 1) SECTION 6(2)(E)(II) OF RESOLUTION NO. 185-18 -
 CONDITIONS OF APPROVAL REQUIRES A REPLAT PRIOR TO THE
 ISSUANCE OF THE FIRST CERTIFICATE OF OCCUPANCY.
  
 2) PENDING LOMR. THE ELEVATION OF THE LOWEST FINISHED
 FLOOR OF THE PROPOSED RESIDENTIAL STRUCTURE DOES NOT
 MEET THE REQUIRED BFE AND 2" FREE-BOARD REQUIREMENTS OF
 THE CITY OF WEST PALM BEACH'S FLOOD ORDINANCE FOR NEW
 STRUCTURES. NOT COMPLIED. PORTIONS OF THE BUILDING ARE
 LOCATED IN A SPECIAL FLOOD HAZARD AREA. THE ELEVATIONS
 FOR THE PROJECT ARE IN NGVD 88. AS OF OCTOBER 5TH, 2017
 THE CITY OF WEST PALM BEACH HAS ADOPTED NEW FLOOD
 INSURANCE RATE MAPS WHICH USE NAVD 88 AS THE VERTICAL
 DATUM. THE CITY ALSO ADOPTED A 2' FREEBOARD WHICH
 REQUIRES THE FINISH FLOOR AND EQUIPMENT TO BE A MINIMUM
 OF TWO FEET ABOVE THE BFE. IN ORDER TO AVOID ANY
 CONFUSION PLEASE REVISE THE PLANS TO SHOW ONLY THE
 CURRENT FLOOD ELEVATION DATA (NAVD 88). ELEVATION
 CERTIFICATES WILL BE REQUIRED TO SHOW COMPLIANCE WITH
 THE CITY'S FLOOD POLICY. THE CITY REQUIRES THREE
 ELEVATION CERTIFICATES. FIRST, A PRECONSTRUCTION ELEV.
 CERT. BASED ON THE CONSTRUCTION DRAWING. SECOND, A
 CONSTRUCTION ELEV. CERT. BASED ON THE LOWEST FLOOR
 FORMS. THIRD A FINAL ELEV. CERT. BASED ON THE FINISHED
 BUILDING. THE CITY'S FLOOD ORDINANCE ARTICLE XVII -
 FLOOD PREVENTION AND CONTROL SEC. 94-546 - PROVISIONS
 FOR FLOOD HAZARD REDUCTION.
  
 3) PENDING. NOT COMPLIED. PROVIDE A COPY OF THE PERMIT
 ISSUED BY THE ARMY CORPS OF ENGINEERS/EPA TO FILL IN
 THE 9,610 SQFT OF SUBMERGED LAND SHOWN ON THE SITE
 PLAN. FBC 107.2.1
  
 4) COMPLIED. APPROVED BY THE BUILDING OFFICIAL. THE
 PROPOSED "DECLARATION" INDICATED IN THE "TEMPORARY
 CONSTRUCTION ACCESS EASEMENT AGREEMENT" DOES NOT
 ADEQUATELY RESOLVE THE ISSUE OF MAXIMUM ALLOWABLE AREA
 OF OPENINGS BASED ON FIRE SEPARATION DISTANCE AND
 DEGREE OF OPENING PROTECTION REQUIRED BY FBC TABLE
 705.8. SINCE THE ADJACENT PROPERTY IS NOT UNDER THE
 CONTROL OF THE BUILDING OWNER, A RESTRICTIVE COVENT OR
 SOME OTHER LEGAL DOCUMENT THAT WILL PREVENT THE
 ADJACENT LANDOWNER FROM AMENDING THE EASEMENT SO THAT
 THE REQUIRED CLEARANCES ARE MAINTAINED FOR THE LIFE OF
 THE BUILDING. NOT COMPLIED. THE PROPERTY TO THE SOUTH
 WHERE THE PROPOSED PERMANENT ROADWAY WILL IS NOT UNDER
 THE CONTROL OF THIS LANDOWNER. SOME TYPE OF
 DOCUMENTATION OF AN EASEMENT OR DEED RESTRICTION
 STATING THAT THERE WILL BE A ROADWAY AT THIS LOCATION
 IN PERPETUITY WILL NEED TO BE SUBMITTED FOR REVIEW. THE
 SOUTH WALL OF THE BUILDING (RESIDENTIAL TOWER AND
 PARKING GARAGE) APPEARS TO BE 10 TO 15 FEET FROM THE
 PROPERTY LINE AND BASED ON FBC TABLE 705.8 IS LIMITED
 TO AN ALLOWABLE AREA 45% OF THE EXTERIOR WALL AREA PER
