULATIONS PERMIT A FIVE STORY BUILDING
 ON THE PUBLIX SITE, INCLUSIVE OF PARKING. STAFF HAS
 REVIEWED THE PROPERTIES AND BUILDING ALLOWANCES
 SURROUNDING THE PUBLIX SITE AND DOES NOT FIND THAT A
 BUILDING IN EXCESS OF 10 STORIES IS IN CONTEXT WITH THE
 CURRENT AND POTENTIAL FUTURE DEVELOPMENT LIKELY TO
 OCCUR TO THE ADJACENT TO THE PUBLIX SITE (NORTH AND
 WEST ? QBD-8, WITH TDR ALLOWANCES TO 10 STORIES AND
 SOUTH ? FERN STREET TOWNHOUSES, EAST - 360 ROSEMARY
 STEPDOWN).
  
 B. PROVIDE A MASSING DIAGRAM FOR THE PROPOSED
 DEVELOPMENT USING THE REGULATIONS AS PROPOSED IN THE
 APPLICATION. THE MASSING DIAGRAM MUST USE THE MINIMUM
 SETBACKS AND MAXIMUM PROPOSED HEIGHT, AND INCLUDE THE
 SURROUNDING PROPERTIES.
  
 C. STAFF RECOGNIZES THE FAR BASED ON THE FORM BASED
 REGULATIONS CURRENTLY IN PLACE FOR THE CITYPLACE
 DEVELOPMENT OF REGIONAL IMPACT (DRI) FOR THE PUBLIX
 SITE AS 2.75 FAR.
  
 D. THE TERM GROUP HOME NEEDS TO BE DEFINED. IF THE
 PROPOSAL IS FOR A SPECIFIC USER GROUP, EX. ELDERLY,
 THIS NEEDS TO BE INCLUDED. IS THIS GOING TO BE
 INDEPENDENT LIVING, ASSISTED LIVING, OR A COMBINATION?
  
 6) WHILE, STAFF DOES NOT SUPPORT THE PROPOSED
 ADDITIONAL HEIGHT 5 TO 15 AND 15 TO 20 OR THE INCREASE
 TO THE FAR FROM 2.75 TO 5 AND 5 TO 6, THE INCENTIVES
 THAT HAVE BEEN PROPOSED DO NOT JUSTIFY THE REQUESTED
 INCREASES. THE PROPOSED INCENTIVES COPIED WHAT WAS
 GENERATED FOR THE CITYPLACE CENTER SUBAREA AND THEN
 REMOVED CERTAIN PROVISIONS DEALING WITH REQUIRED TREES
 AND THEIR INSTALLATION, BICYCLE AND SHOWER FACILITIES,
 TROLLEY CONTRIBUTION, AND INCLUDING AN AFFORDABILITY
 COMPONENT AS PART OF A GROUP HOME USE. THE ARGUMENT
 PRESENTED DURING THE CITYPLACE CENTER WORKFORCE RATIOS
 WAS THAT AS THE 1ST BUILDING TO PROVIDE A WORKFORCE
 INCENTIVE, THE CITYPLACE CENTER SUBAREA SHOULD HAVE A
 LOW WORKFORCE THRESHOLD TO MEET AND THAT SUBSEQUENT
 PROJECTS REQUESTING INCENTIVES SHOULD MEET A HIGHER
 WORKFORCE THRESHOLD. AS A SUBSEQUENT PROJECT, THE
 RESIDENTIAL COMPONENT OF THE CITYPLACE NORTH SUBAREA
 NEEDS TO INCLUDE AN INCREASE IN WORKFORCE UNITS SERVING
 A LOWER AMI.
  
 7) PROVIDE THE RESUBMITTAL IN STRIKE/UNDERLINE FORMAT
 FROM THE DEVELOPMENT REGULATIONS APPROVED BY RESOLUTION
 NO. 304-18.
  
 8) STAFF PROPOSED ROSEMARY SQUARE NORTH SUBAREA
