| | 2. IT IS MY UNDERSTANDING FROM CONVERSATIONS WITH THE |
| | DESIGN TEAM THAT MINOR CHANGES ARE PROPOSED TO THE SITE |
| | PLAN, ETC. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT, |
| | THE MINOR AMENDMENT SHALL BE SUBMITTED TO AND APPROVED |
| | BY THE PLANNING DIVISION. ALL CHANGES WILL BE REVIEWED |
| | AS PART OF THAT PROCESS. UPON APPROVAL OF THE |
| | AMENDMENT, ALL BUILDING PERMIT PLANS WILL NEED TO BE |
| | UPDATED TO PROVIDE CONSISTENCY. |

| | 3. PURSUANT TO RESOLUTION NO. 177-21, PRIOR TO THE |
| | ISSUANCE OF A PERMIT, A 20-FOOT DRAINAGE EASEMENT SHALL |
| | BE GRANTED TO THE PRESIDENTIAL WAY ASSOCIATION ALONG |
| | THE SOUTH PROPERTY LINE. UPON GRANTING OF THE EASEMENT, |
| | THE CITY WILL FILE A DISCLAIMER ABANDONING THE CITY?S |
| | INTEREST IN THE EXISTING DRAINAGE EASEMENT. PLEASE |
| | PROVIDE DOCUMENTATION THAT THE EASEMENT HAS BEEN |
| | GRANTED TO THE POA, AND THAT THE DISCLAIMER HAS BEEN |
| | FILED/RECORDED BY THE CITY. |

| | 4. JUST A REMINDER THAT ALL DEVELOPMENT WITHIN THE |
| | BANYAN CAY RESIDENTIAL/COMMERCIAL PLANNED DEVELOPMENT |
| | (RPD/CPD) SHALL BE SUBJECT TO ALL DEVELOPMENT ORDER |
