 1) PROVISO: THE FOLLOWING CONDITION WAS LISTED IN
 RESOLUTION NO. 329-13 AS REQUIRED PRIOR TO THE ISSUANCE
 OF THE FIRST BUILDING PERMIT IN ORDER TO ADDRESS
 PERMANENT CONSTRUCTION ACROSS THE PROPERTY LINE. THE
 BUILDING OFFICIAL HAS DETERMINED THAT THE CURRENT
 TEMPORARY CONSTRUCTION EASEMENT WILL SUFFICE FOR
 BUILDING PERMIT TO BE ISSUED; HOWEVER, HE HAS STATED
 THAT THE PERMANENT INSTRUMENT SHALL BE RECORDED IN
 ACCORDANCE WITH THE CONDITION (A. BELOW) PRIOR TO
 ISSUANCE OF THE CO OR TCO, OR THE CONNECTOR BETWEEN THE
 HOTEL AND THE CONVENTION CENTER AND ANY OTHER
 STRUCTURES OR SYSTEMS THAT CROSS THE SHARED PROPERTY
 LINE SHALL BE REMOVED.
  
 A. PRIOR TO THE ISSUANCE OF THE SPECIFIC BUILDING
 PERMIT FOR STRUCTURES OR SYSTEMS THAT CROSS THE SHARED
 PROPERTY LINE WITH THE PALM BEACH COUNTY CONVENTION
 CENTER PARCEL, TO INCLUDE WALKWAY CONNECTIONS, THE
 POOL, POOL DECK, POOL EQUIPMENT, IRRIGATION LINES,
 ETC., THE APPLICANT SHALL RECORD IN THE PUBLIC RECORD A
 UNITY OF TITLE, UNITY OF CONTROL, A RESTRICTIVE
 COVENANT, IN LIEU OF UNITY OF TITLE, OR OTHER
 APPROPRIATE INSTRUMENT, AS APPROVED BY THE OFFICE OF
 THE CITY ATTORNEY, TO ADDRESS THE HOTEL STRUCTURES OR
 SYSTEMS THAT ARE ON THE CONVENTION CENTER PARCEL OR
 WHICH CROSS THE SHARED PROPERTY LINE.
  
 2) THE FOLLOWING CONDITIONS WERE LISTED IN RESOLUTION
 NO. 329-13 AS REQUIRED PRIOR TO THE ISSUANCE OF THE
 FIRST BUILDING PERMIT FOR VERTICAL CONSTRUCTION;
 HOWEVER, UPON ENGINEERING SERVICES DEPARTMENT AND CITY
 SURVEYOR REVIEW OF THE PROJECT AND RELATED PLANS, IT
 HAS BEEN DETERMINED THAT THESE CONDITIONS SHALL BE
 ADDRESSED PRIOR TO THE ISSUANCE OF THE CERTIFICATE OF
 OCCUPANCY.
  
 A. PROVISO: RECORD EASEMENTS IN FAVOR OF THE CITY FOR
 ANY PUBLIC SIDEWALKS OR UTILITIES ON THE HOTEL OR
 PARKING STRUCTURE PARCELS. ****FINAL EASEMENT LOCATIONS
 WILL BE BASED ON THE AS BUILT SURVEY OF THE SITE.****
  
 B. PROVISO: SECURE A RIGHT-OF-WAY PERMIT FROM THE CITY
 FOR THE RECONFIGURATION OF THE MEDIANS AND INSTALLATION
 OF LANDSCAPE MATERIAL WITHIN THE FLORIDA AVENUE
 RIGHT-OF-WAY. AS PART OF THE RECONFIGURATION OF THE
 MEDIANS, THE APPLICANT SHALL INSTALL APPROPRIATE
 SIGNAGE TO WARN MOTORISTS OF THE MID-BLOCK PEDESTRIAN
 CROSSING ON FLORIDA AVENUE IN ACCORDANCE WITH THE
 LATEST VERSION OF THE MANUAL ON UNIFORM TRAFFIC CONTROL
 DEVICES (MUTCD). ****THE ENGINEERING SERVICES
 DEPARTMENT HAS DETERMINED THAT IT IS TOO PREMATURE TO
 ISSUE A RIGHT-OF-WAY PERMIT SINCE THE ACTUAL
 RIGHT-OF-WAY WORK IS NOT SET TO BEGIN UNTIL THE
 CONSTRUCTION IS FURTHER ALONG.****
  
