 A. IF THE TREE IS TRANSPLANTED, IT SHALL BE MOVED BY
 THE PROPERTY OWNER IN ACCORDANCE WITH THE NATIONAL
 ARBORIST ASSOCIATION STANDARDS TO ANOTHER LOCATION
 WITHIN THE CITY AND MAINTAINED BY THE NEW PROPERTY
 OWNER.
  
 B. IF A TREE ON PUBLIC PROPERTY IS WILLFULLY DESTROYED
 BY ANYONE EXCEPT THE CITY FORESTER/ARBORIST, THE TREE
 MUST BE SUBSTITUTED WITH AN EQUIVALENT REPLACEMENT THAT
 IS APPROVED BY THE FORESTER/ARBORIST OR DESIGNER ON THE
 SITE FROM WHICH THE DESTROYED TREE WAS REMOVED.
 AFTER APPROVAL OF THE MINOR AMENDMENT THAT ALL DATA IS
 IN ADHERENCE WITH THE ZLDR, THEN A TREE ALTERATION
 PERMIT WILL BE REQUIRED TO BE SUBMITTED TO THE PLANNING
 AND ZONING DEPARTMENT (NOTE: THE PLANS SUBMITTED FOR
 THE ALTERATION PERMIT NEED TO REFLECT THE SAME
 INFORMATION THAT IS BEING ASKED FOR THE MINOR

 8. PURSUANT TO SECTION 94-448 (E) (1), CHARACTERISTICS.
 REPLACEMENT TREES SHALL HAVE SHADE AND SCREENING
 POTENTIAL EQUAL TO OR SUPERIOR TO THAT OF THE TREES
 THEY REPLACE AT THE TIME OF THE INITIAL INSTALLATION.
  
 9. PURSUANT TO SECTION 94-448 (E) (2) MINIMUM
 STANDARDS. ALL REPLACEMENT TREES SHALL BE EQUAL TO OR
 BETTER THAN FLORIDA DEPARTMENT OF AGRICULTURE NUMBER 1
 NURSERY GRADE STANDARD. ALL TREES REPLACED OR RELOCATED
 PURSUANT TO THIS SECTION MUST BE IN A HEALTHY, LIVING
 CONDITION ONE YEAR FROM THE DATE OF PLANTING.
 REPLACEMENTS THAT ARE NOT ESTABLISHED, HAVE FAILED TO A
 DEGREE THAT SURVIVAL IS NOT PROBABLE, OR HAVE DIED MUST
 BE REPLACED WITH HEALTHY SPECIMENS. SUCH REPLACEMENTS
 MUST CONTINUE UNTIL A TREE IS ESTABLISHED AT THE
 APPROVED LOCATION.
  
 10. PROVIDE THE TREE SIZE, HEIGHT INCLUDING THE TREE
 CALIPER, OVERALL HEIGHT AT INSTALLATION, ETC. ON THE
 SITE DATA INFORMATION OF WHAT THE PROPOSED TREES WILL

 ON THE LANDSCAPE PLANS, PURSUANT TO THE LANDSCAPE PLAN
 CHECKLIST ON PAGE 16 OF THE APPLICATION. FOR INSTANCE,
 TABULAR INFORMATION SHOWING EXISTING AND PROPOSED TREE
 COUNT, CLEARLY SHOWING TABULATION NECESSARY FOR THE
 EVALUATION OF COMPLIANCE WITH ARTICLE XIV (CLEARLY
 INDICATE THE AMOUNT OF PLANT MATERIAL THAT WILL BE
 RELOCATED, ETC.)

 REMOVE REFERENCE ON LANDSCAPE NOTES: FIFTH SENTENCE IS
 REFERENCING PALM BEACH GARDEN?S LAND DEVELOPMENT
 REGULATIONS. REVISE TO CITY OF WEST PALM BEACH?S ZONING
 AND LAND DEVELOPMENT REGULATION.
  
