 COMMENTS ON BUILDING PLAN:
  
 1. PREVIOUS COMMENT #2 - WAITING ON DETERMINATION FROM
 ENGINEERING SERVICES REGARDING AERIAL EASEMENT FOR
 LIGHTS OVERHANING THE PROPERTY LINE ALONG 47TH STREET
  
 2. PREVIOUS COMMENT #4 WAS NOT ADDRESSED CORRECTLY. THE
 BUILDING DOES NOT MEET THE MINIMUM REQUIRED 70% GLAZING
 REQUIREMENT ALONG THE STREET FACADES. THE SITE IS
 NON-CONFORMING IN RESPECT TO THE GLAZING REQUIREMENT SO
 THE BUILDING CAN NOT DECREASE THE AMOUNT OF EXISTING
 GLAZING PROVIDED UNLESS A VARIANCE IS OBTAINED. THE
 PLAN MUST DEMONSTRATE THAT THE AMOUNT OF GLAZING IS NOT
 DECREASING AND NEW WINDOWS ARE IN COMPLIANCE WITH THE
 BMUD ZONING REGULATIONS - ZLDR SEC. 94-221(D)(5) AND
 ZLDR SEC. 94-221(D)(6)(C) AND (D).
  
 3. CONFIRMATION THAT THE ROOFTOP EQUIPMENT WILL NOT BE
 VISIBLE FROM THE STREET IS A LITTLE VAGUE INDICATING
 TALLEST EQUIPMENT IS +/- 6. A CONDITION WILL BE ADDED
 TO THE PLANS THAT IF ROOFTOP EQUIPMENT IS VISIBLE,
 ADDITIONAL SCREENING WILL BE REQUIRED. [PREVIOUS
 COMMENT #6].
  
 4. THE REAR SETBACK OF THE BUILDING HAS BEEN REDUCED
 FROM 92'-7" TO 92'-1". THE ZONING BOARD OF APPEALS
 GRANTED A WAIVER FOR A MINIMUM SETBACK OF 92'-7" FROM A
 RESIDENTIAL PROPERTY. THIS SETBACK CAN NOT BE REDUCED
 WITHOUT APPROVAL BY THE ZONING BOARD OF APPEALS. PLEASE
 REVISED PLANS TO DEMONSTRATE COMPLIANCE WITH 92'-7"
 SETBACK.
  
  
 COMMENTS ON SITE PLAN:
  
 5. THE LOADING AREA FROM THE SITE PLAN HAS BEEN
 REMOVED. LOADING AREA WILL BE REQUIRED AND MAY OCCUR IN
 PROPOSED PARALLEL PARKING SPACES WITH NOTATION THAT IT
 IS USED BEFORE OR AFTER HOURS OF NORMAL OPERATION SO AS
 NOT TO CONFLICT CUSTOMER PARKING.
  
 6. HAS SANTITATION REVIEWED DUMPSTER LOCATION IN REGARD
 TO PROPOSED NEW CURBING FOR ADA ACCESS? WILL THERE BE
 ANY CONFLICT WITH ACCESSING THE DUMPSTER FOR TRASH
 PICK-UP?
  
  
 ALL GENERAL COMMENTS PREVIOUSLY PROVIDED ARE STILL
 APPLICABLE:
  
 A. APPROVAL OF ZBA 3322 ALLOWS FOR 92'-7" SETBACK FOR
 DRIVE-THROUGH WINDOW EXPANSION FROM A RESIDENTIAL
 ZONING DISTRICT.
  
 B. LANDSCAPE PERMIT IS REQUIRED TO BE SUBMITTED UNDER A
 SEPARATE APPLICATION FOR REVIEW AND A HOLD WAS
 PREVIOUSLY PLACED ON THE FINAL C.O.
  
 C. A SEPARATE PERMIT IS REQUIRED FOR THE PARKING LOT
 STRIPING.
  
 D. A TREE ALTERATION PERMIT IS REQUIRED FOR RELOCATION
 OR REMOVAL OF ANY TREES.
  
 E. SEPARATE PERMIT IS REQUIRED FOR SIGNAGE AND ZONING
 WILL CONDUCT THEIR REVIEW OF THE SIGNAGE AT THAT TIME.
 PLEASE KEEP IN MIND THE PROPOSED SIGNAGE DOES NOT
 APPEAR TO BE IN COMPLIANCE WITH THE ZONING CODE AND
 MUST DEMONSTRATE COMPLIANCE WITH ZLDR SEC. 94-221(E).
  
 F. SEPARATE PERMIT REQUIRED FOR SITE WORK INCLUDING
 BICYCLE RACKS.
  
 G. ALL REFERENCES TO THE CITY'S ZONING AND LAND
 DEVELOPMENT REGULATIONS (ZLDRS) CAN BE FOUND AT
 WWW.MUNICODE.COM AND NAVIGATING TO WEST PALM BEACH.
  
 H. PLEASE PROVIDE WRITTEN RESPONSES TO COMMENTS WHEN
 RESUBMITTING.
