 STRUCTURE OR FACILITY FROM THE DUTY TO PROVIDE VERTICAL
 ACCESSIBILITY TO ALL LEVELS ABOVE AND BELOW OCCUPIABLE
 GRADE LEVEL, REGARDLESS OF WHETHER THE CODE REQUIRES AN
 ELEVATOR TO BE INSTALLED IN SUCH BUILDING, STRUCTURE,
 OR FACILITY, EXCEPT FOR: (1) ELEVATOR PITS, ELEVATOR
 PENTHOUSES, MECHANICAL ROOMS, PIPING OR EQUIPMENT
 CATWALKS, AND AUTOMOBILE LUBRICATION AND MAINTENANCE
 PITS AND PLATFORMS; (2) UNOCCUPIABLE SPACES, SUCH AS
 ROOMS, ENCLOSED SPACES, AND STORAGE SPACES THAT ARE NOT
 DESIGNED FOR HUMAN OCCUPANCY, FOR PUBLIC
 ACCOMMODATIONS, OR FOR WORK AREAS; AND (3) OCCUPIABLE
 SPACES AND ROOMS THAT ARE NOT OPEN TO THE PUBLIC AND
 THAT HOUSE NO MORE THAN FIVE PERSONS INCLUDING, BUT NOT
 LIMITED TO, EQUIPMENT CONTROL ROOMS AND PROJECTION
 BOOTHS. HOWEVER, AS PROVIDED IN SECTION 553.509,
 FLORIDA STATUTES, BUILDINGS, STRUCTURES, AND FACILITIES
 MUST, AT A MINIMUM, COMPLY WITH THE REQUIREMENTS OF THE
 ADAAG. THEREFORE, FACILITIES SUBJECT TO THE ADAAG MAY
 BE REQUIRED TO PROVIDE VERTICAL ACCESS TO AREAS
 OTHERWISE EXEMPT UNDER SECTION 11-4.1.3(5) OF THIS
 CODE.
  
 STAFF WILL SIGN OFF ON THE WAIVER REQUEST, THIS PROJECT
 HAS BEEN BROUGHT FORTH TO THE ASSISTANT BUILDING
 OFFICIAL ROBERT BROWN AND THE BUILDING OFFICIAL DOUG
 WISE.
 IN FILLING OUT THE WAIVER REQUEST THE CLAIMS OF
 TECHNICALLY INFESSIBLE AND UNDUE HARDSHIP WILL BE
 SUPPORTED BY THE BUILDING OFFICIAL.

 THIS APPLICATION IS AVAILABLE IN ELECTRONIC FORMAT AT:

 RAP.HTM.
  
 THIS PROCESS DOES TAKE UP TO 2 MONTHS DEPENDING WHEN
 THE WAIVER APPLICATION IS RECEIVED.
 TO BE ABLE TO ISSUE THE PERMIT BEFORE THE BOARD MEETS
 TO REVIEW THE WAIVER REQUEST THE CONTRACTOR AS WELL AS
 THE TENENT WILL NEED TO SIGN AND HAVE A NOTIRIZED
 LETTER STATING THAT IF THE BOARD DOES NOT GRANT THEIR
 WAIVER THEY WILL INSTALL VERTICAL ACCESSIBLITY TO THE
 SECOND FLOOR THAT WILL BE CODE COMPLIANT AND MEET
 EITHER THE REQUIREMENTS FOR AN ELEVATOR 11-4.10 OR
 11-4.11 PLATFORM LIFTS WITH THE REQUIRED SHAFT
 ENCLOSURE THROUGH THE RATED FLOOR SYSTEMS 2007/09 FBC-B
 707.
  
 2) PLEASE REVIEW 11-4.1.6(2) ALTERATIONS TO AN AREA
 CONTAINING A PRIMARY FUNCTION. IN ADDITION TO THE
 REQUIREMENTS OF SECTION 11-4.1.6(1), AN ALTERATION THAT
 AFFECTS OR COULD AFFECT THE USABILITY OF OR ACCESS TO
 AN AREA CONTAINING A PRIMARY FUNCTION SHALL BE MADE SO
 AS TO ENSURE THAT, TO THE MAXIMUM EXTENT FEASIBLE, THE
 PATH OF TRAVEL TO THE ALTERED AREA AND THE RESTROOMS,
 TELEPHONES, AND DRINKING FOUNTAINS SERVING THE ALTERED
 AREA, ARE READILY ACCESSIBLE TO AND USABLE BY
 INDIVIDUALS WITH DISABILITIES, UNLESS SUCH ALTERATIONS
 ARE DISPROPORTIONATE TO THE OVERALL ALTERATIONS TIN
 TERMS OF COST AND SCOPE.
 ALTERATIONS MADE TO PROVIDE AN ACCESSIBLE PATH OF
 TRAVEL TO ALTERED AREAS SHALL BE DEEMED
 DISPROPORTIONATE TO THE OVERALL ALTERATION WHEN THE
 COST EXCEEDS 20 PERCENT OF THE COST OF THE ALTERATION
 TO THE PRIMARY FUNCTION AREA.
  
 DUTY TO PROVIDE ACCESSIBLE FEATURES IN THE EVENT OF
 DISPROPORTIONALITY.
  
 (1) WHEN THE COST OF ALTERATIONS NECESSARY TO MAKE THE
 PATH OF TRAVEL TO THE ALTERED AREA FULLY ACCESSIBLE IS
 DISPROPORTIONATE TO THE COST OF THE OVERALL ALTERATION,
 THE PATH OF TRAVEL SHALL BE MADE ACCESSIBLE TO THE
 EXTENT THAT IT CAN BE MADE ACCESSIBLE WITHOUT INCURRING
 DISPROPORTIONATE COSTS.
  
 (2)(A) IN CHOOSING WHICH ACCESSIBLE ELEMENTS TO
 PROVIDE, PRIORITY SHOULD BE GIVEN TO THOSE ELEMENTS
 THAT WILL PROVIDE THE GREATEST ACCESS, IN THE FOLLOWING
 ORDER:
  
 (I) AN ACCESSIBLE ENTRANCE;
  
 (II) AN ACCESSIBLE ROUTE TO THE ALTERED AREA:
  
 (III) AT LEAST ONE ACCESSIBLE RESTROOM FOR EACH SEX OR
 A SINGLE UNISEX RESTROOM:
  
 (IV) ACCESSIBLE TELEPHONES;
  
 (V) ACCESSIBLE DRINKING FOUNTAINS; AND
  
 (VI) WHEN POSSIBLE, ADDITIONAL ACCESSIBLE ELEMENTS SUCH
 AS PARKING, STORAGE, AND ALARMS.
  
 2A) 11-4.13.6 MANEUVERING CLEARENCES AT DOORS.
  
 2B) IF ANY MONIES ARE LEFT OVER FROM THE 20%
 DISPROPORTIONATE COST THE NEXT AREA TO ADDRESS IS
 ACCESS TO ALTERED AREAS AND THEN ACCESSIBLE RESTROOMS.
  
 PLEASE PROVIDE COST LIST OF WHERE THE 20%
 DISPROPORTIONATE COST WILL OCCUR, THIS DOCUMENT WILL