 3) PROVISO: AS PART OF A PERMIT REVISION PRIOR TO THEIR
 INSTALLATION, PROVIDE SHEET E6.02, THE FIXTURE SHEET
 WHICH SHOWS THE SPECIFIC LIGHTING WHICH WILL BE
 PROVIDED FOR THE ART NICHES. THIS SHEET IS REFERENCED
 AS INCLUDED, BUT IS NOT ON THE ELECTRONIC UPLOAD. ALSO,
 PLEASE INCLUDE THE SPEC SHEET.
  
 4) PROVISO: PRIOR TO THE FIRST INSPECTION, THE
 ARCHITECTURAL FLOOR PLAN SHEETS (A3.** SERIES) WHICH DO
 NOT MATCH THE ELEVATIONS AND SHOW THE SOUTHERN WINDOWS
 SHALL BE EITHER CORRECTED OR REMOVED FROM THE PERMIT
 RECORD DRAWINGS (ANY INFORMATION SHALL BE TRANSFERRED
 TO DRAWINGS WHICH REMAIN) SO THAT THERE IS NO FURTHER
 CONFUSION AS TO WHICH FLOOR PLAN DESIGNS APPLY. THE
 A4.** SERIES FLOOR PLANS SHOW THE INFORMATION CORRECTLY
 AND HAVE BEEN STAMPED BY ZONING.
  
 5) PROVISO: PRIOR TO FIRST INSPECTION, THE DATA ON
 SHEET A0.03 SHALL BE REVISED TO BE CORRECT AND TO MATCH
 THE MINOR AMENDMENT DATA.
  
 6) PROVISO: SHEET A3.01 SHOWS DIFFERENT SQUARE FOOTAGE
 NUMBERS FOR THE PUBLIC AREAS (RESTAURANT, BAR, ETC.)
 THAN ON THE SUBMITTED MINOR AMENDMENT AND THE LIFE
 SAFETY PLAN (SHEET A2.02). ADDITIONALLY, NO SQUARE
 FOOTAGE IS PROVIDED FOR THE MARKET. PRIOR TO FIRST
 INSPECTION, THE PLANS SHALL BE REVISED WITH ALL THE
 NUMBERS SHOWN AND BE CONSISTENT AMONG ALL PLANS.
  
 7) PRIOR TO C.O., SEPARATE PERMITS, WITH PLANS, ARE
 REQUIRED FOR THE FOLLOWING ITEMS. THE VALUE OF THE WORK
 SHALL BE SUBMITTED WITH EACH PERMIT AND NOT THE MAIN
 PERMIT. FULL ZONING REVIEW WILL OCCUR UPON SUBMITTAL OF
 THE SEPARATE PERMITS PLANS.
  
 A. SITE FURNITURE THAT WILL BE PERMANENTLY AFFIXED TO
 THE GROUND (EX. TRASH CANS, BENCHES, FIRE PIT, ETC.)
 STAFF HAS REVIEWED THE LOCATIONS OF THE SITE FURNITURE
 AND THEY COMPLY WITH THE APPROVED SITE PLAN.
 B. SITE LIGHTING
 C. BICYCLE RACKS
 D. ENTRY DRIVE - A RIGHT-OF-WAY PERMIT IS REQUIRED FOR
 THE CONNECTION TO FLORIDA AVENUE.
 E. CIVIL PLANS AND RIGHT-OF-WAY PERMIT (THROUGH
 ENGINEERING SERVICES)
 F. SIGNS - SEE COMMENT 10 FOR ADDITIONAL INFORMATION.
 G. POOL, SPA AND POOL DECK H
 H. FENCES/GATES - THE OVERALL HEIGHT OF THE
 FENCE/RETAINING WALL/COLUMNS MAY NOT EXCEED EIGHT (8)
 FEET IN HEIGHT WHEN MEASURED ON THE EXTERIOR SIDE
 (CONVENTION CENTER SIDE) FROM GRADE. DIMENSIONS WERE
 NOT PROVIDED.
