 PLEASE PROVIDE A WRITTEN RESPONSE TO THE FOLLOWING
 REVIEW COMMENTS:
  
 1. PURSUANT TO SECTION 94-342(E)(3) AND ARTICLE XVI,
 INCLUDING SECTION 94-513(A)(1), OF THE CITY?S ZONING
 AND LAND DEVELOPMENT REGULATIONS, LOTS OR PORTIONS OF
 LOTS CANNOT BE SUBDIVIDED SO AS TO CREATE A
 NONCONFORMITY, OR INCREASE AN EXISTING NONCONFORMITY.
  
 2. THE IMPROVEMENTS SHOWN WITHIN THE PARK / NORTH
 FLAGLER DRIVE RIGHT-OF-WAY SHALL BE REMOVED FROM THE
 PLANS OR NOTED ACCORDINGLY AS THEY ARE NOT A PART OF
 THIS APPLICATION.
  
 3. PURSUANT TO SECTION 94-313(1), THE SITE SHALL BE
 LIMITED TO ONE (1) ACCESS POINT.
  
 4. ALL LANDSCAPE BUFFERS SHALL BE DIMENSIONED AND SHALL
 BE A MINIMUM OF FIVE (5) FEET IN WIDTH (AREAS OF
 CONCERN ARE IN THE SOUTHEAST CORNER ALONG THE RADIUS,
 AND ALONG THE EAST PROPERTY LINE).
  
 5. PURSUANT TO SECTION 94-443(B)(2), THE LANDSCAPE
 BUFFER MAY NOT BE INTERRUPTED BY MORE THAN 25 PERCENT
 OF ITS REQUIRED LENGTH FOR VEHICULAR INGRESS/EGRESS.
  
 6. PLEASE CONFIRM THAT NO LIGHTING WILL BE PROVIDED.
  
 7. WITH THE PROPOSED LOCATION OF THE FENCE, AND
 LANDSCAPING BEING LOCATED ON THE OUTSIDE OF THE FENCE,
 ALONG THE ADJACENT RESIDENTIAL HOMES, HOW IS IT
 ANTICIPATED THAT THIS LANDSCAPE BUFFER WILL BE
 MAINTAINED? WILL THERE BE AN EASEMENT FROM THE ADJACENT
 PROPERTY OWNER?
  
 8. IT IS SUGGESTED THAT THE FENCE IN THE SOUTHWEST
 CORNER RECESS IN (PARALLEL TO THE CURB LINE) TO ALLOW
 MOST OF THE LANDSCAPING IN THIS AREA TO BE LOCATED ON
 THE OUTSIDE OF THE FENCE.
  
 9. IT IS ENCOURAGED THAT THE WHEEL STOPS ON THE
 PERIMETER PARKING SPACES BE REMOVED AND CURBING BE
 UTILIZED, ALLOWING EXPANSION OF THE PLANTING AREA.
 VEHICLES CAN OVERHANG INTO THE ADDITIONAL LANDSCAPING
 SO LONG AS THE LANDSCAPE MATERIAL IS LIMITED TO SOD OR
 GROUNDCOVER. THIS PROVIDES FOR A LARGER PLANTING AREA
 FOR PROPOSED TREES, ETC.
  
 10. CURBING SHALL BE PROVIDED IN THE NORTHWEST CORNER
 OF THE LOT, SEPARATING THE PLANTING AREA FROM THE
 VEHICULAR CIRCULATION.
  
 11. SETBACKS SHALL BE PROVIDED FOR THE GUARD HOUSE AND
 SHALL CONFORM TO THE REQUIREMENTS OF THE ZLDRS.
  
 12. PLEASE PROVIDE ELEVATIONS OF THE PROPOSED GUARD
 HOUSE. THE STYLE SHALL BE COMPATIBLE WITH THE
 SURROUNDING ARCHITECTURE.
  
 13. ALL EXISTING CURB CUTS THAT WILL NO LONGER BE
 UTILIZED SHALL BE REMOVED AND REPLACED WITH APPROPRIATE
 CURBING.
  
 14. STRIPING DETAIL SHALL BE PROVIDED.
  
 15. A PEDESTRIAN CONNECTION SHALL BE PROVIDED TO THE
 40TH STREET / NORTH FLAGLER DRIVE INTERSECTION.
 PEDESTRIANS SHALL NOT BE REQUIRED TO CROSS THE STREET
 MID-BLOCK, NOR WALK ACROSS THE GRASS.
  
 16. THE CORPORATION LISTED AS THE OWNER OF 435 40TH
 STREET DIFFERS BETWEEN THE PROPERTY APPRAISER?S
 WEBSITE, THE DEED, AND THE AFFIDAVIT PROVIDED FOR
 WAIVER OF THE REQUIRED WALL.

 D) IF NO RESPONSE IS RECEIVED WITHIN 60 DAYS OF THE
 ISSUANCE OF THESE COMMENTS, THE APPLICATION WILL BE
 CONSIDERED WITHDRAWN AND ANY FURTHER ACTION WILL
 REQUIRE SUBMISSION OF A NEW DEVELOPMENT APPLICATION.
  
 E) PLEASE NOTE THAT YOU WILL BE PERMITTED ONE (1)
 RESUBMITTAL AT NO ADDITIONAL COST. IF PREVIOUSLY-ISSUED
