 THE FOLLOWING COMMENTS MUST BE ADDRESSED PRIOR TO SITE
 PLAN APPROVAL.
  
 1. BASED ON THE SUBMITTED JUSTIFICATION STATEMENT, THIS
 REQUEST INCLUDES REMOVAL OF A CITY OWNED COMPACTORS,
 WHICH CURRENTLY SERVE SEVERAL AREA BUSINESSES. PLEASE
 PROVIDE A PROPOSED NEW LOCATION FOR THE COMPACTORS.
 (THE CURRENT PICK UP SCHEDULE FOR THE COMPACTORS IS 7
 DAYS A WEEK.)
  
 2. PLEASE PROVIDE AN ALTA/ACSM SURVEY WHICH HAS BEEN
 SIGNED/SEALED BY PROFESSIONAL SURVEY & MAPPER (PSM).
  
 3. WE DEFER TO OUR LEGAL DEPARTMENT FOR DETERMINATION
 OF THE MOST APPROPRIATE PROCEDURE FOR AUTHORIZING THE
 EXISTING AND PROPOSED IMPROVEMENTS WITHIN THE
 PEDESTRIAN ALLEY (RIGHT-OF-WAY PERMIT WITH A LONG TERM
 MAINTENANCE AGREEMENT, LEASE OR REVOCABLE PERMIT).
  
 4. THE JUSTIFICATION STATEMENT INDICATES THAT THE ALLEY
 WILL BE OPEN TO PEDESTRIAN USE. PLEASE SUBMIT DRAWINGS
 SHOWING THE PEDESTRIAN PATHWAY, INDICATING THAT THE
 PROPOSAL WILL MEET ADA REQUIREMENTS, HAVE A MINIMUM
 44-INCH WIDE ACCESSIBLE PATH, AND BE OPEN TO FREE FLOW
 OF PEDESTRIAN ACCESS.
  
 5. USE OF THE SIDEWALK ALONG NARCISSUS FOR COMMERCIAL
 SEATING REQUIRES AN APPROVED SIDEWALK CAF? PERMIT FROM
 THE CITY. APPLICATION 14080560 WAS NOT APPROVED BASED
 ON THE BUSINESS NOT DEMONSTRATING THAT THEY ARE A
 RESTAURANT (WHERE FOOD AND BEVERAGES ARE PREPARED,
 SERVED, SOLD AND DELIVERED FOR CONSUMPTION). ADDITIONAL
 REQUIREMENTS OF THE SIDEWALK CAF? PERMITS MAY BE FOUND
 IN CODE OF ORDINANCES SECTIONS 78-341 AND 78-345(A).
  
 6. THE PREVIOUSLY APPROVED PLANS FOR THE BUILDING SHOW
 THE ADA ACCESSIBLE ROUTE AND EMERGENCY EXITS ARE OFF OF
 THE ALLEY. PLEASE DEMONSTRATE THAT THE PROPOSED
 PLANTERS WILL NOT INTERFERE WITH THE EVACUATION ROUTE.

 PETER LEDUC, FIRE MARSHAL, WITH THE FOLLOWING COMMENTS:
  
 1) THE REAR EXIT DOOR TO THE MAIN OCCUPIED STRUCTURE
 OPENS UP INTO THE PROPOSED SIDEWALK AREA. SEATING,
 TABLES AND PLANTERS IN THAT AREA WILL RESTRICT THE EXIT
 ACCESS TO A PUBLIC WAY. AN OPENING AT THE OUTSIDE
 PLANTER AREA OPPOSITE THE DOOR SHALL BE MADE EQUAL TO
 THE DOOR WIDTH, 36". NO TABLES CAN BE PLACED INBETWEEN
 THIS AREA. THIS WILL ALLOW THOSE EXITING THE DOOR,
 STRAIGHT FREE EXIT ACCESS, TO A PUBLIC WAY BEYOND THE
 PLANTER AREA INTO THE PARKING LOT.
  
