 PLEASE PROVIDE WRITTEN RESPONSES.
  
 1) REPEAT COMMENT: THE RENOVATIONS EXPAND THE SQUARE
 FOOTAGE OF THE SUPERMARKET IN EXCESS OF 10,000 SQUARE
 FEET, THUS REQUIRING APPROVAL OF A CLASS B SPECIAL USE
 PERMIT. PLEASE NOTE THAT THE PREVIOUSLY APPROVED CLASS
 B SPECIAL USE PERMIT APPROVED FOR THE SUPERMARKET
 EXPANSION EXPIRED IN JANUARY OF 2011.
  
 2) REPEAT COMMENT: THE BROADWAY MIXED USE DISTRICT
 REGULATIONS REQUIRE THAT ALL PROPERTIES SHALL BE
 BROUGHT INTO COMPLIANCE WITH THE LANDSCAPE REGULATIONS
 IN ARTICLE XXIV, CONCURRENTLY WITH EXTERIOR BUILDING
 IMPROVEMENTS EXCEEDING $10,000. ADDITIONALLY, THE
 PERMIT VALUE OF $400,000 EXCEEDS 50% OF THE BUILDING
 VALUE ($407,097 ACCORDING TO PAPA), SO THE SITE IS
 REQUIRED TO BE BROUGHT INTO LANDSCAPE COMPLIANCE. THE
 LANDSCAPE PLAN SHALL BE SUBMITTED AS A SEPARATE
 LANDSCAPE PERMIT. IN ACCORDANCE WITH THE ZONING AND
 LAND DEVELOPMENT REGULATIONS, THE LANDSCAPE PLAN SHALL
 BE SIGNED AND SEALED BY A REGISTERED LANDSCAPE
 ARCHITECT, NOT AN ENGINEER. ADDITIONALLY, THE LANDSCAPE
 PLAN SHALL VERIFY COMPLIANCE WITH THE REQUIREMENTS OF
 THE ZONING AND LAND DEVELOPMENT REGULATIONS.
  
 3) REPEAT COMMENT: THE PLAN CONTINUES TO FAIL TO MEET
 MULTIPLE ELEMENTS OF THE BMUD REGULATIONS FOUND IN
 SECTIONS 94-219 AND 94-221 OF THE ZONING AND LAND
 DEVELOPMENT REGULATIONS. STAFF IS NOT GOING TO ITEMIZE
 THE LIST AS IT IS TOO LONG, THE APPLICANT SHALL REVIEW
 AND FOLLOW THE BROADWAY MIXED USE DISTRICT 2
 REGULATIONS TO ENSURE THAT THE DESIGN COMPLIES. THE
 FOLLOWING ITEMS WERE IMMEDIATELY IDENTIFIED BY STAFF AS
 NOT BEING IN COMPLIANCE WHICH WERE NOT CHANGED FROM THE
 PREVIOUS SET OF PLANS AT WHICH POINT THE ZONING STAFF
 STOPPED THE REVIEW UNTIL THE APPLICANT RESUBMITS PLANS
 THAT COMPLY WITH ALL ZONING REGULATIONS.
  
 A. THE PRINCIPAL PEDESTRIAN ENTRANCE IS NOT FACING THE
 BROADWAY FRONTAGE LINE - SECTION 94-221(D)(4).
 B. MECHANICAL SYSTEMS SHALL BE SCREENED FROM VIEW ON
 ALL SIDES TO THE FULL HEIGHT OF THE STRUCTURE BY
 LANDSCAPING OR BUILT ELEMENTS DESIGNED AS AN INTEGRAL
 PART OF THE BUILDING ARCHITECTURE - SECTION
 94-221(D)(8).
  
 4) REPEAT COMMENT: HE PARKING, DUMPSTER, SIGNS,
 LANDSCAPE AND AWNINGS ARE REQUIRED TO MEET CITY CODE
 REQUIREMENTS AND SHALL ALL BE SUBMITTED UNDER SEPARATE
 PERMITS, WITH PLANS.
  
 5) REPEAT COMMENT: PLEASE NOTE THAT THE CORNER OF 49TH
 AND BROADWAY IS A LOCATION OF PUBLIC OPEN SPACE AND
 SHALL BE IMPROVED AS SUCH. THE PLANNING DIVISION HAS
 PREVIOUSLY APPROVED PLANS FOR THE PUBLIC OPEN SPACE.
