 2014 EXISTING BUILDING CODE LEVEL II 701.3 COMPLIANCE.
 ALL NEW CONSTRUCTION ELEMENTS, COMPONENTS, SYSTEMS, AND
 SPACES SHALL COMPLY WITH THE REQUIREMENTS OF THE
 FLORIDA BUILDING CODE, BUILDING.

 ACTION: DENIED
  
 1) DEMOLITION SHEET D1 ROOMS 114 AND 115 ON THE
 ORIGINAL DEMOLITION SHEET WERE NOT SHOWN AS EXISITING
 RESTROOMS. THE NEW DEMOLITION SHEET SHOWS THESE UNITS
 AS EXISTING RESTROOMS. PLEASE REFERENCE PERMIT #
 04011145 REV. # 3 ON SHEET 2.1 AND 3.1 THAT THE
 RESTROOM AND BATHROOM WERE QUESTIONABLE AS COMPLIANT
 ACCESSIBLE UNITS UNDER THE CODE AT THAT TIME. WE ARE
 NOT REQUIRING A REVISION> UNDER THE 2014 FBC-ACCESS.
 CODE 202.4 ALTERATIONS AFFECTING PRIMARY FUNCTION
 AREAS.
 EXCEPTIONS:
 2. IF A PRIVATE ENTITY HAS CONSTRUCTED OR ALTERED
 REQUIRED ELEMENTS OF A PATH OF TRAVEL AT A PLACE OF
 PUBLIC ACCOMMODATION OR COMMERCIAL FACILITY IN
 ACCORDANCE WITH THE SPECIFICATIONS IN THE 1994 OR 1997
 FLORIDA ACCESSIBILITY CODE, THE PRIVATE ENTITY IS NOT
 REQUIRED TO RETROFIT SUCH ELEMENTS TO REFLECT
 INCREMENTAL CHANGES IN THE PROPOSED STANDARDS SOLELY
 BECAUSE OF AN ALTERATION TO A PRIMARY FUNCTION AREA
 SERVED BY THAT PATH OF TRAVEL.
  
 UNDER THE 1994 & 1997 ACCESS. CODE THE 60 INCHES CLEAR
 FROM THE SIDE WALL TO THE LAV, (SIDE CLEARANCE AT WATER
 CLOSET) WAS NOT A REQUIREMENT. UNDER THE 2001
 FBC-ACCESSIBILITY AND NEWER CODES IT HAS BEEN A
 REQUIREMENT. THERE ARE TO MANY VARIABLES OR UNKNOWNS
 THAT MAY HAVE COME INTO PLAY DEPENDING ON THE BUILDING
 OFFICIALS INTERPRETATION OF THE CODE. FOR EXAMPLE IF
 THE B. O. WENT WITH THESE ARE NOT REQUIRED FIXTURES BUT
 CONSIDERED PRIVATE RESTROOM AND OR BATHROOM THEY WOULD
 HAVE MET THE INTENT OF THE CODE. TODAYS CODE IS MORE
 RESTRICTIVE IN THE INTERPRETATION OF PRIVATE RESTROOMS
 AND BATHROOMS. THE TENANT MAY BE SUBJECT TO FEDERAL
 LAWSUITE UNDER THE 1990 ADA & FEDERAL BARRIER REMOVAL
 ACT.
  
 2) SHEET 3.1 DOOR # 110 REVISION # 3 SHOWS THE COPIER
 IN THE REQUIRED MANEUVERING CLEARANCES OF THE 2014
 FBC-ACCESS. CODE 404.2.4. AND FIGURE 404.2.4.1. (G).
  
 3) SHEET 3.1 DOOR # 104A ALSO MISSING THE 18 INCHES FOR
 MANEUVERING CLEARANCES ON THE PULL SIDE OF THE DOOR.

 404.2.4.1.(A). PLEASE NOTE TO DATE THERE HAS BEEN NO
 DOCUMENTATION OF MEETING THE REQUIREMENT OF
 DISPROPORTIONATE COST. 2014 FBC-ACCESS. CODE 202.4.1.
  
 4) WHEN RESUBMITTING PLANS PLEASE INDICATE THE REVISION
 & REMOVE ANY VOIDED SHEETS & REPLACE ANY PAGES AS
 NECESSARY. A TRANSMITTAL LETTER LISTING THE ORIGINAL
 REVIEW COMMENT NUMBER, WITH A DESCRIPTION OF THE
 REVISION MADE, IDENTIFYING THE SHEET OR SPECIFICATION
 PAGE WHERE THE CHANGES CAN BE FOUND WILL HELP TO