 GENERAL NOTE: THE EXAMPLES ON ITEMS (E) AND (F) ARE NOT
 INCLUSIVE. REMOVE ANY NOTATION REFERENCE, WHICH IS NOT
 APPLICABLE TO THIS PROJECT.
  IMPORTANT: ALL SITE PLANS AND LANDSCAPE PLANS SHALL
 ALSO BE SUBMITTED IN .PNG GRAPHIC FORMAT. ADDITIONALLY,

 6. SHOW ALL SITE DATA ON LANDSCAPE/SITE PLAN; THIS
 INCLUDES WHAT IS REQUIRED AND WHAT IS PROVIDED.
 PERCENTAGES NEED TO INCLUDE THE LANDSCAPE INFORMATION
 BELOW:
  
 PURSUANT TO SECTION 94-442 (C) OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS ("ZLDR"), PALM TREES MAY BE
 SUBSTITUTED FOR NOT MORE THAN 35 PERCENT OF THE SHADE
 OR FLOWERING TREES REQUIRED BY THIS ARTICLE, EXCEPT AS
 SPECIFIED IN THE COMPREHENSIVE PLAN. HOWEVER, WHEN PALM
 TREES ARE SUBSTITUTED FOR SHADE TREES, TWO PALM TREES
 SHALL BE PROVIDED FOR EACH REQUIRED SHADE TREE. THIS
 2:1 SUBSTITUTION SHALL NOT BE REQUIRED FOR ROYAL PALM
 TREES AND SUCKERING PALM TREES SUCH AS THE ARECA PALM,
 PAUROTIS PALM AND THE SENEGAL DATE PALM. WORK ALL THE
 PERCENTAGE NUMBERS BASED ON THE REQUIRED TREE/SHRUB
 COUNT BELOW:

 WOULD BE 61.6 OR 62 SHADE TREES CAN BE SUBSTITUTED WITH
 THE ROYAL PALM TREES), SEE SECTION 94-442 ABOVE.
  
 176 SHADE TREES X 35% = 62 SUBSTITUTE FOR PALMS (THE 62
 SHADE TREES (OAKS) IT IS MY UNDERSTANDING WITH MEETING
 WITH SEAN O?REILLY THAT THE LIVE OAKS (SHAD TREES) WILL
 BE RELOCATED THROUGHOUT THE 25? CONSERVATION AREA,
 WITHIN THE COMMON AREAS, ENTRYWAY, CUL-DE-SAC, AND
 ROUNDABOUTS WITHIN THE WOODLAND SUBDIVISION.
  
 176-62 =114 SHADE TREES TO REMAIN IN PLACE.
  
 *** FLOWERING TREES, THE CALCULATION IS MADE THE SAME
 WAY:
  
 FLOWERING TREE/6,400 SQ.FT. OPEN SPACE = 44 FLOWERING
 TREES
  
 44 FLOWERING TREES X 35% = 15 SUBSTITUTE FOR PALMS (THE
 15 FLOWERING TREES WILL BE RELOCATED OR INSTALLED
 WITHIN THE SAME AREAS AS REFERENCED ABOVE FOR THE SHADE
 TREES).
  
 44-15=29 FLOWERING TREES TO REMAIN IN PLACE.
  
 THE PROPOSAL EXCEEDS THE TOTAL 35% OF TREES THAT CAN BE
 MITIGATED (RELOCATED).
 NOTE, STAFF WILL REQUEST A SITE VISIT WITH SEAN
 O?REILLY TO TAG WHAT TREES WILL HAVE TO BE COMPLETELY
 REPLACED DUE TO THEIR EXISTING POOR SHAPE OR NOT
 MEETING THE FLORIDA #1 GRADE STANDARDS. SOME TREES ARE
 OF POOR QUALITY, DOUBLE/TRIPLE BRANCHING, SPLIT OR
 DEAD. MR. O?REILLY CAN ALSO TAG THE TREES THAT ARE
 DEEMED NOT TO BE ADEQUATE AND PROVIDE THE INFORMATION
 TALLY TO THE COTLEUR-HEARING LANDSCAPE COMPANY TO ADD
 TO THEIR TABULAR DATA AS REPLACEMENT VS. RELOCATED
 TREES ACCORDINGLY.
 NOTE: PURSUANT TO SECTION 94-445 (4) (B) OF THE ZLDR,
 PALM SPECIES PLANTED SHALL BE REASONABLY RESISTANT TO
 LETHAL YELLOWING DISEASE. WHENEVER THE CLUSTERING OF
 PALM TREES IS UTILIZED, A MINIMUM OF THREE PALM TREES
 PER CLUSTER SHALL BE REQUIRED. PALM TREES THAT ARE
 EXEMPT FROM THE SUBSTITUTION REQUIREMENT PURSUANT TO
 SECTION SUBSECTION 94-442 (C) ARE ALSO EXEMPT FROM THE
 CLUSTERING REQUIREMENT.
  