 2) A TABLE AND SEATING PLAN SHALL BE PROVIDED TO ENSURE
 THAT EXIT PATH SPACE FOR THOSE SITTING AT THE TABLES IS
 ADAQUATE FROM ONE END TO THE OTHER.

 2. PROVIDE 7 SETS OF REVISED PLANS AND/OR DOCUMENTS.
 3. THERE APPEAR TO BE INCONSISTENCIES BETWEEN THE
 JUSTIFICATION STATEMENT AND THE DIAGRAM INCLUDED IN THE
 APPLICATION. IN THE JUSTIFICATION STATEMENT THE
 APPLICANT IS REQUESTING THAT "THE 2 COMPACTOR DUMPSTERS
 TO THE EAST OF THE RAISED ALLEY BE REMOVED TO
 FACILITATE THE EXTENSION OF THE PAVERS TO THE EAST AND
 TIE THE PEDESTRIAN WALKWAY INTO SLOAN'S ALLEY".
 HOWEVER, THE DIAGRAM INCLUDED IN THE APPLICATION SHOWS
 THAT ALL OF THE BENCHES AND PLANTERS PROPOSED ALONG THE
 ALLEY WOULD BE TO THE WEST OF THE EXISTING LOCATION OF
 THE COMPACTOR DUMPSTERS. IN ADDITION, THE DIAGRAM SHOWS
 A WALL/FENCE SEPARATING THE PLANTERS FROM THE DUMPSTERS
 WHICH WOULD NOT ALLOW FOR PEDESTRIANS TO ACCESS SLOAN?S
 ALLEY. THE DISCREPANCY BETWEEN WHAT IS PROPOSED IN THE
 JUSTIFICATION STATEMENT AND WHAT IS SHOWN IN THE SITE
 PLAN DIAGRAM NEEDS TO BE ADDRESSED.
 4. THE SITE PLAN DIAGRAM IDENTIFIES A 'LATTUCE FENCE"
 TO BE PLACED ON THE NORTH SIDE OF THE PEDESTRIAN ALLEY.
 PLEASE INDICATE THE HEIGHT OF THIS FENCE AS CITY
 REGULATIONS PROHIBIT FENCES HIGHER THAN 6 FEET ON THE
 SIDE OF A PROPERTY.
 5. THE SITE PLAN DIAGRAM SHOWS BENCHES, PLANTERS AND
 CHAIRS LOCATED TO THE WEST OF THE SITE AND ALONG
 NARCISSUS AVENUE. PLEASE NOTE THAT THE INSTALLATION OF
 THESE ELEMENTS ALONG NARCISSUS REQUIRES THE ISSUANCE OF
 A SIDEWALK CAFE PERMIT BY THE CITY.
 6. THE SITE PLAN DIAGRAM SHOWS PLANTERS TO THE SOUTH
 OF THE SITE ON A LOCATION WHICH APPEARS TO BE OUTSIDE
 OF THE SUBJECT PROPERTY AND ON PRIVATE PROPERTY.
 INSTALLATION OF THESE PLANTERS AT THAT LOCATION WOULD
 REQUIRE, AMONG OTHER THINGS, AUTHORIZATION FROM THE
 RESPECTIVE PROPERTY OWNER. ALSO NOTE THAT THIS SITE IS
 AN ACTIVE PARKING LOT AND IT WOULD APPEAR THAT THESE
 PLANTERS MAY INTERFERE WITH THE OPERATION OF THE
 PARKING LOT.
 7. WHILE THE SITE GOT APPROVAL FROM THE ART IN PUBLIC
 PLACES (APP) COMMITTEE FOR AN EXISTING MURAL ON THE
 SOUTH SIDE OF THE PROPERTY, THERE ARE TWO EXISTING
 PHOTOGRAPHS INSTALLED ON THE SOUTH SIDE AND THREE
 PHOTOGRAPHS ON THE NORTH SIDE WHICH WOULD APPEAR TO
 REQUIRE APP APPROVAL. PLEASE CONTACT SYBILLE WELTER,