 7. PURSUANT TO SECTION 94-448 (D) (4) OF THE ZLDR, THE
 APPLICANT FOR A TREE REMOVAL PERMIT SHALL BE REQUIRED
 TO RELOCATE OR REPLACE TREES TO BE REMOVED TO ALLOW
 PROPERTY USE, DEVELOPMENT, OR REDEVELOPMENT. RELOCATED
 TREES SHALL BE INSTALLED IN A SOUND AND SKILLED MANNER
 ACCORDING TO ACCEPTED PLANTING PRACTICES AND SHALL BE
 IN ACCORDANCE WITH THE FOLLOWING:
  
 A. IF THE TREE IS TRANSPLANTED, IT SHALL BE MOVED BY
 THE PROPERTY OWNER IN ACCORDANCE WITH THE NATIONAL
 ARBORIST ASSOCIATION STANDARDS TO ANOTHER LOCATION
 WITHIN THE CITY AND MAINTAINED BY THE NEW PROPERTY
 OWNER.
  
 B. IF A TREE ON PUBLIC PROPERTY IS WILLFULLY DESTROYED
 BY ANYONE EXCEPT THE CITY FORESTER/ARBORIST, THE TREE
 MUST BE SUBSTITUTED WITH AN EQUIVALENT REPLACEMENT THAT
 IS APPROVED BY THE FORESTER/ARBORIST OR DESIGNER ON THE
 SITE FROM WHICH THE DESTROYED TREE WAS REMOVED.
 AFTER APPROVAL OF THE MINOR AMENDMENT THAT ALL DATA IS
 IN ADHERENCE WITH THE ZLDR, THEN A TREE ALTERATION
 PERMIT WILL BE REQUIRED TO BE SUBMITTED TO THE PLANNING
 AND ZONING DEPARTMENT (NOTE: THE PLANS SUBMITTED FOR
 THE ALTERATION PERMIT NEED TO REFLECT THE SAME
 INFORMATION THAT IS BEING ASKED FOR THE MINOR
 AMENDMENT.
  
 8. PURSUANT TO SECTION 94-448 (E) (1), CHARACTERISTICS.
 REPLACEMENT TREES SHALL HAVE SHADE AND SCREENING
 POTENTIAL EQUAL TO OR SUPERIOR TO THAT OF THE TREES
 THEY REPLACE AT THE TIME OF THE INITIAL INSTALLATION.
  
 9. PURSUANT TO SECTION 94-448 (E) (2) MINIMUM
 STANDARDS. ALL REPLACEMENT TREES SHALL BE EQUAL TO OR
 BETTER THAN FLORIDA DEPARTMENT OF AGRICULTURE NUMBER 1
 NURSERY GRADE STANDARD. ALL TREES REPLACED OR RELOCATED
 PURSUANT TO THIS SECTION MUST BE IN A HEALTHY, LIVING
 CONDITION ONE YEAR FROM THE DATE OF PLANTING.
 REPLACEMENTS THAT ARE NOT ESTABLISHED, HAVE FAILED TO A
 DEGREE THAT SURVIVAL IS NOT PROBABLE, OR HAVE DIED MUST
 BE REPLACED WITH HEALTHY SPECIMENS. SUCH REPLACEMENTS
 MUST CONTINUE UNTIL A TREE IS ESTABLISHED AT THE
 APPROVED LOCATION.
  
 10. PROVIDE THE TREE SIZE, HEIGHT INCLUDING THE TREE
 CALIPER, OVERALL HEIGHT AT INSTALLATION, ETC. ON THE
 SITE DATA INFORMATION OF WHAT THE PROPOSED TREES WILL
 BE ON THE LANDSCAPE PLANS.
  
 11. PURSUANT TO SECTION 94-445(G)(II)ADD IRRIGATION
 NOTES ON LANDSCAPE PLAN/DETAILS FOR 120% COVERAGE.
  
 12. FOR THE PROPOSED AND RELOCATED LIVE OAKS/SHADE
 TREES WITHIN THE CONSERVATION EASEMENT (BEHIND EXISTING
 HOMES OR PARCELS, ENTRYWAY, ETC.), STAFF SUGGESTS
 PROVIDING A ROOT BARRIER TO AVOID CONFLICTS WITH
 FENCES, ETC. IN THE FUTURE. PLEASE INDICATE WHAT
 MEASURES ARE BEING TAKEN TO AVOID A FUTURE CONFLICT
 WITH THE ROOTS.
